2020-10-27 Unannounced Monitoring 3270.113(a)(1) – Staff assigned to specific children Needs Verification

Noncompliance Area: SECOND CITATION: On 10/27/2020 at approximately 7:45 am, observed staff person #1, #2 and #3 supervising a group of 22 school age children in the school-age classroom. When asked to identify the children in her group, staff person #1 stated, “we have 21 children” and proceeded to name the children in her group. Staff person #1 identified 9 children in her group and struggled with finding the children while they were moving around the classroom. Staff person #2 identified 12 children in her group. Staff person #3 was sitting at a table to check in children as they arrived and was not assigned any children. When asked to identify the child that was unassigned, staff person #1 was unsure who it was. After looking at the roster and the name cards on the desk she was able to identify the remaining child. The entire process took approximately 10 minutes to identify all of the children in the room. PREVIOUSLY CITED on 09/03/2020.

Correction Required: Each staff person shall be assigned the responsibility for supervision of specific children. The staff person shall know the names and whereabouts of the children in his assigned group. The staff person shall be physically present with the children in his group on the facility premises and on facility excursions off the facility premises.

Staff #1 tends to get flustered when a licensing representative is in the facility, management has worked with her to try to get her to relax and just do her job like she does when licensing is not in the facility but she still gets flustered. Management told staff #1 to switch with staff #3 and become the temperature taker and attendance tracker. The staff member taking temps and attendance will call out the names of the children entering the room. Management will continue to monitor the classroom asking how many children they have and who is in each primary group.

There were 23 children in the room at the time and only 22 children were identified, another school-age child arrived while assessing supervision and ratio, for a total of 24 children.

The medical reason shall be documented in a statement signed by a physician, physician’s assistant or CRNP and placed in the child’s record at the facility.

All staff working in the infant classroom were reminded that infants are not to sleep in the swing and that if an infant falls asleep while in the swing they are to be immediately placed in their crib. A sign has been attached to the wall behind the swing as an extra reminder. The infant that was sleeping in the swing does not have a signed statement from the physician. Moving forward the Director and Office Assistant will monitor the classroom to ensure that no infants are sleeping in the swing.

In a mixed age level, the staff to child ratio is 1:10 when the youngest child in the group is preschool age. While assessing supervision and ratio, another school age child arrived for a total of 20 school-age and 4 preschool age children.

The Pre-School aged children were shifted back to their classroom. A staff memo on ratios was handed out to all of the classrooms reminding staff of the regulation requirements and that when transitioning children they need to keep each classroom in ratio at all times. Staff #3 will take a training on staff to child ratios as part of the reprimand for not being in ratio of 1 to 10. Staff #4 was a new staff member who had not yet completed the health and safety training, it is now completed. Moving forward when we transition children the staff will confirm how many children are already in the classroom before bringing younger children into the room. The Director and Office Assistant will monitor all classrooms to ensure every room is following the ratio requirements.

The pack-n-play was removed from the classroom, we tried sewing the mesh side that was torn. The repair did not last and we threw the toy pack-n-play away. Staff have been reminded about checking toys weekly from broken/torn/cracked toys. If the toy can be repaired it will be placed back in the classroom; if a toy can not be repaired it will be thrown away.
