Is maternity leave included in seniority (nuances)?

Whether maternity leave is included in the length of service – this question often arises due to a misunderstanding of what type of leave is in question. Consider whether maternity leave is included in the length of service from the point of view of legislation.

Maternity leave – what is it?

The question of whether maternity leave is included in the length of service, as a rule, is due to the fact that they confuse two types of them: maternity leave and parental leave. Meanwhile, the Labor Code of the Russian Federation distinguishes them very clearly:

  • Art. 255;
  • to the second – art. 256.

The leave described in Art. 255 of the Labor Code of the Russian Federation, is directly related to the birth itself and covers the period, which is usually divided into two equal (with normal birth of one child) parts (70 calendar days before and after birth). For the entire period, a sick leave is issued. Payments for this sick leave are called maternity benefits.

The leave in question is called maternity leave according to the Decree “On the Benefit for Pregnancy and Childbirth”, adopted in Russia back in 1917, which for the first time in the world established payable leave for a woman related to the birth of a child, during which she retains her place of work .

At the end of the maternity leave, at the request of the mother or other person who will actually take care of the child, parental leave may be issued until the child is three years old (Article 256 of the Labor Code of the Russian Federation).

Does the decree count towards work experience?

The question of whether maternity leave is included in the length of service taken into account for pensions also arises because the last two federal laws on pensions (“On labor pensions in the Russian Federation” dated December 17, 2001 No. 173-FZ and “On insurance pensions” dated December 28, 2013 No. 400-FZ), this period is not directly indicated in the list of non-insurance intervals included in the insurance period.

The texts of both documents imply the inclusion of maternity leave during periods of temporary disability, accompanied by payments from the FSS, which is fully consistent with the procedure for its registration (sick leave) and payment (at the expense of the FSS).

Childcare and experience

Childcare leave is different in that it can be granted not only to the mother. Accordingly, the person for whom the vacation was actually issued receives the right to take it into account in his length of service. Moreover, leave to care for each of the children will be included in the seniority for a pension only until the child is one and a half years old (subparagraph 3, paragraph 1, article 12 of Law No. 400-FZ), and in total only six years can be taken into account.

Thus, maternity leave is included in the length of service of any woman who has a child, and leave to care for him can be added to the length of service of another person, if issued for him.

An employee can withdraw from parental leave at any time – for full or part-time work. To do this, she writes a corresponding application, and the employer issues an order. Not only the mother of the child, but also his father, grandmother, uncle or other relative, as well as guardians and adoptive parents can go on parental leave (part 2 of article 256 of the Labor Code of the Russian Federation).

An employee may withdraw from maternity leave at any time. To do this, he writes a free-form application, and the employer issues an appropriate order. This also applies to vacations up to 1.5 years, and vacations from 1.5 to 3 years.

The employer cannot recall an employee from maternity leave at will (Article 255 of the Labor Code of the Russian Federation).

The application form is free. It must contain the following data:

  • full name and position of the employee;
  • date of application;
  • request to interrupt parental leave;
  • desired date of entry to work.

The presence of the application confirms that the employee left the vacation voluntarily, and not you forced him. There is no statutory deadline for its submission – it can be submitted at any time. But it is better to set a certain period in the local act of the organization so that employees warn in advance and the employer has the opportunity to prepare a workplace and deal with a temporary worker who has been taken to the place of maternity leave.

Also issue an order in any form. It is important to reflect in it:

  • full name and position of the employee;
  • details of the application for early withdrawal;
  • date of entry to work;
  • of an order to terminate the vacation early, stop the payment of compensation for up to 3 years, if it was paid, and send a notification to the FSS about the termination of the employee’s right to a monthly allowance.

The employee and responsible persons to whom the instructions from the order are addressed should be familiarized with the order.

If you bring a T-2 personal card to an employee and indicate the planned end date of the vacation in it, you will need to make an adjustment with the new date. If you did not specify the date, it will be enough to enter the actual end date of the parental leave and indicate its duration.

The employer is obliged to inform the Social Insurance Fund that the employee has lost the right to childcare allowance for a child under 1.5 years old. This happens if he went to work full time, quit or lost a child. If the child is 1.5 years old, the notification is not given.

The notification form is approved by Appendix No. 6 to Order No. 119 of the FSS dated 08.04.2022. Specify in it:

  • the reason for termination of the right to benefits;
  • full name and SNILS employee;
  • full name, SNILS and date of birth of the child;
  • information about the end date of the vacation;
  • details of the order.

It is necessary to submit the form to the FSS within three working days after the employee leaves the decree (Article 13 of the Federal Law of 29.12.2006 No. 255-FZ). If the policyholder is late and because of this the fund overpays the allowance, it will recover money from the employer.

Parental leave can be used in full or in parts. Therefore, the employee has the right to resume the interrupted vacation at any time until the baby is three years old (parts 1, 2 of article 256 of the Labor Code of the Russian Federation). If the leave is resumed before the child reaches 1.5 years old, it will be necessary to re-submit documents and information to the FSS for the purpose of granting benefits.

You can submit a notification to the FSS through External. To do this, go to the FSS menu and select the menu “Create” → “Report” → “Notice on the termination of leave to care for a child under 1.5 years old”. The employer’s data will be pre-filled, and the employee can be selected from the directory. Before sending, the notification will be checked for errors and the service will tell you if something needs to be fixed.

If an employee on parental leave wants to work part-time, they have this right. And you can’t refuse him (part 2 of article 93 of the Labor Code of the Russian Federation, part 3 of article 256 of the Labor Code of the Russian Federation, parts 1, 2 of article 5.
