— They took off my pants and threw me on the floor. I was naked from the waist down, it was very cold. They told me the gist of the testimonies of the victims and demanded that my testimonies correspond to them. The employee put a flat object to my face near the ear and started hitting it. There was noise in my head, I was deaf in my left ear. I didn’t understand why they asked me such strange questions: where is my wig, when I shaved and where is my father now. The employee began to look for a “butt stick” and threatened to insert it into my anus, threatened with electric shock. I was assured that if my words confirmed the testimony of the victims, then everything would be over, ”Mikhail Gubin wrote to his wife from the pre-trial detention center.

The police write that everything was different: Mikhail resisted, so they used violence against him. He tried to strangle himself through the bench and banged his head against the walls.

He got there for the following reason: for 120 seconds his car stood in front of the playground. Mikhail claims that he stopped to pee, the security forces – to commit a crime of a sexual nature: he showed the children a penis in order to test sexual attraction to them. During these two minutes, Gubin received 12 years in a strict regime colony and one year of restriction of freedom.

We tried to figure out what was wrong in this complicated story, why the man could be accused, what witnesses say, and how the Gubin family lives now.

On September 12 last year, Mikhail was building a greenhouse. The wife asked her husband to go for medicines. Mikhail agreed and went to the pharmacy. On the way back, he stopped at Kazarovo.

When I saw the mosque, I turned around, drove about 200 meters and stopped at a brick wall. He slightly opened the car and, as he himself claims, while sitting in the cabin, he relieved himself on the road, because he could not stand it. Opposite, behind an iron fence, little girls and their brother were playing on the playground. The red Matiz stood in front of the children for two minutes. At this time, one girl noticed Mikhail and came closer. The rest continued to play.

— When he returned, I didn’t think he looked any different. Everything was as usual, – says Tatyana Gubina, Mikhail’s wife.

Afterward, friends came to the family, they all spent the evening together. Closer to 22:00 there was a knock on the gate. Mikhail went out to open the door, and Tatyana stood in the corridor.

— I waited a few minutes and went out to see where my husband had gone. But there was no one there. At first I thought that the neighbors needed some help: anything can happen. They waited a little more – and began to call her husband. It turned out that he left the phone at home. We got worried,” says Mikhail’s wife.

While the wife was looking for her husband, Mikhail was already in the SIZO. He recalls how he was taken to the department.

— One of the men said that I was detained. He turned me around, pulled the belt out of my jeans, wrapped it around my wrists, tilted me face down, pulled the hood of my sweatshirt over my face. They asked me: to take me straight to the forest or for interrogation? Obscene language and threats sounded in my direction all the way, – Mikhail describes the moment of detention.

About three hours later investigators came to the house where Tatyana was. Then they seized computers, flash drives and Mikhail’s personal belongings. The woman at that time did not understand what was happening and why she was being asked questions about her husband.

— I didn’t know then that I was testifying against my husband. I had the right not to give them. They asked how the day went, what the husband did, where he went and on what. What exactly was going on, it was impossible to understand. Then there was a search. They confiscated the children’s computer, the husband’s work computer, his phone, – says Tatyana.

With relatives, Mikhail’s wife called all departments of the Tyumen police. It turned out that the husband was being held in the administrative cell of police station No. 6 for petty hooliganism. Tatyana was able to see him only the next day after the arrest.

— When I saw him, the sight was terrible. He had a huge bruise under his eye, there were a lot of bruises behind his ears, his face was swollen. It was obvious that he was in shock. He said he got into a fight with a cellmate. Then, when we were able to contact him in the pre-trial detention center, he said that at that time there were people in the office who beat him. A few days later we received a letter from him – urgently send a lawyer. Through him, he sent a letter about what happened to him. He said that he was beaten, he was required to confess to a crime that he did not commit. Specifically, he was brought to article 132 of the Criminal Code of the Russian Federation, – says Tatyana.

At that time, as Mikhail wrote in a letter, several police officers tortured him. According to the man, he was beaten with a stick, after which his ear stopped hearing and hallucinations began.

— I was tormented by headache, delirium and hallucinations, thirst. I understood that I could no longer endure such an interrogation, and did not want to experience the current that I was threatened with. I put together in my head a version of events that corresponded to the testimony of the victims,” Mikhail says in a letter.

In the letter, the man says that after a night of torture he was taken to the chief’s office. The security officer, according to Mikhail, was filled with sympathy and promised that after the confession, the man would be released home and given a suspended sentence. Having trusted the policeman, he decided to tell a lie – only to be released, Mikhail claims. But this did not happen.

— I opened the driver’s door, unzipped my fly, took out my penis, took it in my hands. While looking at the girls. One of them saw, said the other, both began to look. At this time, he lifted his penis to achieve an erection. The girls started laughing and ran away. Then I buttoned my fly back, it became embarrassing, I couldn’t get aroused, – Mikhail gave such testimony then.

On that day, September 12, two girls and a boy were playing on the court: 11-year-old Alina, 7-year-old Damira and 2-year-old Sasha. That day Michael stopped at the gate of their house. It will turn out at the trial: then Alina thought that guests had arrived on the red Matiz, and ran to look. At this time, according to Mikhail, he relieved himself and did not see the children.

Alina did not understand what the man was doing in the car. She ran home with her sister and brother and told everything to her mother. The girl explained that there was a red car near the house, in which “uncle is holding his genitals.” Mom told the police. The children and their parents were summoned for interrogation, and for the first time the children could not explain that Mikhail p and sal. The children described the man in the red car as being old and bald, which does not fit the description of the 37-year-old man at all. There were further interrogations, where Alina already explained that the stranger urinated. But this testimony did not play any role.

– The children were scared, surprised, I was in shock. For the first two hours, I didn’t know what to do at all. When they began to discuss in detail, the daughter said that she had seen him urinate. She didn’t say this before,” Alina’s mother told the court.

She explained that she was frightened by this situation, because recently there was a high-profile story with Nastya Muravyova, a schoolgirl who was raped and killed. Later, Alina’s mother admitted that during the second interrogation, the investigator advised her daughter to adhere to the first testimony. The mother of the second girl said that she had not discussed this situation with her daughter at all.

– I saw a puddle near the driver’s door. There was a puddle, but I don’t know what it is,” the driver said at the trial.

37-year-old Mikhail Gubin worked as a programmer. He is interested in drumming and music. Tatyana describes her husband as a calm, kind and sympathetic person. They have been together for 20 years and have three children. The couple dreamed of their home and travel. Tatyana is sure that she will do everything to make her last dream come true.

— It is unrealistic to imagine that he could do this. He has a lot of friends. Not a single person could believe that Misha could even think of such a thing. We have always dreamed of a big family, which we have achieved: we have three children. They dreamed of their own house – they took it on a mortgage. But, unfortunately, now I’m alone in her crying at . We didn’t have time to travel around the world,” says Tatiana about her husband.

The psychological examination concluded that Mikhail has no impairments. Doctors noted in his character the desire to avoid conflicts and focus on generally accepted norms of behavior. The experts concluded that there are no sexual disorders in a man.

On April 28, 2022, the Central District Court of Tyumen found Mikhail Gubin guilty of sexual assault against minors. The man was sentenced to 12 years in a strict regime colony and 1 year of restriction of liberty. The court considered that Mikhail violated the normal psychological development of children, the right to immunity and caused them moral harm. Among the evidence is the first interrogation of the children and Mikhail’s confession.

The content of the verdict also contains an expert’s opinion: spermatozoa were found on Mikhail’s long-sleeved T-shirt (it was in the laundry basket). Biological traces were found on the steering wheel of a red car. Why this was included in the case and what relation the clothes from the basket have to the situation as a whole, Tatyana still did not understand. No traces of semen were found on the clothes that Mikhail was wearing on September 12, the woman says.

The document states that Gubin’s arguments about the use of torture were checked by the court, but were not confirmed. They also questioned the veracity of Michael’s words. The protocol says that at first, during interrogation, the man explained: he drove into Kazarovo to relieve himself, and at the trial he began to deny this fact and say that he drove along this road to bypass the traffic jam. The investigation considered that in this way the accused was trying to build a line of defense.

— My life has become a never-ending effort to make us heard. You have to constantly contact the authorities, get answers to letters and somehow respond to them. Basically, it’s a witch hunt. These are light articles on which a person can be accused without much evidence. When it comes to children, they turn a blind eye to everything. A man has excellent characteristics, he has his own children, towards whom he never showed such inclinations. No one even put the car in that place to understand what you can see there at all. There was no follow-up experiment. In fact, for some, this is an opportunity to get stars, to advance in the service, says Tatyana Gubina.

The man’s friends even created a petition in which they collect signatures in support of Mikhail. In total, the document was signed by about a thousand people.
