As used in this chapter, the following terms
shall have the meanings indicated:
CHILD-CARE CENTER and CENTER
Any home or facility that is maintained for the development
and supervision of six or more children under six years of age for
greater than two hours per day and less than 24 hours per day for
at least two days per week. This term shall not include:
A.
Recreational facilities utilized on a drop-in
basis.
B.
Any program where there is no agreement, written
or verbal, between the parent/guardian and the program for the program
to assume responsibility for the care of the child.
C.
Kindergartens.
D.
Centers that are a part of a private educational
institution offering elementary education in grades kindergarten through
sixth, seventh or eighth.
E.
Centers operated by the Board of Education of
a local school district.
F.
Centers operated primarily for religious instruction.
HEALTH OFFICIAL
A licensed registered environmental health specialist or
health officer or public health nurse.

License required.
No person shall conduct or maintain any child-care
center without first having obtained a license therefor from the Division
of Health.
§ 104-3
Nontransferability of license; expiration date; fee.

A.
The license shall not be transferable.
B.
All licenses shall expire on December 31 of the year
of issuance.
C.
A licensing and inspection fee of $75 per year is
hereby established.
§ 104-4
Food service.
A.
Facilities, equipment and procedures used for the
preparation, storage and service of food, whether on or off the premises,
shall comply with all applicable provisions of Chapter XII of the
New Jersey State Sanitary Code, N.
J.A.C. 8:24.
B.
Any caterer providing food for children under the
supervision of the child-care center shall be licensed by the local,
county or state Department of Health.
§ 104-5
Health requirements.
[Amended by Ord. No. 4-1995]
A.
The center shall maintain on file an up-to-date immunization
record for children in accordance with the provisions of N.J.A.C.
8:57-4.
B.
Prior to beginning work at the center, all newly hired
full- and part-time employees must submit written proof of the results
of a Mantoux intradermal tuberculin test to the center. Prior to beginning
service, volunteers who serve 10 or more hours per month at the center
must submit written proof of the results of a Mantoux intradermal
tuberculin test to the center. The documented Mantoux test must have
been administered within six months prior to beginning work or service
at the center or as directed by the local Board of Health.

The center shall exclude a staff member who poses
a threat of tuberculosis contagion.[1]

§ 104-6
Revocation and suspension of license.
A license issued pursuant to this chapter may
be revoked or suspended by the Health Official, after notice, for
a violation of this chapter or when, in the judgment of the Health
Official, further operation of the child-care center is determined
not to be conducive to the well-being of children.
§ 104-7
Violations and penalties.
Any person who violates the provisions of this
chapter shall, upon conviction thereof, pay a fine not exceeding $500.

Livingstone was born in Livingstone, York to Continental Congressman Walter Livingston (1740–1797) and Cornelia Schuyler (1746–1822). [2] [3] He was baptized on June 12, 1768, and was probably born on the same day. [4] His sister Gertrude Livingston (1778–1864), who married William Cutting (1773–1820), was the mother of Frances Brockholst Cutting (1804–1870), also a U.S. Representative from New York’s 8th congressional district. His younger sister, Harriet Livingston (1783–1826), was married to Robert Fulton (1765–1815). [5] His paternal grandfather was Robert Livingston (1708–1790), 3rd Lord of Livingston Manor.
[3] His mother was the granddaughter of Peter Schuyler (1657–1724), 1st Mayor of Albany.
He graduated from Yale College in 1786, [6] studied law, was admitted to the bar and began practice in New York. [1]
Career
From 2 October 1787 to 11 September 1789 Livingston was a clerk in the office of Alexander Hamilton, who issued him on 29 April 1790 a “certificate of office” stating that ” he is of good moral character.” [7]
From 1792 to 1794 he was private secretary to Governor Morris, who was then Minister to France. [8]
Livingston was then judged by the Court of Common Pleas of the District of Columbia. He was a member of the New York State Assembly in 1802 and again in 1810. He was elected a Federalist to the 8th and 9th Congresses, serving from March 4, 1803 to March 3, 1807. [1]
Private life
In 1796 [9] he married Mary Masters Allen (1776–1855), daughter of James Allen (1742–1778) and granddaughter of William Allen (1704–1780), Chief Justice of Pennsylvania, and great granddaughter Andrew Hamilton (c.
1676–1741), as Speaker of the Pennsylvania House of Representatives, members of a prominent Pennsylvania family. [10] They were parents: [11]
- Henry Walter Livingston (1798–1848), who married Caroline de Grasse de Pau (1806–1871), daughter of Francis de Pau, French shipping magnate and slave trader , and Sylvie de Grasse, daughter of a French count, in 1823. [9]
- Walter Livingston (1799–1872), married Mary Livingston Greenleaf (1802–1886), daughter of James Greenleaf, in 1828 [12]
- James Allen Livingston (1801–1825), deceased single in Rouen, France
- Mary Livingston (1803–1880), who married James Thomson Jr. (d. 1847) in 1825.
- Elizabeth Livingston (1807–1860), who married William Denning Henderson (1803–1852) in 1828.

He died at his home in Livingston, New York, on December 22, 1810.

Henry W. Livingston and his wife were buried in a vault in the Henry W House. Livingston. In 1904, the crypt was broken into, apparently by grave robbers. Biography
E. Livingston was born May 26, 1764 in Clermont, Columbia County, New York. He was a descendant of the legendary Robert Livingstons .
After graduating from Princeton University in 1781, Livingston opens his own law practice in New York a few years later (1985).
In the period from 1795 to 1801, E. Livingston represented the interests of the Republican Party in the US Congress.
In 1801, Livingston was appointed District Attorney of the State of New York and at the same time Mayor of the City of New York. After a serious illness due to the past epidemic of “yellow fever”, Livingston decides to retire. This was served by the fact that during his absence, many lawsuits were failed and their confidentiality was revealed. The government allocates funds for E. Livingston’s team, which he was able to return in 1826 in full.
In 1804, Livingston arrives in Louisiana, where he creates a series of legal codes that are designed to transform them into a new legal system. This set of laws was adopted in 1805 and lasted until 1825.
In 1807, Livingston holds a successful lawsuit, as a result of which he becomes the owner of land near New Orleans.
During the war with England in 1812-1815, Livingston calls the population to the people’s militia. In 1814-1815, E. Livingston was a consultant and adjutant to General Andrew Jackson.
In 1821 Livingston again worked on the creation of a new penal code and criminal procedure law.

Edward Livingston was a prominent American statesman and talented lawyer. He was an influential figure in the political life of the United States of America and was the author of various legal documents and writings, including of the Louisiana Civil Code (1825), which in spirit and ideas was largely based on the Napoleonic code.
Livingston was born on May 26, 1764, in the USA, the city of Clermont, Columbia County, in the state of New York. He was from a noble and noble family of Robert Livingstons.
In 1781, E. Livingston graduated from Princeton University with a degree in law.
In 1985 he moved to New York, where he opened his private law practice. At this time, differences are rapidly growing in the legislative law of many states of America, which Livingston must take into account in his work and introduce more and more new comments on the laws.
From 1795 to 1801 he was a representative of the Republican political party and represented its interests in the United States Congress. E. Livingston was one of the leaders of the opposition to the so-called “Jay treaty” and on this occasion introduced his own resolution, which called on President George Washington to present to Congress the details of negotiations with Great Britain on a peace treaty. The president refused to reveal details.
At the end of George Washington’s term, Livingston, together with E. Jackson and a number of other radicals, voted in favor of the president and his policies.
In 1800, Livingston, being a well-known opponent of foreigners violating American laws, asked the President to extradite a British sailor who had committed murder on an English frigate and then fled to South Carolina, calling himself an American citizen. Livingston’s position was defended by Presidential Press Secretary John Marshall.
In 1801 E. Livingston was appointed District Attorney of the State of New York. Simultaneously with this position, E. Livingston was elected mayor of the city of New York.
In the summer of 1803 New York was hit by an epidemic of “yellow fever” and E. Livingston could hardly endure the attack of this serious illness. Residents of the city, knowing about his suffering, expressed sympathy and hope for a speedy recovery of the esteemed mayor and prosecutor. When Livingston recovered, he noted with chagrin that judicial and state affairs had fallen into disrepair, and many of them ended in failure due to the dishonest actions of some of his subordinates.
But the government of the state allocated special funds to Livingston to support his affairs. The decency of E. Livingston did not allow him to continue to work in this position, and in a situation where the confidentiality of some trials was violated, E. Livingston, due to his responsibility for his employees, could not endure such a situation, and resigned. His decision was supported by two of his divisions.
Gathering his faithful companions, Livingston, at the beginning of 1804 moved with all his staff to Louisiana. E. Livingston was able to return the government funds spent on the restoration of incomplete and previously failed New York lawsuits in full only in 1826, due to the opening of a serious legal practice in New Orleans.
Upon arrival in Louisiana, E. Livingston launched a vigorous activity to create a new legal system. The fact is that in this state all legal law was based on Roman, French and Spanish legislation. Livingston was tasked with reforming these laws and creating a new legal system.
A new code of laws, created by Edward Livingston, was adopted in April 1805 and lasted until 1825.
In 1807, as a result of a successful trial for the improvement of his client’s land, Livingston obtained the right to use some of these lands in the Battura area, near New Orleans. The result of this process for Livingston was not only the acquisition of property, but also the achievement of the universal respect of the citizens and the governor of the state.
During the war with England in 1812-1815, E. Livingston actively propagated among the population of New Orleans to create a people’s militia and join the resistance. During this period, in 1814-1815, Livingston became a voluntary consultant and at the same time aide-de-camp to General Andrew Jackson, who was his personal friend.
Having accepted a new appointment to the legislature of the country, Livingstone in 1821 began to prepare a new criminal code and criminal procedure law. Subsequently, these codes became known in Europe and America under the name Livingston Code .
The judicial practice of Louisina adopted the publication of a code of laws in two state languages, therefore Livingston Code was published in English and French and consisted of four sections: 1) crime; 2) punishment; 3) evidence procedure in criminal cases; 4) reform of prison discipline. This set of documents was highly appreciated by the European legislative bodies and published in large numbers in England, Germany and France. Livingston Code was notable for its simplicity and energetic presentation of legal language.
The Livingston Prison Code and Reform was adopted by the United States in Central America under the liberal rule of President Francisco Morzan.
In 1825, Livingston worked almost single-handedly to create a new civil code, which emphasized sections that included the work of citizens under a labor contract.
From 1823 to 1829 Livingston served in the US Senate, and at the end of 1829 becomes the 11th United States Secretary of State under President Andrew Jackson.
During his public service, Livingston prepared a number of important government documents, chief among which was the document repealing the proclamation of December 10, 1832. President Jackson considered Edward Livingston his most trusted political adviser.
From 1833 to 1835 Livingston was sent to France as minister and authorized ambassador. His mission was to resolve the conflict between the US and France, which violated the agreements regarding certain cargo deliveries. France was ordered to pay a fine of twenty-five million francs. As a result of negotiations, the United States agreed to pay France one and a half million francs as part of compensation to settle the claims. E. Livingston and the US government were pleased with the outcome of the negotiations, but the French Chamber of Deputies refused to allocate funds to pay for the first shipment under the 1833 treaty. As a result of these events, relations between the two countries deteriorated sharply, and Livingston was instructed to close the diplomatic mission in France and return to America.
Shortly after returning home, Edward Livingston died. He died on May 23, 1836 at Montgomery near New York. E. Livingston was married twice. His first wife died in 1801 and they lived together for thirteen years. Three years after the death of his first wife, Livingston married a second time to the beautiful and intellectual Louise Moreau de Lassi, who bore the surname D’Avezac as a girl. At one time, she fled due to revolutionary actions in Santa Domingo and settled in New Orleans. Having outlived Livingston by nineteen years, she always noted her great influence on her husband’s public career.
Edward Livingston, by virtue of his services to the nation and his role in international diplomatic relations, can rightly be called “the diamond of legal reform.”
