Shuttered preschool to Metairie parents: Closure had nothing to do with the center’s children | Education

Days after a local church in Metairie abruptly closed its preschool, leaving about 150 families scrambling for care and dozens of teachers looking for new work, the local pastor had a message for members: The school shutdown had nothing to do with “any activity involving children” at the center.

In a statement Friday night, the Rev. Tim Barnes, the pastor of St. Matthew’s United Methodist Church, sought to assuage concerns after the church’s board on Thursday night unanimously decided to shut down the school, which had served families of infants to four-year-olds before the doors were permanently closed Friday morning.

“While I know you all want answers, this is a personnel-related matter, and because of that, information related to personnel and issues of employment must remain confidential,” Barnes said to parents in an email.

A Metairie preschool’s sudden, permanent closure stuns parents: ‘We don’t know why’

“As we discuss the next steps, I appreciate that it is hard to accept this decision, given that we cannot disclose any further information,” Barnes added. “However, I want to underscore two points: this closure is not the result of any activity involving children who have attended the ELC, past or present, and the decision to close was unanimous.

For many parents, however, the statement left more questions than answers, leading some parents and church members to confront Barnes after church service on Sunday morning.

Most families said they learned about the closure when they arrived at the early learning center on Camphor Street on Friday morning, only to find a sign posted on the door saying the daycare was shut down. 

On Facebook, the center’s former director, Jillian Patterson, said she’s looking for a new building to lease in order to start her own center, and urged community members to keep checking her posts “for updates for our new home.”

However, she didn’t address the reason behind the closire or comment on a recent petition aimed at keeping her. 

“I don’t have information regarding their decision,” Patterson said in an interview Monday morning. “What my next step is, is to continue to do what I love to do and to serve the children of the community.”

Even some parent members of the Early Learning Center’s governance board said they were left in the dark about its sudden closure.

Member Todd Palmer said he was confused about why the church’s leadership would shut down an entire school when they could simply let go of individual teachers.

“If you have an issue with any personnel, you have the right to let them go for any reason whether it’s unfounded or not,” Palmer said at the rally on Sunday. “You don’t shut down an entire school with 150 children and 40 plus staff.”

Ren Mayeaux, another parent member of the school’s board, said she hadn’t been privy to the closed-door meeting held by members of the church’s governance board where they voted to close the school.

In a phone interview, Mayeaux cited tensions between Patterson, who had been at the center for 15 years, Barnes, who assumed his duties over the summer, and some governance board members. She said the church had unsuccessfully tried to oust the director days before closing the entire preschool.

Mayeaux had shared a petition on Wednesday, two days before the center closed, urging parents and teachers to “Save St. Matthews ELC” by writing in support of Patterson, suggesting that the director was being “forced to leave.” It had been signed by 684 people by Monday.

Efforts to contact church officials were unsuccessful. No one at the church returned a message left Monday. 

A preliminary records search turned up no legal issues with the director. No financial information was readily available on the church or associated daycare because as a religious organization, St. Matthew’s is exempt from filing a 990, or nonprofit disclosure form.

The Rev. Cynthia Fierro Harvey, who serves as bishop of the Louisiana Annual Conference of The United Methodist Church, also said in an email provided by Mayeaux that she was “aware of the situation,” but essentially is powerless to do anything.

“While I appreciate your concerns, local church staffing is the responsibility of the local church and not the Conference,” Harvey wrote.

In the meantime, other local day care centers, including Beary Cherry Tree Child Care and Carousel Preschool in Metairie, along with St. Matthew the Apostle Catholic School in River Ridge, wrote on local moms’ groups social media accounts that they might have openings for families left without daycares. Some also said they’d accept resumes from some teachers looking for new work.

          How to open a kindergarten in a high-rise apartment – Snob

          Thanks to the demographic policy of the state, since 2019 it has become easier to open a kindergarten on the basis of an ordinary apartment.           In 2014, the problem of huge queues for kindergartens was solved by increasing the number of groups for children over three years old and abolishing nurseries. As a result, nursery groups became a rarity, and mothers were forced to wait three years before returning to work after giving birth. In order not to be “overboard” during a career rise, women began to give birth later, and those who had already given birth were in no hurry “for the second”.

          In this regard, at the beginning of 2019, the implementation of the federal project “Promoting women’s employment – ​​creating conditions for preschool education for children under the age of three” was announced as part of the Demography national project. Here, special attention is paid to preschool institutions, including private ones. The aim of the project is to create additional places for looking after young children so that young parents can return to work more quickly. Then, during pregnancy planning, future parents will not be afraid of “three years of decree”.

          In reality, home kindergartens today successfully operate in the format of a “mini-garden next to your home.” Officially, this activity is called “home care and childcare services.” This form of business is not yet widespread, so people have a question: “Is it legal at all?”

          How to Start a Home Garden

          Virtually anyone can register as a self-employed person, furnish their own or rented apartment, and provide “day care services.

          A license is not required for such a kindergarten, since educational activities are not carried out: children in a group develop basic skills – they learn to make friends, communicate with peers, take care of themselves, etc. Developing interaction takes place in a playful way – songs, exercises, theatrical performances.

          In the home garden, you can hire assistants – a teacher, a nanny, a cleaner. Since the status of an individual entrepreneur is registered, you can easily pay salaries to employees and deduct taxes to the budget. The situation is beneficial for everyone: the entrepreneur earns money (if this is a young mother, then at the same time she looks after her child), parents can bring their children and go to work. The state receives additional jobs, queues for kindergartens are reduced, the treasury is replenished from tax deductions, pension and insurance funds receive additional contributions.

          Housing issue

          The Housing Code allows business activities in residential premises, if it continues to be residential, and is not converted into an office, production, warehouse, hotel or animal shelter: “It is allowed to use residential premises for professional activities or individual entrepreneurial activities legally residing in it citizens, if this does not violate the rights and legitimate interests of other citizens, as well as the requirements that the residential premises must meet.

          But what does “does not violate the rights and legitimate interests of other citizens” mean? We are talking, first of all, about maintaining silence from 23:00 to 07:00, reducing the noise level after 19:00, and the like. The home garden certainly meets these requirements: children are usually brought in at eight in the morning and picked up before seven in the evening, and the garden is closed on weekends.

          Requirements for apartments in which home kindergartens are located are developed by the Federal Service for Surveillance on Consumer Rights Protection and Human Welfare and are regulated by the Sanitary and Epidemiological Requirements for Preschool Groups Placed in Residential Premises of the Housing Stock. The very existence of this document suggests that groups for preschoolers can be opened in apartments.

          Who is responsible for what

          In addition to the housing problem, another question arises – the question of responsibility. Who is responsible for the child and his health while he is in home kindergarten?

          In accordance with Article 1073 of the Civil Code of the Russian Federation, a child under 14 who is temporarily under the supervision of an organization (medical, educational, etc.) is responsible for that organization.

          In practice, responsibility is distributed as follows:

          • The responsibility of the business owner includes creating a safe environment for children that meets all regulatory requirements, as well as recruiting, training and instructing staff (including safety issues).
          • Kindergarten employees’ responsibilities: to comply with regulations, instructions, work procedures and standards in order to provide a safe environment for children.

          Then everything is logical: the owner or employee of the kindergarten is responsible for any emergency, depending on who performed any of their functions in bad faith.

          Relations with neighbors

          When a home garden is opened in an apartment, tenants or owners do everything to make the entrance nice and clean: cosmetic repairs, periodic cleaning. It happens that with the advent of a kindergarten in the yard, old playgrounds are updated. Another plus for the residents: the home kindergarten is a good neighbor. No evening quarrels, nightly gatherings and smoking on the balcony.

          Few people know about the possibility of opening such home kindergartens, so neighbors may worry, hint at the illegality of the establishment, and even apply to city services with a request to conduct an inspection. Usually the issue is resolved by providing the inspection authorities with all the necessary documents. It is enough to have a lease agreement, which states that the relevant services can be provided in the premises, documents for individual entrepreneurs with the relevant OKVED, medical books and employment contracts for employees.

          Owner Relations

          Most home gardens are located in rented apartments. A tenancy agreement is concluded with the owner of the apartment, which also additionally states that childcare is allowed in the premises. Then, as a rule, the landlord makes cosmetic repairs at his own expense.

          It is profitable for owners of premises to rent out their apartments to such tenants for several reasons:

As in any other business, difficulties can arise here, however, the legislative and legal framework is on the side of the entrepreneur, you just need to dive in and study the issue. And most importantly, this business has a high social mission, which is important to understand: we are talking about the most precious thing – about children.

          The Supreme Court upheld the right of the child to go to the nearest kindergarten

The woman handed the child to her grandmother and decided to defend her rights through the courts. Two instances sided with the administration, but the applicant reached the Supreme Court. At the meeting, it turned out that the child was still given a place in the garden, but this did not prevent the Supreme Court from assessing the actions of officials.

          The Supreme Court declared illegal the inaction of the district administration, which could not provide the child with a place in the municipal kindergarten within walking distance from the house. The queue for kindergarten does not excuse officials, because they must anticipate the need for preschool education. Their duty is to take measures in advance so that there are enough places for everyone, the Supreme Court explained with reference to the Resolution of the Constitutional Court of May 15, 2006 No. 5-P.

          The Supreme Court overturned the decisions of the lower courts in the case of Elena Malyshkina* from Murin in the Leningrad Region, who was unable to place her little son in the nearest kindergarten in 2017. The administration explained to her that there was a queue and no places. In return, officials offered a short stay group in Murin or a kindergarten located at 49km in another settlement, the village of Lesnoye. But these options did not suit the mother, who is raising a child alone and had to start earning money, says Kirill Druzhinin, a representative of Malyshkina. “As a result, she had to send her son to her grandmother in the Komi Republic, 2,300 km away, because she has no relatives in the Leningrad Region,” says the lawyer.

          The administration said that there were no places in the nearest kindergarten and suggested an institution 49 km from the house. But this did not suit the woman, because she was raising a child alone and wanted to get a job.

          At the same time, the woman decided through the court to recognize the officials’ inaction as illegal and force them to provide a place in a kindergarten in Murin. She insisted that an institution 49 km from home was not suitable for a child’s daily visit. But two instances sided with the administration. In particular, they referred to paragraph 4 of Art. 67 of the law on education. It establishes that state or municipal educational organizations may refuse admission if there are no places. The courts also took into account that Malyshkina did not choose the maximum possible number of institutions when she entered the electronic queue. In addition, she refused alternative options: a short stay group or a kindergarten at 49km.

          “Physically accessible” education

          Malyshkina disagreed with this and appealed to the Supreme Court. In her cassation appeal (available in the editorial) she recalls that the right to education is one of the fundamental human rights (Article 26 of the Universal Declaration of Human Rights, etc.). It must be accessible not only economically, but also physically. The latter means “safe physical reach when the educational institution is at a reasonable geographical distance” – no more than 300 meters in cities and no more than 500 meters in small settlements, Malyshkin quotes the Code of Rules 42. 13330.2011 “Urban planning. Planning and development of urban and rural settlements.

          The Supreme Court decided whether the administration could refuse placement in the nearest kindergarten because there were no more places.

          According to the mother, the courts did not explain why they did not take into account these standards, and did not justify why it was necessary to select the maximum number of options in the electronic queue. “The administration did not provide evidence that it had taken all the necessary measures to place their son in a kindergarten in accordance with the requirements of the law,” Malyshkina said. Therefore, in her opinion, officials cannot refer to the lack of places in the kindergarten.

          The Supreme Court listened to her arguments and considered the complaint on 12 February. During the meeting, the defendant said that Malyshkina’s son, who was already three years old, was allocated a place in a kindergarten within walking distance from home. Therefore, the civil board, chaired by Igor Zinchenko, considered only one of the requirements – to recognize the administration’s inaction as illegal. The Supreme Court pointed out that the lower courts had overlooked a number of important circumstances: Malyshkina is raising her child alone and a kindergarten in another locality is not suitable for her, because it will prevent her from getting a full-time job. She herself did everything that depended on her to arrange for her son: he was already registered in 2016, when he was one year old and he received the right to apply for a place in the kindergarten.

          “Mother did everything to get her son into kindergarten: she registered him in advance. And the officials failed to fulfill their duties,” – the Supreme Court.

          The administration failed in its duty to provide pre-school education, the Supreme Court ruled. He considered that the defendant was not excused by the queue and the lack of places: according to the Resolution of the Constitutional Court No. 5-P, the state and municipalities are obliged to maintain a sufficient number of kindergartens and, if necessary, open new ones. And if there is not enough money on the ground, they are transferred from the budget.

          Plots

          From this, the Supreme Court concluded that the local government should have anticipated how many kids will be sent to kindergarten, and take measures in advance so that everyone can find a place. The lower authorities have overlooked this. In addition, they did not apply a norm of international law, namely the 1989 Convention on the Rights of the Child. It prescribes that the best interests of the child be a primary consideration […] and that the rights and obligations of his parents, guardians or other persons legally responsible for him be taken into account.”

          With this explanation, the Supreme Court declared the officials’ inaction illegal. “If the administration claims that it “does not have conditions” for placing a child under the law, these are its problems,” Druzhinin explains the meaning of the court order.
