So why do we publish our rates when so many other schools require you to call? People generally price shop for “commodities” like gas or groceries. Child care is not a commodity and all preschools are not the same. The parents that choose for their child or children to attend our program value the many qualities of our school. So how do we differentiate ourselves from other programs? Well, our teachers are amazing, our schools are immaculate, you can watch your child using our camera system, we cook and prepare the meals for our children, and we actually teach the children in our care while providing lots of love. We truly do “Touch hearts and build minds”!

*For contracts only, a 5% total tuition discount is extended to all Active Duty Military, Police Officers, Fire Fighters, Nurses (LPN or RN) or Medical Doctors with appropriate ID

    An employee works as a teacher in a preschool institution in a speech therapy group in two shifts, in fact, he performs work at two rates of a teacher for an additional payment.

    What is the maximum number of hours a caregiver can work at one position? Can an employee work at two rates in one institution and how to properly arrange such a job?

    When setting working hours for teachers and other employees, the employer must take into account the requirement of labor legislation to comply with normal working hours.

    According to Art. 91 of the Labor Code of the Russian Federation, the normal working time cannot exceed 40 hours per week. According to Art. 92, as well as Art. 333 of the Labor Code of the Russian Federation for teachers, a reduced working time is established, which is no more than 36 hours per week. At the same time, the duration of working time (norms of hours of pedagogical work for the wage rate) is determined by the Government of the Russian Federation depending on the position and (or) specialty. Clause 3 of the Appendix to the order of the Ministry of Education and Science of the Russian Federation of December 24, 2010 N 2075 “On the duration of working hours (norm of hours of pedagogical work for the wage rate) of pedagogical workers” establishes that for educators in preschool educational institutions the norm of hours of pedagogical work for the wage rate pay is 36 hours a week.

    Thus, for the wage rate, the caregiver must work 36 hours a week.

    As a general rule established by art. 60.1 of the Labor Code of the Russian Federation, performing other regular paid work for the same employer in his spare time from his main job is an internal part-time job. In case of part-time employment (both external and internal), work is performed on the basis of a separate employment contract, which must specify the conditions for remuneration (including the size of the tariff rate or salary (official salary) of the employee, additional payments, allowances and incentive payments) ( article 57, article 60.1 and article 282 of the Labor Code of the Russian Federation).

    In this case, it should be taken into account that in accordance with paragraphs. “e” paragraph 2 of the Decree of the Ministry of Labor of the Russian Federation of 30.06.2003 N 41 “On the features of part-time work of pedagogical, medical, pharmaceutical workers and cultural workers” (hereinafter – Decree N 41) for pedagogical workers is not considered part-time work and does not require a conclusion (registration ) of an employment contract teaching work in the same preschool educational institution with additional payment. It should be noted that such work will not be part-time work, provided that the employee performs it during the main working hours with the consent of the employer (clause 2 of Resolution N 41).

    This norm, however, does not prohibit performing the work specified in it in free time from the main job on a part-time basis. According to paragraph 1 of Decree N 41, part-time work for a teacher is the performance of other regular paid work on the terms of an employment contract in their free time from their main job at their main place of work or in other organizations, including in a similar position, specialty, profession, and in cases where reduced working hours are established (with the exception of work for which sanitary and hygienic restrictions are established by the regulatory legal acts of the Russian Federation) (see also the decision of the Supreme Court of the Russian Federation of December 21, 2006 N GKPI06-1518.

    Thus, if an employee can perform additional work only in his spare time from his main job, a separate employment contract for part-time work can be concluded with a teacher. On the basis of such an employment contract, the employer must issue an order (instruction) to hire an employee in a unified form N T-1, approved by the Decree of the State Statistics Committee of the Russian Federation of 01/05/2004 N 1.

    By virtue of clause 1 of Resolution N 41, the duration of work of teaching staff part-time within a month is established by agreement between the employee and the employer and for each employment contract it cannot exceed: for teachers – half the monthly norm of working time, calculated from the established duration of the working week; for teachers who have half of the monthly norm of working time for their main job is less than 16 hours per week – 16 hours of work per week.

    Thus, with a caregiver who agrees to work on two rates, an employment contract for full-time work (36 hours a week) and two employment contracts for internal part-time work for no more than half-time each (for 18 hours) can be concluded in Week). Registration of several employment contracts on work on the terms of internal combination with the same employer does not contradict labor legislation (part two of article 282 of the Labor Code of the Russian Federation, clause 1 of the Resolution).
