Oak Hill Satanic Ritual Trial

The Oak Hill Satanic Ritual Abuse Trial occurred in Oak Hill, Austin, Texas in 1991 when Fran Keller and her husband Dan, owners of a small daycare, were charged with repeated and sadistic abuse of several children.

The Kellers were found guilty of multiple charges and sentenced to 48 years in prison, but were released in 2013 based on newly disclosed misconduct by prosecutors and other authorities. The charges against them were dropped in 2017 and the Kellers were declared “virtually innocent”, making them eligible for compensation for the lost years of their lives.

In the summer of 1991. The therapist of a three-year-old child treated for behavioral problems due child was raped. The child’s mother contacted the police, who alerted a possible prosecutor in the case, who contacted a friend whose child was also enrolled in daycare and treated by the same therapist. In the pre-trial period, two other kindergarten children made similar allegations. According to the children, the newlyweds served with blood. Kool-Aid and forced them to have sex on video with adults and other children. According to them, the Kellers sometimes wore white robes and lit candles before hurting them. The children also accused the Kellers of forcing them to watch or participate in the killing and dismemberment of cats, dogs, and a crying baby. Bodies were unearthed in cemeteries and new holes dug to hide freshly killed animals, and on one occasion an adult bystander was shot and dismembered with a chainsaw. The children recalled several plane trips, including one to Mexico where they were sexually abused by soldiers before returning to Austin in time to meet their parents at kindergarten. ^[1]

An adult who recently claimed to have regained memories of childhood ritual abuse claimed that the abuse was an example of satanic ritual abuse and the parents began to contact each other, eventually bringing legal action. With information gained from Believe the Kids, an organization set up by parents involved in the earlier McMartin Preschool Trial, children attending Keller Daycare have been repeatedly questioned by parents, therapists, and law enforcement officials as part of the investigation.

Suspicion spread to civil servants, including police officers; one officer’s ex-husband was interrogated for several hours and given two polygraph tests, eventually confessing to child abuse (but not ritual), although he retracted the confession the next morning. Following this confession, the Kellers fled the state, later explaining that their decision was based on harsh sentences given to other child care providers with similar charges. The children were diagnosed with dissociative identity disorder. ^[2]

The Kellers had a six-day trial. The first child to testify against the Kellers claimed that there was no actual abuse, but she was taught to claim that there was abuse. The only physical evidence of abuse in this case was provided by Dr. Michael Move, an emergency room physician at Brackenridge Hospital, who examined a 3-year-old girl in 1991 on the night she first accused Dan Keller of abuse. Move testified at the Kellers’ trial that he found two tears on the girl’s body. hymen consistent with sexual abuse and determined that the injuries were inflicted less than 24 hours ago. Three years after the test, while attending a medical seminar, Move said that a slide presentation of “normal” baby spittle included a photograph that was identical to the one he had observed in a girl. ^[1] ^[3] In 2013, at a new trial, Move stated unequivocally under oath: “I was wrong.” ^[4]

The Kellers were found guilty and sentenced to 48 years each.

Fran Keller went to jail near Marlin, Texas, and Dan Keller went to jail near Amarillo, Texas. ^[4]

Reassessment

Further investigation of the case revealed serious problems: there was no physical evidence of abuse, a denied confession that the investigator did not believe, erroneous medical examinations of children, testimony from a dubious “expert” on satanic ritual abuse, and an allegation of withholding protection information. ^[5] In general, since 1991 there has been more awareness of the unreliability of child testimony and that young children are easily suggestible, meaning that an unethical or simply incompetent investigator can easily extract wild and false statements from children. ^[5]

How a private kindergarten turned out to be the center of a satanic cult where children were tortured

This terrible story took place in the 1990s and was suspiciously quickly forgotten by the media. Nowadays, it is mostly written about in various journals about child psychology, and even then very rarely.

It all started in 1989 when a private daycare called Fran’s Day Care Center opened in Oak Hill, Austin, Texas. On the surface, it was a lovely little oasis, surrounded by picturesque cedars and nestled in pastoral countryside among green hills.

The pretty cottage had playgrounds, a swimming pool, and a small petting zoo with rabbits and ponies. The owners of this place were spouses Fran and Dan Keller who seemed kind, hospitable and accepted even children with behavioral problems into their garden.

For local working parents, this kindergarten seemed like the perfect place and a dream come true. But after a while this place turned into a real dark nightmare.

Ominous clouds began to form when a woman named Susan Challier gave her 3-year-old daughter Christine to the Keller Kindergarten. These were difficult times for Susan, she was just divorcing her husband and because of this the girl had some difficulties with her behavior, she needed care and therapy.

Susan decided that the Keller Center would help her daughter, but after a while the girl’s behavior worsened. She began to constantly lie and behave in bizarre ways, for example, she could enter the living room when guests were sitting there and strip naked in front of everyone.

And these were still flowers. Then Christina began to behave quite wildly, as if she considered herself an animal, she was aggressive, threw herself at her mother with her fists, scratched her, bit her, threw frequent and unreasonable tantrums, and once even tried to stab a harmless family dog with a knife.

Never before, even during the period of the parents’ divorce, had this child behaved in this way, and Susan could not understand what was going on. In 1991, she decided to take her daughter to a session with a psychotherapist, and during conversations with the doctor, the girl suddenly said that in kindergarten, the Kellers subjected her to physical and sexual abuse.

It was a shock to both the doctor and Susan, because the Kellers were generally considered good people, they were highly respected in society and they had no dark histories related to breaking the law, using drugs or drinking alcohol.

Before opening a private kindergarten, Fran Keller worked for many years as a child nanny and then as a kindergarten teacher, and employers never had any complaints about her. Therefore, the girl’s words were treated very suspiciously and in the end they wrote it off as a lie, since she liked to lie a lot.

But then similar oddities in behavior began to be detected in other children who attended the Keller kindergarten. Further, two children immediately said that Fran and her husband touched them in intimate places, beat them, threatened and forced them to be silent about what had happened.

More to come. The children began to tell that the Kellers gave them drinks that were added with blood, and after that the Kellers dressed in white clothes, lit candles and began torturing the children, filming it all on video.

Among the psychological torments were those where children were forced to watch pornographic videos, and they were also forced to kill animals: rabbits, dogs and cats. According to the stories of the children, once a small gorilla was brought to the children’s center from somewhere and forced the children to kill it, and then a human baby was brought and the same fate awaited him.

The more the children told, the more surreal the story became. It turns out that the Kellers also made trips with their children to the local cemetery, where they dug up the dead. And once they took the children by bus to neighboring Mexico, where they brought them to some military base and the soldiers “had fun” with the children all day, after which in the evening the children were taken back to the kindergarten, just in time for the moment when they began to come for them after the work of their parents.

From time to time, the Kellers took the children to the neighboring forest, where they also tortured them, including torturing them with electric current, and in the forest the children were met by strangers who were dressed as ghosts or werewolves. These people subjected the children to a variety of abuses.

To prevent outsiders from knowing what was going on, the Kellers allegedly posted their observers on all nearby roads, who would immediately report if cars appeared there heading towards their center.

Most of this madness resembled some kind of satanic cult. The Kellers were accused of frequently talking about Satan and participating in mysterious secret rituals that the children could not understand. In the center, strange mystical portraits hung on the walls, and children were regularly forced to write incomprehensible occult symbols on the floor and sing songs in an unknown language.

On one occasion, the Kellers allegedly gave a boy a drum that they told him was supposed to summon Satan. Each time, the children were warned that if they told anyone, their parents would be killed, beheaded, and sacrificed to Satan, and their homes burned to the ground.

It was all like a horror movie, or a terrifying fairy tale told in all seriousness by little children. Carol Stalin, whose 4-year-old son Danny was among the victims, described it all this way:0005

“Every aspect of these children’s lives they distorted and perverted. They tortured the rabbit in front of the children and told them it was the Easter Bunny. They kept a flock of doves – doves, the symbol of Christianity. They broke the dove’s wing and then buried the wounded pigeon on the graveyard and the children were also buried. Danny allegedly buried the children himself, and then Fran dug them up seconds before they ran out of air and told them, “Satan spared you.”

It turned out that quite a few parents had previously suspected that something strange was going on with their children at the Keller Kindergarten. For example, when children came home in someone else’s clothes, with wet hair or smeared with something. Suspicious bruises were regularly noticed on the bodies of children, which parents considered just bruises after playing on the playground. It wasn’t until the disclosure began that these parents realized their suspicions were justified.

In almost all cases, the children who told about all this did not show any special behavioral or mental problems before entering the Keller kindergarten, which served as an indirect sign that something frightening was really happening in the kindergarten.

During the investigation, it turned out that the local police and even some government officials were apparently closely associated with the Kellers, in any case, one of the policemen failed a polygraph test when asked about his involvement in child abuse from kindergarten.

When it smelled like fried food, the Kellers closed their center and fled to Las Vegas, where they were found two weeks later and arrested. At the trial, they insisted that they were innocent and that the children had invented everything, and they explained their escape by saying that they did not want to be “crucified by the system” and become victims of a “witch hunt”.

At the trial, both the judge and the jury were shocked by the many ominous and horrific details of what was revealed to their eyes. The Kellers, from beginning to end, strongly denied all the charges against them.

Unfortunately, the prosecution had very little real evidence, except for the oral testimony of several children, almost none. The doctor examining little Christina Chavier stated that her genitals had signs of violence and the hymen was damaged, which was counted in favor of the prosecution, but in subsequent years this diagnosis was considered erroneous for some reason.

An expert on “satanic ritual abuse” was also brought in and said that all signs point to it actually happening. And even then, the Kellers denied everything and assured that the children were lying:

“They portrayed us as monsters and cannibals. At the witness stand, I told them that the little girl (Chavier’s daughter) was a liar and a manipulator, and the prosecutor jumped on me. I was scared, like that child. They ruined my life and my husband’s life. Because of this little girl, we lost everything we’ve ever owned or cared about,” said Fran Keller.

The Kellers were each eventually convicted on multiple harassment and sexual assault charges and sentenced to 48 years in prison. But it didn’t end there. Information soon surfaced about the misdiagnosis of the girl, and then a re-evaluation of the trial was carried out, which concluded that the only direct witnesses to the abuse were 3-4-year-old children, and that, together with their behavioral problems, this made them unreliable, easily suggestible witnesses, with testimony that could also be twisted and shaped to make false statements.

All of this led the state in 2013 to drop all charges against the Kellers, declare them virtually innocent, release them, and even agree to pay compensation for wrongful imprisonment and the loss of so many years of their lives, eventually giving them net compensation at 3.4 million dollars.

It is still very difficult to say what really happened to the Kellers, whether they were just a victim of mass slander due to mass hysteria, or whether they really were Satanists and the children were simply not believed because of their age and psychological immaturity.

Child psychologists believe that young children are quite good at lying and can do it quite convincingly, but the logical question is how could a group of young children get so many details about what they were telling? Dead people, animal torture, pornography, strangers in the woods in strange costumes torturing children, and so on. To this, the supporters of the innocence of the Kellers have an answer that the parents of the children were behind all this, who “persuaded” them to tell all this. True, for what purpose, it is not clear, before this story everyone loved and respected Kellers, and, as they say, there is no smoke without fire …

In recent years, more and more American families have made the fateful decision to live in Texas. Suitcases are packed, furniture and other household belongings are loaded, and “yukhols” of all kinds and sizes rush along the freeways, as the classic used to say, “from the sweet north towards the south.” It is time to ask a question from the same poem: “What drives them? Is it fate’s decision? Wanderlust never arises just like that, from scratch. The reasons for the migration of the population always or almost always lie exclusively in the economic situation.

According to the US Census Bureau for 2006-2007, Texas leads in the influx of migrants. The metropolis of Dallas / Fort Worth, which received 162,000 people, took first place in the country, but other large Texas cities were not far behind. Houston, San Antonio and Austin also made the top ten nationally.

Where are they leaving? From Detroit, Pittsburgh, Cleveland, Columbus, Buffalo…

Why people flee from industrial states like Michigan and Ohio is no secret. A decline in production, a reduction in the number of jobs, low wages against the backdrop of a rapidly rising cost of living. But they also migrate en masse from, at first glance, rich and prosperous California.

Moving to Texas is tempting not only because of the relatively stable economy compared to other US states, but also because of the incredible cheapness of housing. According to real estate experts, home prices in Texas have fallen much less than the national average, and in some areas even continue to rise.

Texas is expected to remain a very attractive and stable place to live during a recession. Not without reason, sixteen percent of Americans who made the difficult decision to move last year came to our state. The influx of migrants, especially migrants who are skilled, educated, able to work and buy housing, always benefits the state’s economy.

In the last year or two, sociologists have been talking more and more about a qualitative change in the structure of population growth in Texas. It’s no secret that the population of Texas has always grown rapidly, but mainly not at the expense of economically independent groups, which created certain social problems: it lowered the average per capita income and dropped the average level of education. The rapid growth of the Hispanic minority into the majority in our state is a separate economic and social problem, which it is better not to touch on the pages of this article, if only for reasons of political correctness. Everyone understands that a family that moves legally to Texas land, speaks English, intends to work, pay taxes and has the means to buy a home – for the state’s economy will be a useful acquisition at all times.

The influx of economically independent population into Texas has a positive effect on the situation in the real estate market. That’s about this burning topic for many – real estate, we decided to talk with realtors from different cities of Texas.

Natalia Chernis, HOUSTON.

– How can Houston attract migrants?

– First of all, a decent state of the economy and, as a result, the job market. While real estate prices in Florida fell by an average of thirty percent, in New York – by fifteen, in good areas of Houston, prices continue to rise stubbornly. Prices have fallen only in places where the pressure of developers to sell houses at all costs led to the fact that loans for real estate were given to families with small incomes. This is where most of the “foreclosure” occurs – sales due to the financial insolvency of the debtors. In areas with favorable demographics and good schools, “foreclosure” is an extremely rare occurrence.

– Have the requirements of banks to borrowers changed due to the current situation?

– Oh, yes! You can’t even imagine how seriously and meticulously they check the financial situation of the family now before issuing a loan to buy real estate, how many papers they require to provide. After all, they take into account not only the total income of the family, but also payments on all loans. For example, all payments on large loans, such as payments for cars or furniture, will be deducted from your income. Banks are afraid of getting burned and try to give loans only to obviously financially wealthy families.

– However, despite the credit situation, there is still a clear “buyer’s market” in Houston right now. What are your tips for buyers?

– Honestly, Houston is always a “buyer’s market”. A lot of new housing is being built. My advice to buyers: bargain. Of course, the buyer takes a risk by making a low offer, but if you wisely play on the panic, on the rumors that nothing is for sale, you can buy a beautiful house in a good area at a reasonable price.

– Well, given that there are persistent rumors among the people that nothing is for sale, what is your advice to sellers?

– In fact, everything is for sale. It is only necessary to put the house on the market for the price for which it has a chance to quickly leave. If there is no need to sell quickly, then you can, of course, set an inflated price and wait for the house to find its buyer. But I wouldn’t recommend it. It is very important when putting up a house for sale that it is properly prepared.

– That’s right – how is it? Leave the house and wash it clean?

– No, it’s just the houses where people live, the houses where the furniture is located, look more attractive. You just need to make the atmosphere at home as neutral as possible. What you can not use, put in boxes and out of sight. Remove family photos from the walls, all sorts of little things from the shelves. The buyer must enter the house, feel the space and try it on. Any buyer is wondering how I will live here? I always help my clients to prepare the house for sale, put it on the market at the right price. The main thing is to be mentally prepared for a change of residence. Indeed, in America, on average, people live in one house for only about five years. If nothing was for sale, where would these statistics come from?

Sergey Petrov, AUSTIN

– Austin is the least “Texan” city compared to Dallas and Houston. It has an old residential center, a huge number of young people and a pronounced bohemian bias in lifestyle. How do these features affect the current state of the real estate market in Austin?

– Yes, Austin is indeed a special city. I have been working in the Austin real estate market for six years and I can say with confidence that sales in our city are constantly growing. If we compare the situation in Austin with the situation in the country as a whole, then our real estate market is doing more than well. And in Austin, a lot is being built and bought up not only houses, but also condos that are ideal for young people.

– A lot of people are moving to Austin from California. They buy houses without haggling, which helps the market to stay afloat.

– Yes, that’s right, mostly employees of high-tech firms are moving from California. In general, the Austin real estate market is in a stable state, as the volume of sales is growing, and the number of homes for sale is decreasing. Therefore, prices are rising. I work with the JBGoodwin agency and can give you some data from their report. If in 2006 the national average sales fell by 8.4%, and the number of homes on the market increased by 23%, then in Austin over the past two years, sales have grown by 12%, and the number of homes on the market is constantly declining. This is due to the expansion of the job market and low interest on loans. Next year, Austin is expected to have a population influx of about 100,000 and about 40,000 new jobs are expected to be created.

– Celebrities are said to love buying real estate in Austin.

– This city has a reputation as the music capital of America, is home to rock festivals and an independent music festival, has a great film studio built here where some Hollywood movies are filmed, so of course celebrities live and own property here. But this fact has little effect on the state of the real estate market.

– What areas of Austin do you personally specialize in?

– I am mainly in sales in South and Southwest Austin. Also, importantly, I help my clients find a loan for the purchase of real estate on favorable terms.

Yuri Golub, DALLAS

– As you know, Dallas came out on top in the country in terms of population growth. People move from other states, settle down, buy housing. This has a positive effect on the real estate market. What do you think causes this situation? What attracts migrants to Dallas?

– Compared to the rest of the country, Dallas is now in a very stable economic situation. People are attracted to reliability, jobs, and above all, Dallas is a huge metropolis that has everything. I also do commercial real estate sales, land sales, and I can say for sure that Dallas real estate is a profitable investment site.

– How many years have you been in the real estate market?

– I’ve only been in real estate for three years, but my whole career, since Russian times, has been related to work in the field of sales.

– So you have a talent to sell?

– Not entirely accurate. To successfully sell, you must first understand what a person needs. I have the ability to find people exactly those houses in which they would like to live. And for this you need to be able to understand the lifestyle of the client, and the characteristics of his character, and the family situation. In short, I help people build the right nest, where they will live comfortably and comfortably, not forgetting that they should also be able to afford this nest.

– Sounds very tempting. What do you build your marketing policy on, how do you attract customers?

– My marketing policy is based mainly on reputation: clients recommend me to each other, and this is the most reliable. After all, you will only recommend to a friend a realtor with whom you are absolutely satisfied. I can stay friends with the client. I recently had a very touching meeting with a longtime client of mine who used to work at Toshiba and used to buy computer parts through me. Now, this old man came down from Atlanta just to see. Human relations – that’s what business should be built on. Some time ago, for example, I was engaged in selecting a room for rent for our Dallas kindergarten “Sunshine”. Found a great option, but the owner was not going to rent out the premises, but would certainly sell. I managed to convince him, with figures in hand, that renting out would be more profitable for him than selling. As a result, the kindergarten received premises for rent, they now have about a hundred children, the business is developing, and everyone is happy.

– What are your plans for the future? Since you have not been in the Dallas real estate market for very long, tell us how you plan to turn around.

– Yes, I have been on the market for three years, but I have already created my own team. I plan to open a Russian branch of Keller Williams Realty.

– In what sense is it Russian?

– I have a strong belief that Dallas real estate is attractive to buyers from Russia, both in terms of investment and in terms of buying a ranch, for example, for personal recreation.

– Ranch?!

– Dallas in Russia has a reputation as a wealthy, successful city. So why don’t Russian businessmen buy a ranch next door to George Bush, after all?! Well, speaking seriously, foreign investment in real estate is a very interesting and promising business.

From small to great: the road that is long in eternity

I would like to start the history of our parish with a hobbit riddle: “What do I have in my pocket?” Can you guess on the first try?

No, not the Ring of Omnipotence, not a cross, not an icon, not a rosary, and not even bread crumbs from prosphora. And in his pocket is a tiny mustard seed from the parable of the Savior. Have any of you attached importance to some mustard seed? Or, in need, did he rejoice at such a “treasure”? “I have a mustard seed in my pocket! With his help, I will move mountains and do something important!” Surely not. And in vain. The Kingdom of God – the greatest of all things – turns out to be something the smallest and most insignificant in this world, in our understanding of the essence of things. The most fundamental, grandiose, enduring, eternal is likened by the Savior to a small grain. And, if what the Lord has sown does not peck at the crows, the grain will sprout, and a few enthusiasts who have gathered in the name of God will begin to cultivate the field.

The founder of our parish was the rector of the church of St. Vladimir in Houston Lubomyr Kupets. In 2001, he celebrated the first Liturgy in Austin. Services were usually held two or three times a year on major holidays. In 2007, the Parish Council was formed and the monthly Divine Liturgy services of Fr. Cassian Sibley, rector of the temple in honor of the icon of the Inexhaustible Chalice, in Brian, TH. Since October 2008, Hieromonk Aidan Keller began to serve in the chapel. In 2010, with the blessing of Bishop Peter of Chicago and Central America, the chapel-caravan of the Intercession of the Virgin moved to its present location, to a house in Pflugerville, converted into a temple, where regular services have been held since the beginning of 2011. In 2020, Hieromonk Aidan Keller was transferred to the monastery of Sts. Sergius and Herman in Michigan, and Fr. Moses McPherson, Cleric of St. Vladimir’s in Ann Arbor, Michigan.

Sown Fr. By Lubomir and a handful of parishioners, the grain gave abundant shoots. Today, the Church operates the Sisterhood of the Holy Myrrh-Bearing Women, a Sunday school in the name of St. Nicholas the Wonderworker, the Orthodox Board chess club, annual Pokrovka and Easter festivals, charity events for packing and distributing Christmas gifts for those in need, Christmas performances are staged, and children’s art exhibitions, pilgrimages to nearby monasteries are organized. The boys of the parish participate in the St. Herman of Alaska Orthodox Scouting Group. An Orthodox library in Russian and English has been created at the temple and is constantly updated.

As you can see from the above, special attention in our temple is given to the younger generation. There is an interesting image in Psalm 126: sons are compared to arrows in a quiver. Arrows travel faster and hit targets at a greater distance than people armed with a sword. Each new generation must go further than its parents, solve more serious problems. The church here is likened to a bow pulling a bowstring with an arrow. We are responsible for where these arrows go. Therefore, the task of maximum church education is to form in the child the image of a hero as a hero of faith, setting as an example people who have responded to God’s call, and showing them the glory of Christ revealed in their lives. Sacred History and the Russian Church are rich in such examples.

Classes in Sunday school are conducted in the form of a heuristic conversation: the material is presented in a simple, accessible language, and the children draw all the conclusions themselves with the help of the teacher’s leading questions. Visual aids are also used: icons, illustrations, props. Pupils of the younger group usually make crafts on the topic of the lesson. Visualization and applied aspect are designed to help you remember the material better.

The purpose of the Sunday school is exclusively religious education, instilling in children a love for the Church, Sacred History, the lives of saints and the Divine Liturgy, so that church life would not be a burden, but a joy. The annual charity wrapping Christmas gifts for the poor, held before the evening of St. Nicholas the Wonderworker on December 18, with carol singing, wassail (hot apple compote with cinnamon) and a light dinner, fills the need of young people to act, fulfill themselves and feel needed through service to others. Despite the fact that the action is organized by the Sunday school, the entire parish is invited to participate. The collection of gifts begins in early November. A box is placed in the corner of the candle shop, where parishioners donate socks, hygiene items, and sweets. The event begins with a prayer to St. Nicholas, who, imitating Christ, was a generous giver (the notorious image of Santa Claus is based on the famous saint). The action teaches us to give and bring joy to our neighbors, so that “beautiful impulses of the soul” do not fade away with the pre-Christmas brilliance of trees and lights.

At the same time, we do not leave attention to the cultural component. In preparation for the Intercession Autumn Festivals, timed to coincide with our patronal feast, children are immersed in the world of Russian folklore traditions. The history of the holiday is connected with the liberation of Constantinople from the siege of foreigners through the intercession of the Most Holy Theotokos in 910. In Russia, the celebration of the Intercession was established by St. Andrei Bogolyubsky in 1164, at the same time he erected the famous Church of the Intercession on the Nerl. The celebration falls on October 14th. By this time, the first frosts and snowfalls came, field work stopped, leisure life began, and Pokrovsky fairs were held. In our temple, with boxes filled with all sorts of things, peddlers come out. Proceeds from sales go to the building fund. By the grace of God, we hope to build a real temple.

Contract Oak (Austin, TX)

B Treaty Oak is a Texas Living Oak tree in Austin, Texas, United States, and the last surviving member of the Council of Oaks, a grove of 14 trees that served as a sacred meeting place for the Comanche and Tonkawa tribes prior to European settlement of the area. Foresters estimate the age of the Treaty oak at about 500 years. ^[1] Prior to the vandalism in 1989, the tree’s branches spanned 127 feet (39 m). The tree is located in Treaty Oak Park, on Baylor Street between 5th and 6th streets, in Austin. West Line Historic District.

History and legenda Native American legend says that Council Oaks was the site of war and peace parties. Legends also state that women of the Tejas tribe drink tea made from honey and oak acorns to ensure the safety of warriors in battle.

According to popular local folklore, as well as a plaque at the base of the tree, early Texan pioneer Stephen F. Austin met local Native Americans in a grove in the 1830s to negotiate and sign the first Texas boundary treaty. after two children and a local judge were killed in raids. There are no historical documents confirming that this event actually took place. Folklore also holds that Sam Houston rested under the Treaty Oak after being ousted from the Governor’s office at the start of Texas’ involvement in the American Civil War. ^[1]

History

As more and more European Americans settled in Texas, Oaks Council fell victim to the neglect and development of the City of Austin. By 1927, only one of the 14 original trees remained. The American Forest Association proclaimed this tree the most perfect example of a North American tree and included the Treaty Oak in its Hall of Fame in Washington, DC.

Since the 1880s, the tree has been privately owned by the Caldwell family of Austin. Because she could no longer pay property taxes on land, at 1926 widow W.H. Caldwell put the land up for sale for $7,000. While local historical groups urged the Texas Legislature No funds were allocated to purchase the land. In 1937, the city of Austin bought the land for $1,000 and erected a plaque commemorating the tree’s role in Texas history.

Vandalism

In 1989, as a result of deliberate vandalism, a tree was poisoned by a powerful hardwood. Velpar herbicide. Laboratory tests showed that the herbicide used would be enough to kill 100 trees. ^[2] The incident sparked public outrage, national news reports, and a flood of homemade “Get Well” cards for children that were posted on the fence around the park. Texas industrialist Ross Perot wrote a blank check to fund efforts to save the tree. ^[3] Herbicide manufacturer DuPont set a $10,000 reward for the poisoner. The vandal, Paul Cullen, was apprehended after reportedly boasting of poisoning a tree as a means of casting the spell. ^[4] Cullen was found guilty of a felony and sentenced to nine years in prison.

Intense efforts to save the Treaty Oak included adding sugar to the root zone, replacing the soil around the roots, and installing a system to spray the tree with spring water. Even though the arborists expected the tree to die, the Treaty Oak survived.
