In Adygeya, ecologist Valery Brinikh was acquitted of charges of extremism after nearly three years of trial. Prosecutors saw incitement to hatred in the article “Silence of the Lambs” about problems with waste in a pig-breeding complex, and they saw an insult to local residents in the word “lambs”. The ecologist intends to demand compensation for the persecution. According to experts, an acquittal in an extremism case is a rare event.

On Monday, the Maykop City Court dismissed the criminal case on extremism of the 53-year-old chairman of the Adyghe republican branch of the All-Russian Society for the Conservation of Nature, director of the Institute for Regional Biological Research Valery Brinikh, due to lack of corpus delicti. He was accused under Art. 282 of the Criminal Code of the Russian Federation (inciting hatred or enmity). “In court, the public prosecutor filed a motion to drop the charges and terminate the criminal case. The judge satisfied him, ”the ecologist’s lawyer Alexander Popkov told Kommersant. The article “Silence of the Lambs”, which the prosecutors saw as extremism, was written by Mr. Brynykh in 2014 after talking with residents of the settlements adjacent to the “Kyevo-Zhuraki APK” pig farm. According to ecologists, the volume of treatment facilities in the pig farm is several times less than necessary, as a result, manure ends up in the fields and in the water.

Prosecutors became interested in the article, and the forensic center of the Central Internal Affairs Directorate of the Krasnodar Territory confirmed their suspicions. “The examination said that lambs are a negative synonym for the Adyghe people. In addition, they saw an insult to women, since the lamb is the son of a sheep. In Voltaire’s quote “God helps those battalions that shoot better” and in the continuation “So let’s shoot better”, the experts saw a call to shoot at officials,” Mr. Popkov said. Nevertheless, at the trial, three experts from Moscow, Nizhny Novgorod and Stavropol stated that they did not see extremism in the text. Another examination, appointed by the court and carried out by the Krasnodar laboratory of the Ministry of Justice, also did not find inciting hostility and hatred in the article. The prosecutor’s office achieved the annulment of the decision of the examination and the direction of the publication for a new study – to the Moscow Institute of Criminalistics of the FSB of Russia. “The result was discouraging – they also did not find extremism, but only harsh but acceptable criticism,” says Mr. Popkov. “After that, the issue was resolved in 20 minutes,” Valery Brinikh explained to Kommersant.

Now the ecologist intends to seek compensation – he spent a long time under house arrest. “The psychologist calculates the moral damage. There is also material – lost profits. I had many orders, including government contracts. As soon as a criminal case was initiated, they were terminated,” says Mr. Brinih. He adds that the problems with the pig farm have not been resolved. “We fought with one owner, a senator from Karachay-Cherkessia, but in 2015 he sold the business. Whether the new owner will spend money on the introduction of modern cleaning technologies is unclear,” says the ecologist.

“The expertise of the FSB institute played a key role,” says Pavel Chikov, head of the Agora international human rights group. He noted to Kommersant that there were only a few acquittals in the case of extremism. “Usually cases are stopped at the investigation stage. In our practice, so far there has been only one acquittal under Art. 282, and then the defendant was found guilty under other articles,” says Mr. Chikov.
