    9000 Delaware ( / ˈDɛLəW ɛər / ( listen ) DEL ə -wair ) [ 13] is a state in the Mid-Atlantic region of the United States, [ 14] bordering Maryland to the south and west; Pennsylvania in the north; and New Jersey and the Atlantic Ocean to the east.     Delaware occupies the northeastern part of the Delmarva Peninsula and some islands and territories within the Delaware River. It is the second largest and sixth most populous state, but also the sixth most densely populated state. Delaware’s largest city is Wilmington, and the state capital is Dover, the second largest city in the state. The state is divided into three counties, having the fewest counties of any state; nine0376[a] from north to south, these are New Castle County, Kent County, and Sussex County. While the two southern counties have historically been predominantly agricultural, New Castle is more urbanized, being part of the Delaware Valley Metropolitan Statistical Area with in Philadelphia. Although Delaware is included in the Southern United States by the Census Bureau, Delaware’s geography, culture, and history combine elements of the Mid-Atlantic and Northeast regions of the country. [16]

    Before its coastline was explored by Europeans in the 16th century, Delaware was settled by several groups of Native Americans, including the Lenape to the north and the Nantikoke to the south. It was originally colonized by Dutch traders at Zwaanendael, near the modern city of Lewes, in 1631. Delaware was one of the thirteen colonies that took part in the American Revolution. On December 7, 1787, Delaware became the first state to ratify the United States Constitution, and has been known as the First State . [17] Since the early 20th century, Delaware has also been a de facto onshore corporate haven, in which, by virtue of its corporate laws, the state is home to more than half of all companies listed on the New York Stock Exchange, and more than three fifth Fortune 500 .

    The state was named after Delaware Bay, which in turn took its name from Thomas West, 3rd Baron De La Warr (1577–1618), the first governor of the Colony of Virginia. The Delaware people, the name used by Europeans for the Lenape people, a native population of the Delaware Valley, also takes its name from the same source. nine0007

    The name de La Warr comes from Sussex and is of Anglo-French origin. [18] [19] This probably came from the Norman Lieutenant La Guerra . This toponym may derive from Latin age , from Breton gwern , or from Late Latin varectum (par). Place names Gara, Gare, Gaire (the sound [ä] is often modified into [æ]) are also found in old texts quoted by Lucien Musset, where the word ga(i)ra means blood. It could also be related to a patronymic from Old Norse verr .

    Before Delaware was settled by European colonists, the area was home to the Eastern Algonquian tribes known as the Unami Lenape, or Delaware, who lived mostly along the coast, and the Nantikoke, who occupied much of the southern part of the Delmarva Peninsula. John Smith also shows two Iroquoian tribes, the Kuskarawok and Tokwog, living north of Nanticoke, who may have owned small tracts of land in the western part of the state before they migrated across the Chesapeake Bay. nine0376 [20] The Kuskaravoks were most likely Tuscarora.

    How Many Hours Is a Part-Time Job?

    Have you ever wondered how many hours a part-time job is? Some part-time workers still have full schedules, while others only work a few hours per week. Understanding how part-time hours are different from full-time hours empowers workers to understand their rights and company benefits.

    When people think of part-time work, they usually imagine someone that works between 15 and 30 hours per week. However, part-time hours vary widely depending on the industry, company and employer agreement. 

    Companies cutting down to less than the traditional 40-hour work week complicates our understanding of this topic. 

    Part-time employees work fewer hours per week than their full-time counterparts, but how many hours set these two groups apart? Learn more about part-time work, workers’ benefits and more below.

    What Is Part-Time Work?

    There are no set legal guidelines in the United States surrounding part-time hours or work. The Fair Labor Standards Act does not state how many hours a person has to work to be part-time or full-time. It protects employees the same regardless of how often they work. 

    Company policies typically state the required minimum hours for part-time or full-time workers. They classify workers based on their unique requirements, but part-time workers generally work fewer hours overall. 

    Part-time jobs are available in many industries, such as hospitality, service and retail. With specialized skills, workers can also find positions in more niche industries, like IT or marketing. They can also be entry-level positions.

    What Are the Average Part-Time Hours?

     The average part-time hours worked will vary significantly based on:

    • Industry
    • Type of role
    • Location
    • Other responsibilities
    • Employer agreement

    Every part-time worker is different. They have different schedules and various personal or professional responsibilities that impact their weekly work hours.  

    Additionally, some part-time workers also have multiple part-time jobs. This would indicate that the hours worked in a typical week are likely much higher than other part-time (or even full-time) workers.

    Working 30 hours or less per week is typically considered part-time. However, part-time workers might work more or fewer hours than this per week overall. 

    Are Contractors Considered Part-Time Workers?

     Contractors and part-time employees are not the same.

    Career Coach, Will Rippetoe, explains that part-time workers and contractors do have several factors in common, making it easy to get the two confused. 

    “Almost universally, part-time workers and contract workers have the commonality that they don’t receive full-time benefits, such as PTO and health insurance,” said Rippetoe. “Also, both types of workers do hourly work. But typically, with contractor roles, employers expect a full 40 hours a week as opposed to that part-time schedule. ” 

    Another difference is that contractors are sometimes self-employed, which allows them to create their own schedules. Also called gig workers or freelancers, contractors are not considered employees.

    Like many part-time employees, a contractor likely completes work for multiple companies to maximize their income. A significant difference, however, is that contractors may not have steady employment at any company.

    Another factor to consider is that part-time employees still have taxes withheld from their income. Contractors may not have taxes withheld before receiving payment from a company.

    Do Part-Time Employees Still Receive Full Benefits?

    Some part-time employees receive benefits, but others do not. Additionally, companies may offer part-time employees partial benefits rather than full benefits. 

    Company policies outlined in the employee handbook should explain employee benefits and perks more. This is likely something the human resources department or hiring manager discusses with a hired employee before they start working.  

    This company information will also indicate whether part-time workers have access to any of the benefits or perks that workers often desire. This would include:

    • Health insurance
    • Retirement savings plans
    • Paid time off
    • Vacation days
    • Sick leave
    • Tuition reimbursement
    • Fixed schedule
    • Discounts or free merchandise

    What Benefits Are Part-Time Employees Eligible to Receive?

    Most often, organizations only offer complete benefits packages to full-time employees. There are many reasons for this, but it comes down to company policy. 

    Companies must pay coverage costs if they want to offer benefits. For example, extending these advantages to part-time employees may not be worth the price if they are in a high turnover industry. However, companies may choose to offer benefits to part-time workers to attract top talent. It varies widely in each industry. 

    Part-time employees’ benefits are generally the same as those of full-time employees, including insurance, paid time off, and retirement plans.

    Who Works as Part-Time Employees?

    Many people work part-time, including college students, high school students, interim employees, retirees or parents.

    “Part-time work most makes sense for people whose life circumstances don’t necessarily allow for a full 40-plus hour week,” said Rippetoe. “For instance, maybe you’re trying to do a side hustle or build out your business, or maybe you have a child and you’re a stay-at-home parent. Whatever that circumstance might be, then obviously, that part-time role can actually be a huge benefit in flexibility.”

    Workers may choose part-time positions over full-time positions for a variety of reasons, such as:

    • Family responsibilities

    How Many Hours Is Considered Part-Time In California?

    Is 32 hours full-time in California? What about 40? Is there a limit at all? Generally, part-time means less than 40 hours per week in California.

    That said, there really isn’t a California law that sets a hard line for full-time employment. The California Labor Market Review refers to 35 hours or less as part-time, but again, this is more of a guide than a rule.

    On the Federal side, the Affordable Care Act defines full-time as at least 30 hours. Part-time hours in California usually vary by employer.

    Many employers make an honest effort to properly classify their employees, but some don’t.

    How Do Employers Use Part-Time to Discriminate?

    You may have heard that part-time employees do not get the same protection against discrimination as full-time workers— but this is false.

    California takes discrimination seriously. Know your rights and keep a lookout for attempts to use your part-time status as a reason to discriminate against you.

    Let’s go over some common ways part-time employees are taken advantage of.

    Minimum Wage

    Part-time workers are subject to the same minimum wage regulations as full-time employees.

    California’s minimum wage is $13 per hour and $14 per hour for organizations with more than 26 employees.   The Federal minimum wage is $7.25 per hour.

    Despite what you may have been told, you can’t waive your right to minimum wage, even if you only work part-time. 

    Break Periods

    Some part-time workers are told they are not entitled to breaks. The truth is, you can take meal breaks and rest periods even if you’re part-time.

    Typically, you may take a ten-minute break for every four hours worked. You should also be able to take a thirty-minute meal break if you’re working for more than five hours, and two meal breaks when working more than ten.

    Overtime

    If you’re part-time, that doesn’t mean you can’t get paid overtime. Contrary to popular belief, employers often ask “part-time” employees to work more than 40 hours.

    Regardless of whether you are considered part or full-time, working overtime may entitle you to time and a half or even double your regular pay.

    That said, there are some exceptions to overtime regulations for certain positions. Most of these exceptions are for executive and professional positions.

    Shift Work

    California requires extra pay, called a premium, for split shifts. These are shifts that are broken up throughout the day.

    Working four hours in the morning and four at night is an example of a split shift. Many part-time employees are asked to work split shifts. Fortunately, the regulations don’t prevent part-time workers from split shift premiums.

    Benefits & Pay

    California requires that employees receive pay that is equal to the pay of their colleagues that perform substantially similar work.

    Substantially similar means work that is similar in skill, effort, and responsibility; and that is performed in similar conditions.

    For example, two cooks are likely performing substantially similar work, even if one is part-time. Some employers may try to limit your benefits and pay based on your part-time status, but this is not an exception to equal pay.

    The California Equal Pay Act prohibits this type of abuse.

    Working hours are regulated by the Russian Labor Code. Part-time work is characterized in article 93 as a reduction in working hours, paid in proportion to the number of hours worked, shifts. Part-time work is provided in the application form.

    Switching to part-time work

    Each employee has the right to apply to the employer with a request to switch to work on a shorter schedule. Mandatory approval is possible if the employee belongs to the privileged category of persons. The employer has the right to prohibit everyone else from working under a shortened regime if it is unprofitable for him

    The employer is obliged to accept the application and agree (or refuse) the reduced work schedule.

    Categories of workers for whom the law allows part-time work:

    • mothers-to-be;
    • parent, guardian, guardian of a child under 14 years of age and a disabled child under 18 years of age;
    • a person caring for a sick family member, the state of the disease is confirmed by a medical report.

    The beneficiary can work on a shortened schedule for as long as necessary due to the circumstances that have arisen. The daily routine is adjusted taking into account the needs of the employee and production features.

    The earnings of a part-time worker will be lower. Accrual is carried out taking into account the hours worked (produced for the change of products).

    The shortened schedule can be set both for unlimited time and for a strictly defined period. Conditions are reflected in the employment contract.

    A shortened worker is granted annual leave of at least 28 days. Work experience is not sequestered. The procedure for establishing part-time work is regulated article 93 of the Labor Code of the Russian Federation “Part-time work”.

    What is part-time work

    Part-time work is a form of employment in which the employee’s working hours are less than those specified by law. By agreement between the applicant and the employer when applying for a job, and also subsequently, a reduced day may be fixed (Article 93 of the Labor Code of the Russian Federation). The Labor Code of the Russian Federation does not provide a decoding of the concept of “part-time work”. But the Convention of the International Labor Organization (24.06.1994) No. 175 defines this term as labor time, the duration of which is less than the normal length of the working day. It is important to know that this document has not been ratified by Russia. But commitments were made to consider its provisions for approval by Russian trade unions and employers’ associations.

    An employee must apply for a job or transfer to part-time work. At the same time, he has the right to choose any suitable option:

    • part-time: 4, 5 or 6 hours, not 8.
    • part-time work, such as working eight hours a day but three days a week instead of five;
    • Short day and week mode: work 6 hours a day, three days a week instead of five.

    In addition to the groups of persons listed in the article of the Code who are entitled in accordance with of the Labor Code of the Russian Federation for part-time work, postgraduate students on parental leave and studying in absentia can work part-time.

    Persons who do not belong to any of the privileged categories are also allowed a shorter work schedule.

    How part-time work affects wages and vacations

    By switching to shorter hours, the employee loses earnings. According to Art. 93 of the Labor Code of the Russian Federation , remuneration in such cases is made on the basis of the time actually worked or the volume of production produced.

    The number of days of annual leave is not affected by the partial work schedule. Vacation pay is calculated according to the general rule based on the average daily earnings.

    By multiplying the number of rest days by the average salary per day, the amount of vacation pay is calculated. To calculate the average daily earnings, an annual period and only labor payments are taken. Disability allowance, various social supplements are not taken into account.

    Working in a reduced working day, the employee enjoys the same labor rights as other employees. There should be no infringement of the rights and guarantees of such an employee. But you need to understand that wages, and therefore all payments (sick leave, vacation pay, BIR allowance), calculated on average daily earnings, will be less.

    Does the employer have the right to force them to work part-time

    Fixed by labor legislation, the usual norm of working time is 40 hours a week when working 8 hours with two days off. Working time is the time allotted to the employee to fulfill the labor norm, plan, task. When normal hours of work are shortened, wages are also reduced.

    Curious facts

    Do not confuse part-time work with a reduced one, which is mentioned in Article 93 of the Labor Code and which is established for certain categories of people. For example, for citizens under the age of 16, disabled people, students, workers employed in hazardous areas of production, etc. For such workers, reduced working hours are considered the full norm.     This schedule is not problematic in cases of voluntary transition. Problems can arise when part-time work is introduced at the initiative of the employer, and such a schedule is most often unprofitable for the employee.

    By law, the employer has the right to introduce a part-time work week for up to 6 months. If the employee does not agree with such a change in the work schedule (in this case, he loses pay), the employee is dismissed under part 2 of Art. 81 of the Labor Code of the Russian Federation. In this case, the dismissed person is paid compensation.

    How to apply for a part-time job

    Before a part-time employee is applied for, the employer must determine whether the applicant is a benefit worker or not.

    If the worker is not in the benefits category, you should:

    1. Determine the amount of work available, the expected work tasks and other factors to decide whether the applicant’s request can be granted. If the nature of the work allows, the employer has the right to grant permission.
    2. If an employee is just getting a job, the employment contract indicates in what mode he (at 1/2, at 3/4 of the rate, etc.) will work and what amount of remuneration he will be set for this.
    3. If an already working employee requests a change in work mode, information on the transition to a new work mode is entered in a separate document, by agreement of the parties. It is mandatory to indicate the amount of the full salary for this position and the amount of payment when working part-time, quarter-rate, etc. If necessary, the period for which an additional agreement for part-time work is concluded. A sample of drawing up an additional agreement is not regulated Labor Code of the Russian Federation. The agreement is drawn up in any form, but must be in writing ( article 72 of the Labor Code of the Russian Federation ).

    Accordingly, the accrual of salaries, taxes, disability benefits will be carried out in proportion to the established rate.

    If the employee belongs to one of the categories specified in Art. 93 of the Labor Code of the Russian Federation , the manager is obliged to provide the required work schedule unconditionally.

    Further registration for work takes place in the usual manner.

    It must be remembered that a part-time worker is subject to all labor rights and guarantees provided for by law: payment for sick leave, regular leave, etc.

    Compensation to the employee of income lost due to the fault of the employer

    The Labor Code obliges the employer to compensate the employee for the loss of income if there are such cases as:

    • illegal dismissal, suspension from work, transfer to another place;
    • non-execution of decisions of the court or labor inspectorate, which restored the violated rights of the employee;
    • non-issuance of labor on time or making an incorrect entry in it about the reasons for dismissal.

    In these cases, the employer is obliged to compensate the employee for lost wages.

    The first pension for a part of the month

    How the first pension for a part of the month is calculated, if it is assigned, for example, from the 10th day. The amount of the pension is calculated by the formula:

    A = B x (N – 10) : N, where

    A – the amount of the pension for an incomplete month
    B – the prescribed amount of the pension
    N – the number of days of the month, 30 or 31.

    In such cases, employees of the territorial FIU determine the payment in proportion to the days of accrual. Consequently, only part of the pension is due for an incomplete month.

    Someone decided to temporarily not pay employees anything at all and forced them to take unpaid leave. Others have declared simple. Still others transferred employees to remote work. And someone, like your director, introduced a part-time work regime in the company – NRT. In everyday life, it is often called an incomplete rate.

    But according to the law, it is possible to change the working hours of employees only with their consent and only in certain cases.

    What is part-time work like?

    Art. 91, 93 of the Labor Code of the Russian Federation

    This is how the NRT regime can be:

    1. Part-time work. For example, six hours instead of eight.
    2. Part-time work. For example, work eight hours a day, but not five days a week, but three. Let’s say Tuesday, Wednesday and Thursday.
    3. Mixed mode – part-time work with part-time work week. For example, an employee works two days a week, Tuesday and Wednesday, seven hours a day, and one day a week, Thursday, five hours a day.

    The employer can also set the total working hours, for example 20 hours per week. The main thing at the same time is to work out the set hours, and the time of the beginning and end of the working day and the days of presence at work do not matter.

    The employer can stipulate the NRT condition immediately when hiring an employee – then it is written in the employment contract and indicated in the order for employment. Or an employer can transfer an employee to NRT already in the process of work, for example, if he met the employee halfway and granted his request for a part-time job. In this case, the employer and the employee enter into an additional agreement to the employment contract, after which the employer issues a separate order to establish the NRT regime for a specific employee.

    Employers’ rights

    At the same time, the employer is obliged to establish part-time work at the request of:

    1. A pregnant woman.
    2. One of the parents of a child under 14 or a child with a disability under 18. The same rule applies to guardians and trustees.
    3. An employee who cares for a sick family member, if there is a medical certificate about this.

    NRT workers are entitled to the same guarantees as full-time employees. For example, annual paid leave is not reduced and remains equal to 28 calendar days.

    How part-time work is paid

    A part-time worker is paid in proportion to the hours worked. Therefore, the final amount may be lower than the federal minimum wage of 12,130 R, or lower than the regional minimum wage. This will not be considered a violation, because the minimum wage is calculated on the basis of a full working day.

    In this case, in the employment contract or supplementary agreement to it, the salary must be indicated according to the full rate. Here is an approximate wording: “Payment is made in proportion to the hours worked, based on a salary of 40,000 R per month.”

    How an employment contract works

    When an employee can be transferred to part-time work

    An employer can unilaterally change almost all the terms of an employment contract, including transferring employees to NRT. The only exception: you cannot change the work function of an employee. Those who refuse to work under the new conditions, the employer has the right to dismiss.

    The Labor Code has a universal basis on which an employer can change an employment contract – a change in organizational or technological working conditions under which an employee can no longer work as before.

    Employers are very fond of this reason for its vague wording, but they forget about two important points:

    1. Each employee must be warned in writing about the new working conditions at least two months before the changes. The term for IP is at least 14 days.
    2. Financial difficulties, such as reduced orders, production decline, credit denial, etc., cannot be the primary reason for changing working conditions. The courts have confirmed this in previous crises.

    Changes in organizational or technological working conditions must be real. The Supreme Court clarified what is meant by such a change. These are, for example:

    1. the introduction of new production technologies or the use of new, more modern equipment: machine tools, units, mechanisms;
    2. development of new products;
    3. new technical regulation that changes the usual work cycle;
    4. change in the company’s management structure;
    5. revision of the performance standards for employees.

    A decrease in consumer demand is not a change in organizational or technological working conditions. It turns out that your director had no right to introduce part-time work, especially without warning you about this in advance in writing.

    The notice period is the number of days between your resignation and departure from your current company. Employers ask about your “notice period” on job applications to know how long you need to serve in your current organization before you can jump ship.

    What Is the Typical Notice Period?

    Your employment contract usually specifies the details of your notice period. Typically, you will have a one-week notice period after submitting your resignation if you have worked as an employee for more than a month but less than two years.

    You are entitled to an additional week’s notice for every continuous year between 2 and 12 years. At the same time, employers must provide at least a 12-week notice period for employees who have worked at the company for more than 12 years.

    The length of notice may also vary based on your position in the company. For example, if you hold a highly significant role, you may need more time to train a candidate who will replace you.

    Can My Notice Period Affect My Job Application?

    If the job application mentions keywords like “work immediately” or “as soon as possible,” the recruiter might be reluctant to hire candidates with long notice periods as they expect to fill this position quickly.

    However, a notice period of one or two weeks is usually not considered a deal-breaker. How much notice is tolerated by the employer depends on the position and profile of the candidate.

    Why Is a Notice Period Important For Prospective Employers?

    There are multiple reasons why your prospective employer might ask about your notice period:

    • They want to know your availability to ensure you can start the interview process on time.
    • There is a labor shortage, and they must fill the position ASAP.
    • They want to know how disposable you are. If can get replaced within a few hours, it indicates that you are not essential to the operation of your current company and that you perform low-complexity tasks.

    Note that it is terrible practice for HR to ask about personal information, such as your current notice period. Ideally, HR should ask you to fill out your availability instead.

    Why Is a Notice Period Import For Your Current Employers?

    When you resign, the notice period allows your employer to prepare and find someone who can take over your role in the company. A notice provides your company sufficient time to process your resignation, create a job advertisement, examine applications, and interview candidates for the position. It also gives your employer a chance to delegate your tasks to your co-workers and plan for your absence, especially if your position is not yet filled by the time you leave.

    Notice periods ensure a smooth transition of duties and responsibilities within your workplace. Furthermore, a notice period lets you maintain a positive relationship with your employer. That is because you may need their recommendations when you apply for future positions.

    Final Words

    When filling up a job application form, you might be asked about your current notice period. Typical notice periods that are not a deal-breaker on job applications are one week’s notice and two weeks’ notice.     What is a notice period?

    Put simply, it’s the agreed amount of time you must continue to work after resigning from your job. Or, if you are asked to leave the company for whatever reason, this is the time that you are expected to continue to be employed, and crucially, paid for.

    This time is known as the ‘notice period’. The more senior the role, or the longer your period of service, the longer this period may be. Standard notice is 30 days, if you are a Director, for example, it may be 3 months or more.

    How long is my notice period?

    So, what is your notice period? The length of your notice period should be detailed in your offer letter and/or contract of employment and/or your employee handbook (if you have one).

    The notice period works both ways – whatever amount of time you have to give the employer, they have to give you unless something different is specified in writing. The minimum notice period, even if it’s not written down anywhere, is 1 week, as long as you have worked for a month. The notice period normally runs from the next day after you notify the company of your intention to leave your job. So, the answer to the question, “What is the notice period you need to give your current employer?” is the same number of weeks that they must give you.

    Garden or Gardening Leave

    After you have been asked to leave, your job has been made redundant or you have resigned from your role, you may be put on ‘garden leave’ or ‘gardening leave’ – this means you are still employed, and still entitled to all your contractual benefits, but don’t go into the office or carry out any further work.

    Often, this will happen if you are leaving to join a competitor, for example, in case you take company information with you or contact existing clients, while still working for your existing company. It may be for security reasons or because your employer they don’t want to risk you not performing at your best. Whatever the reason, you should get full pay and benefits while you are on gardening leave – for your full notice period.

    If you have company equipment, a mobile phone, a laptop, etc. your employer will often ask for these back – if you have a company car, they can’t, as it’s a benefit. (Technically so are the phone and laptop, so a discussion should be had if you really wish to keep them for your notice period – but a reasonable employee might surrender these if they aren’t needed anymore).

    Payment in lieu of notice

    If your employer wishes you to leave immediately, they can ask you to do so provided they pay you the full amount you would have received should you work your notice, plus any extras. ‘Pay in lieu of notice’ may be specified in your contract in which case they can ask you to leave immediately but they must still pay you in full.

    This doesn’t mean you can be sacked with no disciplinary, all employment laws still apply, of course. If you resign, they can ask you to go immediately and pay you in lieu of your notice period. You will also receive any unused holiday entitlement as pay (note that this may also be deducted if you have used more than you have accrued).

    Redundancy notice periods

    This is a separate issue, and minimums do apply but they are more clearly defined if you are made redundant.

    The statutory redundancy notice periods are:

    • At least one week’s notice if employed between one month and two years
    • One week’s notice for each year if employed between two and 12 years
    • 12 weeks’ notice if employed for 12 years or more
    • Check your employment contract or employee handbook. Your employer can give you more than the statutory minimum, but they cannot give you less.

    Acas (the Advisory, Conciliation and Arbitration Service) is a very useful public body of the UK Government – they have lots of employment advice on their website, or you can call them on 0300 123 1100 if you’d rather talk to someone.

    Restrictive covenants

    These are the ‘terms and conditions’ of you leaving the business. Your contract may well state that you cannot work in a similar field, or for one of the company’s competitors for a while – typically 6 months, but can be more. These are ‘restrictive covenants’. If you break them, the company could take you to court.

    NOTE: You should seek advice from a legal representative if you are considering breaking any restrictive covenants.

    Some would argue that a covenant can’t stop you from doing your stock in trade – if you’re a trained carpenter and you leave one job then it could be seen as unjust to stop you from working as a carpenter for a competitor – but, always best to get advice on legal matters, perhaps try Citizens Advice for free guidance, or seek out an employment law specialist.

    If your current employer should try to give you less notice than you believe you are entitled to, contact them informally in the first instance to try to resolve it, it might just be a genuine error or miscommunication along the way.

    If the matter isn’t then resolved, perhaps use the company grievance procedure, if there is one. If this still does not resolve it then you may have to take it to an Employment Tribunal, again Citizens Advice or Acas are specialists in this sort of issue.

    Indeed, if you are set on going to a tribunal you must go to Acas first to inform them of your decision. They can then offer the chance to settle the disagreement using their Early Conciliation service – if this doesn’t resolve it, then you can take legal action via Employment Tribunal.

    What happens if I don’t give my employer enough notice?

    The flip side of the coin, is you not giving enough notice to your employer, in which case they can take YOU to court.

    Again, they should try and resolve it informally with you first, it may just be an error or miscalculation on your part or a disagreement over the actual notice period required. If it can’t be resolved and you leave without enough notice, they can take you to court for damages.

    For example, they may have to hire someone to cover your role for the remainder of your notice period.

    Can I shorten my notice period?

    There are several possible ways to effectively reduce your notice period.

    The first is to ask nicely. You can’t expect to be paid for 30 days’ notice if you only work 20, but your employer may be happy to oblige if you’re leaving on good terms.

    Another way is to take holiday leave that you have accrued but not yet used; for example, by taking 5 days’ leave at the end of your notice period you will effectively be working a week less.

    There are other ways to shorten your notice. If your employer has breached your employment contract, you can terminate your contract without notice. Or, if your employer gives notice of dismissal, you could leave at an earlier date by countering.

    Can I challenge a garden leave request?

    Garden leave sounds great – but it can be a real nuisance. You can’t go into the office and in fact, you can’t work anywhere until your notice period is completed and you leave the job. You can look for another job if you don’t have another one already. If you do have another job, then you need to just accept the garden leave and relax.

    However, if you aren’t going to the competition, it’s worth asking your employer to waive the gardening leave. After all, there’s not much damage you could do to the business under the circumstances.

    But, if you ARE joining a competitor,  and refuse to go on garden leave and start with the new company, your current employer could sue you for damages.

    Unless it’s stated in your contract of employment, your employer cannot legally require you to go on garden leave. If they do insist, you can claim breach of contract and that you have therefore been a victim of ‘constructive dismissal’. This is where an employee becomes entitled to resign after a serious breach of contract by the employer. The employee considers themselves ‘dismissed’ and can now take the employer to court or tribunal.

    Examples of contract breaches are:

    • A salary reduction or threatening one
    • Alleged poor performance, with no evidence
    • ‘Unreasonable’ disciplinary proceedings
    • Changing the nature of your job completely
    • Changing working hours without approval
    • Harassment at work
    • Bullying at work
    • Overwork or work-related stress that hasn’t been suitably addressed by the employer
    • Not making reasonable adjustments for workers with disabilities

    How much notice should I give during my probationary period?

    If you wish to hand in your resignation during a probation period then the notice period is often less, it may be just one day. Again, this should be covered in your contract, if not, you could ask the HR team or your line manager, if you’re going to resign regardless.

    If not, then the statutory period could be considered just one week. If you’re leaving on good terms, or wish to, it’s best to be flexible and discuss the company’s requirements, you might not want to leave them in the lurch.

    What is your availability?

    If you’re asked this in a job interview, the answer is basically the duration of your notice period, as once you state that you are leaving, and formally resign, your notice period begins.

    Clarification of the current legislation and legal education

    The only requirement for an employee to freely resign on his own initiative at any time is the obligation of the employee to notify the employer of his dismissal.

    As a general rule, the notice period is two weeks before the day of dismissal. For employees who have been placed on probation upon hiring (during the probationary period), who work under fixed-term employment contracts concluded for a period of less than two months, as well as for employees involved in seasonal work, the notice period is three days. nine0015

    On the contrary, for the head of the organization, employees of internal affairs bodies, a longer notice period for early termination of the contract is set – one month. For employees working for an employer – an individual, the notice period is determined by the employment contract. The establishment of these deadlines is due to the need to provide the employer with the opportunity to timely select a new employee for the vacant position, and at the same time ensures the protection of the employee’s labor rights, giving him the right to withdraw his application before the expiration of the notice of dismissal. nine0015

    The notice period starts on the day after the employer receives the employee’s application for dismissal.

    It is not allowed to unilaterally shorten the deadline for notification of the intention to terminate the employment relationship. There is one exception to this rule, when the reduction of the term is due to the occurrence of certain reasons (events) that make it impossible for the employee to continue working (enrollment in an educational organization, retirement, or other good reasons due to which the employee cannot continue working, for example sending a husband (wife) to work abroad, to a new place of service), as well as in cases of established violation by the employer of labor legislation and other regulatory legal acts containing labor law norms, local regulations, terms of a collective agreement, agreement or employment contract, the employer is obliged to terminate the employment contract within the period specified in the employee’s application.     The notice period may be reduced by agreement between the employee and the employer. So, in the application, the employee has the right to indicate that he asks to dismiss him of his own free will on a certain day, that is, before the expiration of the warning period. The consent of the employer may be expressed in the form of a resolution on the application.

    Before the expiration of the prescribed warning period, the employer does not have the right to issue an order to dismiss the employee under paragraph 3 of part 1 of Art. 77, art. 80 of the Labor Code of the Russian Federation, however, is not deprived of the opportunity to decide on dismissal on the grounds provided for in Art. 81 of the Labor Code of the Russian Federation (termination of an employment contract at the initiative of the employer). nine0015

    Prior to the expiration of the termination notice, the employee has the right to withdraw his or her application at any time. Dismissal in this case is not carried out, except for the case when another employee is invited to his place in writing in the order of transfer from another employer, within one month from the date of dismissal from the previous place of work. The withdrawal of the application must also be made in writing with the fixation of the date of receipt by the employer. In order to avoid abuse by the employer, the employee should keep copies of documents confirming that he sent the revocation of the letter of resignation, received it by the employer. nine0015

    In the event that an employee submits an application for granting him unused vacation followed by dismissal of his own free will, the withdrawal of the application for dismissal is possible only before the start of the vacation.

    After the expiration of the termination notice, the employee has the right to stop working. On the last day of work, the employer is obliged to give the employee a work book, other documents related to work, at the written request of the employee, and make the final settlement with him. nine0015

    If the employment contract has not been terminated after the expiration of the termination notice and the employee does not insist on dismissal, the employment contract continues.

    Dismissal at the initiative of the employee is allowed during the period of temporary disability of the employee and during his stay on vacation.

    In case of disagreement with the dismissal, the employee has the right to apply to the court to resolve the labor dispute. If the employee believes that the employer forced him to file a resignation of his own free will, the obligation to prove this circumstance during the court hearing of the reinstatement case rests with the employee. nine0015

    At the same time, explaining to an employee the possibility of holding him liable in case of illegal actions in the performance of official duties, the existence of grounds for the employer to dismiss the employee on other grounds, does not in itself indicate pressure from the employer. It is not regarded as forced dismissal and the fact that the plaintiff has conflict relations with other employees, his dissatisfaction with working conditions. The current judicial practice proceeds from the fact that an employee, submitting an application to an employer to terminate an employment contract, at his own discretion chooses an acceptable way for him to resolve a labor dispute, by terminating an employment relationship that does not suit him.

      I like that the environment is not only surrounded by education, but also sports. Many teachers grew up in this area and participated in the same activities as students are today. There is a big sense of unity in that aspect. However, the sportsmanship between the schools has/has been toxic for years. There is a sense of superiority from the older schools, which is understandable. However, it is sometimes overwhelming when people doubt your skills and talent because of the school you go to. The sport experience between schools is something that I wish would change for the better.

      I’ve grown up going to Williamsburg-James City County schools, and I’ve had a pleasant experience at each school I’ve gone too. The teachers and staff are so kind and attentive to the students needs, and have no problem helping out a student when they are struggling.

      I like the inclusive atmosphere. We celebrate diversity of people, religions and holidays that are meaningful to all groups of people. More could be done about student language and fighting. Sometimes it goes on too long before an adult gets involved.

    Congrats, you’re no longer a green bean! You are a contributing member of the team, they/we rely on you, to promote the Starbucks experience, create the third place, not just for the customers, but for the team, and we need you to continue your development as a SUPERVISOR. As a supervisor, you will have not only ALL the barista responsibilities, but also MANAGERIAL! Double duty! So you know how you have to scramble to finish everything you have to do each open/close/mid with the paltry number of team members you have? Now on top of that, you also have to count the cash, fill out the books, communicate with the other supervisors and the manager, fill out the orders, count the orders, place the orders, and inventory the orders (after ordering the inventory). You are also responsiblity for QASA, at all times, even when you’re not in the store! If QASA comes in and last night’s delivery is still on the floor at 7am, you know who’s ass is on the line? yours future supervisor. Also, members of the team will need you, in all sorts of ways! Training, un-training, disclosure of documents, passing on of promo materials, correction of recipes used for promo drinks, to push sales, and also, you to pull double duty when a team member doesn’t show up, be they barista, supervisor, or, gasp, manager.

    In all seriousness, the workload of a supervisor is ridiculous compared to a barista, there’s twice as much work involved and at the end of the shift, you don’t even have a cheeseburger in pay over a regular barista who started at the same time as you. You have also have to eat crap, from the customers, from the other supervisors when you pass them the shifts, and from the baristas from the way you run your shift, and the manager for all the above plus the state of the back room. Also, there’ll only be 2, or 3, maybe 4 people in your store you can switch shifts with comes a situation, you will have to coordinate your entire life schedule, including school, family, etc. with these other supervisors in order to give the manager the schedule they want, and god forbids an emergency occurs, imagine the store not opening? omg, dozens of people will miss out of their coffee from that store and will be forced to go to the store down the street! Unlike a barista, who can drop in and out easily, a supervisor is a much more involved position.

    There are a few rewards: If you do want to move up in the company (keep in mind this is the retail side, if you want to work corporate it’ll be much more impressive to be an intern for 6 weeks at HQ in Seattle than be a store manager for 6 years), if you want your manager’s job. This is part of the process and dues you have to pay. Keep in mind once you get to the next step, ASM (assistant store manager), the dues and difficulties will be much higher.

    You get to model the shift you run in the way you want it. That was the main benefit for me during my time as a supervisor, that me and baristas, for a few hours, run the store in an actual focused and efficient manner. People would trade shifts just to get close with me instead of the other supervisors cause I don’t micromanage or put unrealistic expectations. I do expect the work to be done, but I don’t expect the work to do you in.

    You are a bigger part of the team, and if that’s important to you, or you haven’t experienced it, then go for it.

    The cons: The pay:work ratio was lol. The workload increased immensely as well as expectations and the pay raise was unsubstantial. I literally made more money as a barista cause working 40 hours as a barista wouldn’t kill me as much as 30 hours of being a supervisor.

    The target of shit flinging, you will get crap, from above (the manager and sometimes the DM), from the sides (other supervisors ie closers vs. openers, eternal civil war), and from below (the baristas). You’ll be blamed for things totally out of your control, you won’t get credit for your contributions, you’ll have to thank everyone for their crap.

    You don’t learn that much more, I mean, sure, cash counting, running a shift, all these things are basically the results of systems put in place and you learn how to work around glitches, like the safe running wonky, the change order not coming in as expected, or someone not showing up. I feel that if you’re serious about getting to manager, you shouldn’t be a supervisor for more than a year, if that.

    Life is a lot less flexible. As a barista, you can afford a few sick days, switching, even switching in a partner from another store, but as a supervisor that will be really tricky. Flexibility is one of the main attractions of the job, and you lose that when you step up.

    tl;dr If you’re using Starbucks as a part time job (and admit, they’re using you as well), keep it part time and don’t step up or think about promoting until school is over. There’ll be plenty of time to be a miserable supervisor and an even more miserable ASM (DON’T EVEN GET ME STARTED ON THE CRAP INVOLVED WITH ASM). Starbucks is expanding, but when you make Starbucks your priority, you do not. If you want more pay, get a job with more pay and prospects. If you want to get paid to think, don’t go for corporate retail.

    You’ve seen their ads and coveted their clothes — but after reading this, you might just want to start working at lululemon too. After all, the company scored a 4.1 rating and Glassdoor’s coveted Employees’ Choice Awards, honoring the Best Places to Work in  2018, after having scored the same honor in 2017. But what exactly do employees love about it? Here are a few reasons.

    The Perks

    Employees who left reviews on Glassdoor gave lululemon’s benefits a rating of 3.9, citing the company’s impressive fitness reimbursement program as one of its top perks.

    “I felt very valued as a part-time employee with lululemon,” said one former Educator. “As an Educator, I was able to sweat once a week on the company (in other words, was reimbursed up to $25/week to [interact] with the community while promoting my own health and wellness!)” But more than a reimbursement program, lululemon also offers fitness freebies to employees, according to another former Educator, who wrote in a review, “You have a lot of opportunity to improve your own health and wellness through free classes, and company-paid fitness classes, which many employees attend together.

    lululemon also gives employees deep discounts on their products: part-time employees score 40 percent off and full-time employees get 60 percent off, according to reviews.

    Beyond that, lululemon offers “excellent health insurance, including vision and dental,” said a current Manager. “[Plus] a 401k for full- and part-time employees. There is [also] a stock matching program. Overall lululemon takes care of us.”

    The People

    An impressive 86 percent of employees who left reviews on Glassdoor approved of the CEO at lululemon, Laurent Potdevin. And his good leadership seems to have trickled through the rest of the company, as employees report being happy.

    “[lululemon is] an amazing company to work for that truly cares about your development, career, and goals – whether that is within lululemon or somewhere else,” wrote one former Seasonal Educator. Another former Educator said, “the people working there were by far the best people I know. [They are] always so positive and uplifting in any situation.

    The Office Digs and Culture

    As a company that stresses the importance of fitness to their employees, you would expect that the company culture would also be, well, healthy — and according to employees, it is.

    “[lululemon has a] great culture [and] great perks,” wrote one former employee, who added “overall, [lululemon] really preaches goal setting, work-life balance, and a healthy lifestyle.” Another employee called the company culture a “supportive network” promoting “growth.”

    If you work at lululemon, there’s a good chance you’ll work inside one of their store across the U.S., Canada, Australia, New Zealand or Hong Kong. As photos show, those stores are brightly-colored — like lululemon’s clothing — and sometimes have fitness studios inside.

    The Pay

    More than 1,000 salaries have been reported on Glassdoor for lululemon, sharing that wages on average are $12.79 per hour for an educator and about $15.22 for a key leader.

    When you make your way up to a managerial position, you can expect to make more: assistant store managers are paid about $22.42 an hour, while store managers make about $58,253 per year, according to the salaries reported to Glassdoor.

    lululemon is known for helping their patrons achieve a healthy lifestyle, and it seems like they want the same things for their employees, too.     At the end of June 2020, Canadian sports brand Lululemon acquired Mirror, a manufacturer of fitness mirrors. The transaction amount is $500 million. Today we will analyze this transaction.

    Using her example, we will see how to differentiate the product, and how to find growth points, and how to create / involve / strengthen the community.

    A little about the members of

    Few have heard of Lululemon, let alone Mirror in Russia. The former do not have stores in Russia, the latter do not even have a Wkipedia page.

    Lululemon is a sportswear manufacturer specializing in yoga

    The Canadian company was founded in 1998 and started selling yoga clothes. Gradually, the range expanded and now there are dozens of categories.

    Lululemon mostly sells:

    • women – 70% of sales;
    • in North America – 88% of sales;
    • through their own stores and website – 92% of sales.

    A focus on direct customer relationships and community building is the hallmark of Lululemon. For 2019, the latest full year for which data is available, 28% of sales came from their own website. For comparison, Nike has only a third of all sales (online + offline) – direct. Adidas owns online and offline accounts for 60% of sales, but this includes joint ventures and franchises. With the pandemic, of course, the growth of the online share has accelerated for all players.

    In addition to large-scale events traditional for sports retailers, Lululemon open stores with rooms allocated for group classes, cafes, meditation rooms, and recreation areas.

    It looks like this.

    The “Community” section has been moved to the main menu of the site, and the word “community” appears 19 times in the annual reports. For comparison, Nike has 2. Lululemon call their customers “guests”.

    Mirror – $1495 mirror

    Since 2016, Mirror has been manufacturing equipment (mirrors) and software for home workouts. The user connects the smartphone to the mirror via Wi-Fi and selects the appropriate workout.

    In the mirror, the user sees a trainer who shows how to perform the exercises, as well as an indicator of calories and heart rate.

    In the Mirror library, not only recorded workouts, but also live broadcasts. Live broadcasts have a few bells and whistles, like praise from the coach.

    In October 2019, Mirror added personal training.

    Mirror is not cheap. The device will cost $1495, another $250 will have to pay for delivery and installation, a monthly subscription will cost $39. For each personal training you have to pay another $40.

    Effect of COVID-19 on the fitness industry

    How has the epidemic affected fitness?

    1. Fitness clubs are bad . Fitness clubs are not the most profitable business. And when the whole business depends on the physical presence of the client in the premises – even more so.

    It has been reported that 70% of Russian fitness clubs may close by the end of 2020. This is all you need to know about the state of the market at home or abroad.

    2. Sales of sportswear are unstable . Thus, Lululemon’s revenue in the second quarter grew by only 2%. But in the third quarter, growth was already 22%.

    3. The era of sports at home . Some businesses were able to adapt to new conditions, others were not. And the third ones were created for them. A striking example of this is Peloton, a home exercise machine. The company’s revenue in the fourth quarter grew by 172%.

    So, fitness clubs are closed, sales of sportswear are not always growing, and sports can be practiced at home.

    How will Mirror help Lululemon?

    We have come to the main question. Buying Mirror helps Lululemon in five ways.

    Vertical integration

    Behind the pompous descriptions of the vision is a simple task: not to sell more clothes, but to give the consumer everything necessary for a healthy lifestyle.

    What do you need for a healthy lifestyle? On the example of Lululemon:

    • clothing that you feel comfortable in is Lululemon’s core business;
    • sports space – at home with Mirror or at the Lululemon studio;
    • list of exercises – there is a library in the Mirror, on the Lululemon website – too;
    • knowledge of the basics of healthy eating is still a question;
    • healthy food in itself – Lululemon opens restaurants;
    • motivation – when an online coach praises you, you are pleased;
    • support – group classes in stores, digital events and personal trainers;
    • Peace of Mind – Lululemon published meditation lessons on the website.

    Lululemon makes no secret of the fact that being in consumers’ homes is a great advantage. Especially when consumers do not leave these houses.

    Diversification and guaranteed income

    Buying Mirror is not buying an exercise equipment manufacturer, but buying a media company.

    As a modern media company, Mirror operates on a subscription basis. Unlike most media companies, Mirror has its own distribution – that is, its own physical device through which content is broadcast.

    Lululemon knows that they guaranteed part of next quarter’s revenue this quarter. Moreover, by investing $1,700 in buying and shipping a mirror, you will continue to pay for a subscription, even if you rarely use it. Otherwise, it turns out that you have lost a lot of money. And with a subscription, you console yourself with the hope that from Monday you will take up your mind.

    A big plus of Mirror is that Lululemon will earn not only on the sale of the mirror and the subscription. Lululemon uses dozens of Mirror options: advertising platform, consultation channel, fitting room for home or shop, etc.

    Strengthening brand and community ambassadors

    Lululemon and Mirror were linked even before the deal: the former invested in the latter. But this is not the only thing that unites the companies.

    Part of Lululemon’s ambassadors are Mirror’s ambassadors. With the merger of the company, the role of cross-promotion will increase. And that means:

    • part of the audience will get better acquainted with the products of either Lululemon or Mirror;
    • there is an “emotional moat” – “you can not” buy Peloton if you are a buyer of Lululemon;
    • A sense of community temporarily lost due to the pandemic is being restored, where brand ambassadors are the link.

    Additional sales

    The least interesting point is the direct growth in revenue. Lululemon has 491 own store in which the mirror appeared in the fourth quarter.

    Own stores are an important factor for product growth. Firstly, it is easier to sell it when the consumer sees a mirror and tries to do the exercise. Secondly, Mirror’s awareness is growing through stores.

    All Mirror trainers train at Lululemon. These are dozens or even hundreds of influencers whose content (and Lululemon clothing ads) mirror buyers encounter every day.

    Entry into a growing market

    According to an internal Lululemon survey, before the pandemic, 64% of customers exercised at home, while 75% did during the pandemic. 86% of customers who had home equipment do not plan to reduce their activity at home.

    Simply put, more people work from home means more people buy home equipment.

    Final model

    Lululemon expands and integrates new directions. As a result:

    • associations with the brand are being strengthened – comprehensive work on oneself, a healthy lifestyle, community, etc. ;
    • It is easier for a Lululemon client to find information about a healthy lifestyle – not only on clothes, but on meditation, exercises, etc.;
    • community growing – the Lululemon community can be joined by more than just buying clothes.

    Strengthening brand associations is a direct way to increase the number of buyers. A strong brand is the source of true benefits.

    What do we get?

    Switching costs appear. For example, by opting out of Mirror, the user opts out of the community.

    Lululemon’s desire to get into all areas of healthy lifestyle makes it easier for the consumer to solve any problem. Everything is collected in one place – this is a plus.

    The community is the most loyal customers, and they tend to recommend the brand. Recommendations bring new customers.

    Finally, new buyers lower marginal cost and expand the community. Reducing marginal cost is the way to expand your product offering.

    New products linked in the same chain with existing ones bring in new customers and increase LTV.

    What to take away from the deal?

    First, diversification opportunities exist even in the most competitive markets. The company offered a differentiated product from the very beginning. But during the crisis this is not enough. What they did at Lululemon: they looked at the value chain, trends and their own brand, and found the perfect continuation of this brand.

    The second is the importance of a loyal audience. And without Mirror, the Canadian company was building a community. Mirror this community expands and strengthens. And the Lululemon community is real. These are not Instagram followers.

    The customer has previously encountered an Instagram influencer, possibly in training at Lululemon locations. Now nothing prevents her from acquiring this person’s personal training.

    Third, nothing is more important than a complete product. Buying a Mirror suits Lululemon. It fits into the company’s brand, into its vision. And when the product is logical and its components do not contradict each other, the consumer buys more.

    Lululemon’s revenue up 88%

    Lululemon reported that its first-quarter revenue rose 88% to $1.2 billion, up from $652 million last year when stores were temporarily closed due to the pandemic. Net income increased by 57% compared to 2019year.

    According to Lululemon CEO Calvin McDonald in an analyst meeting, the growth of the men’s segment has outpaced the growth of the women’s segment compared to 2020 and 2019.

    Unlike many retailers, the company was in the red a year ago, but net income is still up more than 400% compared to 2020 and 50% compared to 2019 to $145 million.

    The company’s CEO attributed Lululemon’s first-quarter results to a number of factors, including the continued expansion of e-commerce, category performance and returning shoppers to stores.

    Wedbush analyst Jan Redding said the results show growth across channels and continued momentum for leisure sports with no signs of slowing down, even as consumers transition to a new normal post-pandemic.

    The sportswear retailer also said it is committed to its “Power of Three” growth plan, which focuses on product innovation, online and offline customer experience, and market expansion.

    One potential driver of this growth is the company’s investment in Mirror, an interactive training platform that offers live and on-demand classes. Lululemon acquired Mirror a year ago for $500 million as disabled customers sought home workout solutions at the height of the pandemic.

    Mirror, which operates as a stand-alone company, is expected to generate between $250 million and $275 million in revenue this year, according to Kelvin McDonald. By mid-June Mirror will be presented at almost 90 physical stores, and by the holiday season, the company expects to have about 200 stores.

    • To be eligible for enrollment in a district free prekindergarten program, a child must:

      • Be four years of age on or before September 1 of a given school year.   
      • Live within the boundaries of the Houston Independent School District

      AND meet at least one of the following criteria:

      • Child is homeless
      • Child unable to speak or understand English as determined by the Home Language Survey
      • Child is economically disadvantaged
      • Child of an active-duty member of the U.S. military or one who has been killed, injured, or missing in action while on active duty

If additional space is available and there is no waiting list for eligible four-year-old students and non-eligible tuition-paying four-year-old students who reside in HISD, schools have the option of enrolling students who are 3 years of age on September 1 provided they meet the eligibility requirements.

      • After all eligible and ineligible four-year-old students have been enrolled, if there are available seats, schools may then enroll three-year-old students who qualify after April 5, 2023.
      • It is recommended that a waitlist by birthdate be created for three-year-olds so that when enrolling students, they may be close in age and development to their classmates.

    All New York City families with children born in 2020 can enroll for the 2023-2024 school year.

    Children with disabilities or who are learning English can attend 3-K.

    Children do not need to be toilet trained to attend 3-K.

    Education for special children. What to choose?

    There are 16 million schoolchildren in Russia, 12% of them have learning difficulties. The reasons are different: the poor work of teachers, the poor material and technical base of schools, the weak level of preschool education, tense relations in the families of children. And finally, a violation of the normal development of the child.

    Some of the difficulties can be eliminated by moving to another school or studying with tutors. But sometimes the problem goes deeper. Let’s consider in which case it is better for a child to study at school, and when home schooling is more suitable.

    If possible, it is better for the child to study at school

    Full-time education is best suited for children who are comfortable in school. Now I will tell you what to look for when choosing an educational institution.

    Accessible environment. It is important that the school be adapted to the physical needs of the child. It should have devices that help the child be independent.

    For children with cerebral palsy, these are ramps, handrails, an elevator, comfortable door handles, a specially equipped cabin in the toilet.

    For children with visual impairments – tactile signs, sounders, embossed floor tiles.

    For children with hearing impairments – visual duplication of information.

    Children with autism need small, quiet spaces to relax and special signs to explain.

    Schoolchildren’s psychological readiness. Assess how the child is socially adapted.

    An adapted child is calmly in the team. He is ready to learn in a group when they turn not only to him, but to everyone. Such a child adequately interacts with children and teachers, is trained in self-service: he eats himself, goes to the toilet, and gets dressed.

    Teacher readiness. It is important to check whether teachers take into account the individual characteristics of the child. Are they able to work with these features. In general, the standard recommendations for teaching auditory, visual, and kinesthetic learners apply here.

    For example, if a child has a hearing or hearing impairment, the teacher should duplicate oral explanations with slides, demonstrations, text, or sign language.

    We work with hyperactive children at the Light City Center as with kinesthetics. We often switch tasks from one to another, we accompany their performance with movements. For example, you can bend your fingers while counting, trace letters with your finger, or do something while moving around the class. Be sure to include physical education.

    Compliance of the curriculum with the level of development of the child and his characteristics. Depending on the violation and its degree, programs are divided into several types and subtypes. It is important that the school implement the kind of program that suits the child. Which one is suitable is decided by the psychological-medical-pedagogical commission.

    Too easy learning will be boring for the child and will not allow him to fully realize himself. And too complicated will require exorbitant efforts, will negatively affect the psychological state and physical health.

    If all factors are in order, the child is better off in school. The school provides communication, which is important for every person and necessary for the formation of a full-fledged personality.

    Sometimes things go wrong

    It happens that the school is not adapted to the physical characteristics of the child. Or it does not have full-time classes studying according to the desired program. The way out is to study at home. There are three formats for such training, and now I will tell you how to choose the right one.

    Home education is suitable for children who are physically unable to go to school. But the teachers and the program suit both the parents and the child.

    In this format, school teachers come to the child’s home and teach him according to an individual program. There are programs for both intellectually intact children and those with disabilities. And the quality of education depends on the professionalism and enthusiasm of the appointed teachers.

    Benefits. The child studies according to an individual program with a school teacher. At the same time, he remains in comfortable conditions at home. In addition, home education is free.

    Defects. Home education is expensive for the state, so it is not so easy to get it. It is necessary to confirm the needs of the child: documents on disability or illness from the list giving the right to home education.

    Distance learning – for those who find it physically difficult to study at school and home schooling is not suitable. At the same time, the child learns the program quite easily and with interest.

    Children study remotely if they are far away from school, it is difficult to perceive information in the classroom, they fail to establish relationships with classmates.

    In distance learning, the child joins classes via the Internet – online or by appointment – and learns according to the standard program. In this form, you can get any kind of education. The service is provided by both public and private schools.

    If parents know that a child has problems, an adapted educational program can be agreed with the school at the beginning of the school year. It takes into account the individual characteristics of the child, so it will be easier than the standard one.

    The advantage of distance learning over home learning is relative freedom. The child watches lessons and completes tasks at a time convenient for him and his parents.

    The disadvantage is the lack of live contact with the teacher. Parents will have to invest a lot of time and effort to explain incomprehensible things to the child, to captivate and motivate them to study.

    Family form is suitable if the child for some reason cannot study at school and the standard program does not suit him.

    Often the reason for family education is not a child lagging behind, but quite the opposite. Many children develop very quickly, so they get bored at school.

    By decision of the parents, any child can be transferred to family education. This is quite simple, you only need to follow some formalities: for example, conclude an attestation agreement with the school and notify the RONO.

    In family education, parents decide what and how to teach their child. They also choose who to entrust it to: parents themselves, tutors, private clubs and centers can teach.

    Young athletes and musicians often choose family education. Intensive training and trips do not allow them to fully study at school.

    To move on to the next grade, once a year a child takes an assessment in all subjects. A student who has not passed the certification will return to school. As in the case of distance learning, parents can coordinate an adapted program with the school in advance. Then it will be easier for the child to get a certificate.

    The advantage of family education is complete freedom. Parents themselves decide what knowledge is needed, who and how will teach the child.

    Disadvantage – the responsibility for learning lies with the parents. Moreover, such training is often more expensive than usual if parents decide to attract paid teachers. And during certification, the child has to experience stress comparable in level to the exam.

    It is important for children who study at home to be given the opportunity to communicate

    An important feature of homeschooling is the lack of socialization. At school, communication with peers, group interactions are an integral part of the educational process. Only in interaction with other people is a person formed as a person.

    Therefore, with home, distance and family education, the task of parents is to provide the child with the opportunity for socialization. I know at least three solutions to this problem.

    Children’s socializing at playground seems like an obvious way out. Unfortunately, it is not always possible to establish it: modern children do not walk much. Instead, they do their homework, take extra classes, or play gadgets. In addition, it is sometimes difficult for a child not from the class to join the existing company.

    How parents can help. Become for the duration of a walk something like mass entertainers. Organize yard games or hold special meetings for children.

    Mugs and sections is another option. However, classes in circles are usually strictly limited in time, lessons are intense, and breaks are short. Children do not have time to communicate.

    How parents can help. Arrange in advance with other parents about a joint walk after class.

    Communication group or aftercare at private centers . In this case, children have enough time to communicate with their peers. The direction of communication is determined by the topic of the lesson, so there is an additional developmental component. The same children go to the group, so they establish deeper relationships and expand the communicative experience.

    This option has no disadvantages known to me. I recommend communication groups and extensions to all parents who have the opportunity to bring a child.

    Correctional school: do special children really need it?

    What education would be optimal for children with disabilities (HIA)? This question has been worrying many for decades: parents, teachers, doctors, officials. There is no single opinion, as well as identical diagnoses – each child is individual. Some children are able to socialize, others have difficulty in a peer environment. Therefore, the topic belongs to the category of always relevant.

    During the “Honest Route” Yamal Governor Dmitry Artyukhov was asked about the construction of a correctional school in Novy Urengoy. The head of the region expressed his point of view, noting that he was ready to listen to all the arguments “for” and “against”.

    – A separate school for children with disabilities is not true. Today we are building them taking into account accessibility for all categories of the population. New schools are accepted with the necessary equipment – elevators, lifts. We will purchase special educational methods. There is already such an experience in the example of the kindergarten “Viniklyuzia”. We will follow this path,” said Dmitry Artyukhov.

    “The building is outdated”

    Anastasia Garanina, director of the only such school in Novy Urengoy, addressed the governor with a question. It was about a correctional or inclusive correctional institution, she clarified in an interview with a Krasny Sever correspondent.

    – The fact is that the range of health limitations is quite wide and varied in its nosology. Children with mental and intellectual disabilities study in the existing special correctional school. This category of children is difficult to be included in the general educational environment, they have their own specifics of education, – Anastasia Garanina believes. – Defectologist teachers, narrow specialists in various fields work with such children.

    The existing school building is morally and physically obsolete, and it can hardly accommodate all the students for whom it is intended.

    – The city has a good experience of inclusion in general education schools of children with various physical ailments, but with intact intelligence. As for “Sadko” (Center for Social Assistance to Families and Children – ed.), a well-equipped modern institution, it has a different functional purpose. They are engaged in social services, rehabilitation of children with disabilities and the disabled,” commented Anastasia Garanina.

    In her opinion, the school has a different function – educational, correctional process, profiling areas of work.

    There must be a choice

    Irina Alexandrova, deputy director of the Sadko Family and Children Assistance Center, believes that both an inclusive and a correctional school are needed, taking into account the needs of children.

    – If a child is able to join the team, then he can study in an inclusive school, and if he has mental disabilities, then he needs a correctional school. For example, a child in a wheelchair with cerebral palsy will be able to study in a regular school, if conditions are created there, there are special devices, support of tutors, why not. And if a child is not able to master the program of a comprehensive school… I think that there should be a choice,” said Irina Aleksandrova.

    At the same time, there are children with severe mental disorders who, due to their characteristics, cannot join the team. They need a special program, methods, classes with narrow specialists, emphasizes Irina Aleksandrova.

    It is necessary to change the work with disabled children

    Chairman of the regional public organization of parents of disabled children “Mercy” of YaNAO Lyudmila Bednenko advocates the socialization of children with disabilities.

    – Provision should be made for children with disabilities to receive education in general education schools. Unfortunately, there are no programs, tutors, individual approach. At the same time, there are children who, due to their state of health, cannot attend a regular school. It is necessary to change approaches in the field of education in terms of working with children with special needs, – said Lyudmila Bednenko.

    She also noted that correctional school No. 18 needs reconstruction and overhaul. The property is in a deplorable state.

    – Conditions should be created in ordinary schools, then the need for specialized schools will disappear, summed up Lyudmila Bednenko.

    Individual approach to each child

    The Department of Health of the Yamal-Nenets Autonomous Okrug noted that a student with disabilities is a person who has physical or psychological deficiencies, confirmed by the psychological, medical and pedagogical commission and hindering education without creating special conditions. The conditions of training are set collectively by the psychological-medical-pedagogical commission, where they determine what conditions need to be created to obtain a high-quality result. The individual development situation of the student and special educational needs are also taken into account.

    Each child with disabilities should have an individual approach, taking into account the views of parents and the child on the need to create special conditions for learning.

    Viniclusia: Always follow the child!

    The socialization of the youngest Novourengoy people with disabilities is carried out by Viniklyuzia, unique for Yamal. Along with 141 healthy pupils, the kindergarten is attended by 59 special children. And without the help of narrow specialists, tutors and special equipment, they cannot do here.

    “Everything depends on the individual characteristics of each child,” said Natalya Maksimova, deputy director of the institution. – There are groups of 15 people combined, in which there are 3-4 children with special needs. There are groups only with children with disabilities. Everything is very individual. In inclusive kindergartens, there is a rule – always follow the child. If he does not want to be in a team, avoids his peers, then we create such conditions for him. And there are children who do not need special conditions, they are in combined groups.

    Children learn an adapted program in small groups of 5-6 people. It is difficult for them to be in a group with other kids. A psychologist, defectologist, speech therapist, physical education instructor deal with them individually. Each child has their own recovery itinerary. For example, a pupil has a real age of 6 years, but his development is at the level of a three-year-old – the training program is selected accordingly.

    – If a child has a good intellect, then he can be socialized, but if not, an individual approach is needed. We create conditions according to its development. I repeat once again, in inclusive educational organizations we always follow the child, and not the child obeys the rules of the institution, – said the teacher with thirty years of experience working with children.

    At the end of the conversation, she emphasized that “inclusion” cannot be understood one-sidedly – it is not only the integration of children with disabilities into the team, but also the acceptance by each member of a large team of a special child as an equal, the ability to respect his needs and provide support if necessary.

    In the Altai Territory, 81 new cases of coronavirus infection were registered over the past day, 61 patients recovered, 11 people died from COVID-19-11.

    The total number of cases of coronavirus infection is 48,205 people, incl. 3,317 children. Only 43,203 (+61) people have recovered. 2,826 (+11) people died, all adults, including causes of death: coronavirus infection – 1 940 (+11) people; other causes of death – 886 (+0) people.

    As of April 12, 925 people with laboratory-confirmed coronavirus infection are being treated in infectious disease hospitals. In addition, 319 patients with radiologically confirmed viral pneumonia similar to COVID-19 are being treated in covid hospitals. The number of seriously ill patients is 212, of which 84 are connected to ventilators.8, with mechanical ventilation – 284, reserve – 452.

    12 people (asymptomatic virus carriers) are under outpatient observation and treatment. 105 patients with radiologically confirmed viral pneumonia similar to COVID-19 are undergoing outpatient follow-up care in a hospital setting at home.

    Over the past day, 81 new cases (including asymptomatic cases) of coronavirus infection were registered in the region: Barnaul – 24, Rubtsovsk – 13, Biysk – 10, Pospelikhinsky district – 7, Mikhailovsky district – 4, Kalmansky, Pavlovsky districts – by 3 cases, Biysk, Kulundinsky, Soltonsky, Tabunsky, Shipunovsky districts – 2 cases each, Aleysk, Kamen-on-Obi, Slavgorod, Yegoryevsky, Eltsovsky, Zavyalovsky, Krutikhinsky districts – 1 case each.

    Of the total number of cases, 478 cases are imported, incl. 197 – from abroad; 29332 cases – in contact with previously ill persons. Of the 48,205 cases: 12,733 – in patients with community-acquired pneumonia, 27,685 – in patients with acute respiratory viral infections, in 7,787 cases – asymptomatic course.
    In total, 1,345,498 people were examined for a new coronavirus infection in the region. The average daily testing coverage of the inhabitants of the region amounted to 140.52 tests for every 100,000 inhabitants, or 1,030 people per day. The number of tests, taking into account repeated studies, is 1065 over the past day.

    The total amount of vaccine delivered to the Altai Territory was 151,257 kits (component I + component II) of the combined vector vaccine for the prevention of coronavirus infection caused by the SARS-COV-2 virus for immunization of the adult population, primarily from risk groups.

    As of the morning of April 12, 2021, 126,425 (+480) people are being vaccinated, including: 51,542 (+465) people received their first vaccination; 74,883 (+15) people are fully vaccinated (received two shots).
