Story No. 1

About fractures during a walk, which the teacher kept silent about

What happened. A woman from Surgut sent her daughter to a private kindergarten. On a daytime walk, the child rolled down the hill unsuccessfully and was injured – closed fractures of the ulna and radius bones of the forearm.

The teacher was nearby and saw the fall, but did not have time to help. When the child stopped crying, she decided that everything was fine and did not send the girl to the doctor for examination. She did not tell her parents about this case.

Some time later, the mother suspected that her daughter had injuries and examined her with a surgeon. It turned out that the bones had already grown together at an angle and it was impossible to correct this due to the young age.

The woman went to court and demanded compensation from the kindergarten for moral damage: 500,000 R for the child’s suffering and another 150,000 R for herself, as she was constantly sleep deprived and worried about her daughter. She also asked to recover a consumer fine for refusing to pay compensation before the court – 50% of the amount awarded for reimbursement – and to reimburse the costs of a lawyer – 50,000 R.

The kindergarten management did not deny the institution’s guilt and was ready to compensate for moral damage, but in a smaller amount. The teacher apologized to her parents, and then quit.

What the court decided. The court confirmed the teacher’s guilt: she did not follow the child and did not provide him with medical assistance. And then she hid it from her parents, because of which they could not show the girl to the doctor in time and the treatment was delayed.

However, the court reduced the amount of all compensations: moral damage in favor of the child to 100,000 R, in favor of the mother to 10,000 R, and expenses for a lawyer to 15,000 R.

Story No. 2

About a children’s game that ended in property damage

What happened. During a daytime walk in the courtyard of the kindergarten, three children from the older group threw stones and toys over the fence. The teacher made comments, but still could not pacify them. As a result, the children damaged the car that was parked nearby: they broke the hood and windshield.

The owner of the car turned to the police and demanded compensation from the head of the kindergarten. The police refused to initiate a case, and the manager said that the children could not throw a stone at a distance of 10-15 meters.

Then the man went to court and demanded compensation for all losses already there: 130,653 R for a car, 22,500 R for two expert examinations, and 31,600 R for legal services and drawing up a power of attorney.

What the court decided. The court appointed its own examination, which confirmed that the stones flew into the car from the garden.

Damage to a citizen’s property must be compensated by its inflictor. But, since we are talking about young children who were in kindergarten during dirty tricks, the educational institution should be responsible for them.

The court ordered the garden to pay damages to the plaintiff – 130,653 R, as well as cover all legal costs – 57,913 R. The management of the institution tried to appeal the decision to the court of appeal, but it remained the same.

Story No. 3

About the cruel teacher who beat the children

What happened. A grandmother from Astrakhan came to pick up her grandson from the state garden. She found him crying in the arms of the teacher’s assistant, with a fresh blow mark on his cheek.

At home, the child got worse — his head hurt and he began to vomit. He told his mother that the teacher hit him. The boy was shown to the surgeon, and he confirmed the version of the slap: the doctor diagnosed a concussion. I had to register the child with a neurologist and treat him.

The teacher denied everything, and then she quit of her own free will along with the assistant. Later it turned out that she worked in the garden for only 10 days.

Mom wrote a complaint to the head of the garden, but did not wait for any explanation. Then she went to court demanding compensation for non-pecuniary damage, medical expenses and a lawyer.

What the court decided. In court, they studied the testimony of other parents: their children also said that the teacher hits on the head. But the parents preferred not to complain, but simply transferred the children to other groups.

Considering this and the conclusions of the doctors, the court upheld the plaintiff and ordered the garden to compensate her for moral and material damage, including expenses for a representative. The compensation was reduced, but the specific amounts were not specified in the decision.

Story No. 4

About a pensioner not from a timid dozen

What happened. Mom came for her son and found him crying: the child complained that he gave a toy to another boy to play, but he did not return it. Coincidentally, that child was in the locker room with his grandmother.

A woman approached her and asked to see if there was someone else’s toy in their belongings. In response, the pensioner swore, dressed her grandson and hurried away. The woman tried to detain her in order to find out their last name, and the grandmother slapped her in response.

A woman recorded the fact of a bruise in the clinic, wrote a statement to the police and went to court demanding compensation for moral damage – 50,000 RUR.

What the court decided. The court found the grandmother guilty of a criminal offense – causing physical pain. And he ordered her to pay a fine in favor of the state – 5000 R – and the same amount to the plaintiff as compensation for non-pecuniary damage.

On the accusation of the head of bribery

What happened. In Magadan, a commission of officials and parents visited one of the state gardens. One of the mothers publicly accused the head of the garden of extorting money: she allegedly asked for a bribe in the amount of 5000 R. In the evening, the woman boasted of her act in the parental WhatsApp chat and once again criticized the leadership of the garden.

The manager could not stand the insult to her honor and went to court: she demanded to publicly refute what was said, apologize and compensate for moral damage.

What the court decided. The parent did not deny that she had slandered the woman: in fact, she did not demand any bribes. Mom simply did not like the equipment of the garden, and in this way she tried to draw the attention of officials to this.

The court partially satisfied the claim: the impulsive mother was ordered to pay compensation for non-pecuniary damage and speak at a general meeting in the garden with a refutation of her words, but without apologies – they are not provided for by law as a way of judicial protection of honor and dignity.

About scrupulous mother, grandmother and tired caregivers

What happened. A mother from Izhevsk carefully read the contract with the state garden and came to the conclusion that the educators do not develop her child, but, on the contrary, cause harm to health, insult and mock.

The woman remembered that she once refused to make additional donations to the garden, and felt that this was why the attitude towards her child had deteriorated.

For example, for three months a child was offered to drink from a glass, while all other children were given mugs with handles. The woman complained about this to the Commissioner for Children’s Rights, and then her child was given a signed set of dishes. Mom regarded this in her own way: the teachers marked the dishes in order to wash them less thoroughly, and the child was made an outcast.

The woman also rated the methods of raising children in the garden low: the educators take the children to harden on the veranda barefoot, they don’t go through new topics in the methodological manual, they don’t teach their native language, they don’t monitor the behavior of children, and they call each other names and adults. There were even complaints about the sandbox – only one child out of thirty in the group fits in it.

The woman also planned to include her mother: she wanted her grandmother to be allowed to be with her granddaughter in the garden during the day. So she would monitor the work of educators and identify even more violations. But the women were refused.

Then they went to court and demanded to compensate each of them for moral damage, to remove the head of the garden from her post, and to oblige the education department of Izhevsk to better monitor the working day of educators so that they do not overwork and better cope with their duties.

What the court decided. The court dismissed the claim. In the kindergarten, indeed, they signed the child’s dishes and collected charitable payments, but the court did not see in this signs of humiliation of the child.

Due to women’s complaints, the kindergarten was checked several times. Rospotrebnadzor, the education department of Izhevsk, the prosecutor’s office and the Commissioner for Children’s Rights visited there. Many employees of the educational institution were interviewed, and none of them testified about the discrimination of the child.

The girl goes to the garden, where any child can catch a cold, push or call another, and the teachers build a lesson program based on the approved norms. These are all life situations and it is impossible to judge for each leadership of the garden.

Mom and grandmother tried to change the decision in the court of appeal, but it remained in force.

Story No. 7

On the demand to expel children from the garden because of lice

What happened. A medical examination was carried out in one of the kindergartens in the Sverdlovsk Region. Two children from a large family were diagnosed with pediculosis – the defeat of the scalp by parasites. Children were suspended from visiting the kindergarten until their parents bring a certificate of full recovery.

The family cured the children and brought them to the garden. But the mother of another child from the same group began to demand that the “lousy” children be kicked out of the garden. The head of the garden explained to her that the children have a certificate and they have the right to visit the garden.

The dissenting woman went to the city district council, then to Rospotrebnadzor. And even initiated a meeting of the parent committee on this topic. The children were checked several times, but no more pediculosis was found. Sanitization was carried out in the kindergarten group, linen was changed and aired.

A mother of many children was upset that information discrediting her family became known to a large circle of people, and filed a lawsuit against the disgruntled woman for moral damages.

What the court decided. Citizens can seek refutation of information discrediting their honor and dignity, and receive compensation for this, but for this the court must establish that this information does not correspond to reality

Art. 152 of the Civil Code of the Russian Federation

In this situation, the court did not see that the information about “lice” was not true, because the children still had pediculosis. And the arguments that the defendant exposes the plaintiff to society as a bad mother were not confirmed by the witnesses. Therefore, the court dismissed the claim.

How to help a child with ADHD adapt to kindergarten and prepare him for school

Children with attention deficit hyperactivity disorder (ADHD) usually have a hard time learning at school: problems with concentration, difficult relationships with peers. Often problems begin already in kindergarten. Margarita Kravchenko, a child neuropsychologist, spoke about how to help a child with ADHD adapt to society and the family.

Question . My son is almost 8 years old, diagnosed with ADHD in remission. There is a little aggressor in the garden: he fights, bites (says that he is defending himself from the ridicule of other children). Educators regularly complain, but at home he is an ideal child: kind, caring, obedient. The psychologist says that the child draws attention to himself because he lacks attention at home. I can’t imagine how much this attention should be for him to get enough. I spend a lot of time with him, but it is impossible 24/7 to be only in his world. The son is well aware that he is doing bad things by getting into fights. He knows that I will be upset, he is upset himself, but nothing changes.

School ahead. They will definitely not tolerate such behavior there, there will quickly be a child who will beat my bully. Or teachers will immediately label him as a “fighting fool.” How can you help your son?

Reply . Parents of children with attention deficit hyperactivity disorder are always concerned about the child’s behavior both in the family and in society. It is important to understand that it is very difficult for such a child to cope with what is happening to him. Therefore, an integrated approach and work with a team of specialists is needed here.

Child care plan

  • The first level is metabolic. It involves medical assistance. The choice is made by a doctor, neurologist or psychiatrist based on the symptoms of behavior.
  • The second level is neuropsychological. Here we carry out diagnostics and complex psychomotor neurocorrection. The program includes special exercises that help the child control himself and improve his psychological state. A neuropsychologist draws up a plan of work with a child that promotes the development of mental abilities, based on individual characteristics identified after diagnosis.
  • The third level is a complex of educational games that allow you to train certain skills.
  • The fourth level is behavioral. Here we work with a psychologist and turn to cognitive behavioral therapy.
  • The fifth level is personal. Both individual and group therapy are possible here. Work is being done to resolve the child’s internal and external conflicts, he is taught how to interact with adults and peers, personal growth takes place.
What remission looks like

ADHD is considered to be a variant of impaired neurodevelopment. With age and with an integrated approach, manifestations may decrease. Parents and child adapt to the syndrome, and the symptoms do not cause severe overexertion. Then we understand that the child is compensated. But, as a rule, he still continues to experience certain difficulties. He may need more strength to solve certain tasks in everyday life: in school, self-organization at home or in communication in teams.

Dealing with behavior

Remember that children with ADHD may engage in socially unacceptable behavior, but this is not because they want to behave in such a way.

If a person is lame, we will not be angry with him and demand to walk normally, like everyone else. We understand that a person needs help. We send him to the doctor, give him a crutch, and so on. But when it comes to behavior, the opposite is true, unfortunately. We will not say to the lame: “Don’t lame!” – but for some reason we think that “Behave normal!” should help a child with ADHD.

Neuropsychological correction is indicated for such children. In classes with a specialist, the formation of the arbitrariness of mental processes is activated: voluntary attention and memory, self-control.

How to deal with aggression in ADHD

If a child has strong manifestations of aggression, it is necessary to teach him to express aggression in acceptable ways, without violating the rules of society and the personal boundaries of other people.

Play therapy and art therapy can be connected. This is one of the effective options for working with hyperactive children. In particular, art therapy improves adaptation in daily life at school and develops abilities. Working in this approach reduces fatigue, levels out negative emotional states and their manifestations.

Communicative groups are well suited for teaching communication and interaction skills in teams. These classes are aimed at correcting hyperactivity and social adaptation of the child, preventing and overcoming social exclusion.
