12 U.S. states have rejected Obama’s transgender policies

Despite “higher” authority and backing of billions of dollars in federal education funding, leaders in at least twelve states have said Barack Obama’s edict on transgender toilets, showers and locker rooms is unconstitutional, with many saying that they will not carry out this decree, no matter what happens.

Governors, attorneys general and school authorities, not to mention outraged parents, argue that the federal document released last week is a gross overreach of the president’s authority and puts children at risk. nine0003

Disobeying the president’s “social experiment”

After the publication of the long-discussed document, numerous governors declared that the document was defective.

The state of North Carolina, long stubborn in a long-running battle over its own law on transgender toilet use, simply shrugged off the order. As Deputy Governor of North Carolina, Dan Forest, said, Obama’s policies are “an invitation to invade privacy and security.” nine0003

“North Carolina will not stand idly by as school locker rooms and showers are used as a social experiment at the expense of privacy and the protection of our underage children of both sexes,” he continued. “I don’t think it’s right for teenagers to shower together. They shouldn’t bathe next to each other. .. I’m sure most parents in North Carolina agree with me.”

“After receiving a letter from the President, we reminded NC Public Schools that there is already a mandatory state law regarding personal care space policy, and a non-binding executive order is simply an attempt to push their version of social policy into our state without any constitutional authority. . This order should be rejected on principle and policy,” Lieutenant Governor Forest said. nine0003

“I don’t think it’s right for boys and girls to share the same shower. I don’t think it’s right when male coaches and teachers have unhindered access to women’s locker rooms and showers,” he continued.

Texas Gov. Dan Patrick said the state would rather withhold federal funding than change policy, though doing so would deprive students of approximately $10 billion, most of which goes to the free breakfast and lunch program. Their calls to ignore the President’s innovative interpretation of Civil Rights Act 1972 years, Volume IX, which does not mention gender identity, has swept across the country.

“Mississippi public schools should not be part of the president’s social experiment,” Gov. Phil Bryant said, because “these decisions should be left to the discretion of the states, not imposed by the federal government.”

Mississippi Lieutenant Gov. Tate Reeves agreed that “the state and local communities should not be forced to promote the liberal policies of a president who does not understand what the American people want.” nine0003

Gov. Bryant signed House Bill 1523, which explicitly allows people to set their own policies regarding “access to restrooms, spas, baths, showers, locker rooms, dressing rooms, or other private areas” without fear of government sanctions.

Kentucky Gov. Matt Bevin said that public schools in the “Wheatgrass State” “are not required to submit to such intimidation.”

Utah Governor Gary Herbert said, “Schools are the province of state and local government, not of the president. Unfortunately, this is exactly what I expected from the Obama administration. If we have to fight against this order, we will oppose it without hesitation.” Board of Education head David Crandall advised schools not to make any changes until there is a clearer court order or binding order. And Arkansas Gov. Asa Hutchinson tweeted, “We will fight this order.” nine0003

Republican Alabama Attorney General Luthor Strange vowed, “If the Obama administration tries to enforce this ridiculous executive order, we and the other attorney generals will do everything we can to challenge it.”

One such prosecutor, Scott Pruitt of Oklahoma, wrote a letter to the Presidential Administration shortly after the executive order was issued, stating that he “would vigorously defend” the state’s reasonable decision. In the state of Louisiana, 32 out of 105 representatives sent a letter to the attorney general asking for clarification on the issue of transgender people to administration officials. nine0003

Other states are battling administrative guidelines that require anyone who claims to be of the opposite sex to be treated accordingly. After the Obama administration released its letter, the states of Arizona, Kansas, Maine, Nebraska, Utah, and West Virginia signed a petition in defense of a Virginia village school that was being sued by the administration over the issue.

Less pronounced opposition

Several Republican governors have said that while transgender students should be treated with respect, they do not believe the federal government has the right to take on such a role. Mike Pence of Indiana, Scott Walker of Wisconsin and Terry Branstad of Iowa said the decision should be made by local leadership. Bill Haslam of Tennessee called the document “arbitrary.” However, sources say Pence appears ready to follow the president’s orders. nine0003

While many local officials said they found it unacceptable for members of the same biological sex to be left unsupervised in intimate spaces with members of the opposite sex, others raised concerns about the constitutionality and legality of the decree.

Obama Turned the Constitution Upside Down

Earlier this week US President Obama said he only issued the executive order because “schools asked” for proper legal guidance. However, transgender activists such as Mara Kiessling, spokesperson for the National Center for Transgender Equality (NCTE), have been asking the Obama administration for such rules for years, to no avail. nine0003

Texas Gov. Greg Abbott stated on Fox and Friends that “there is only one body of the three branches of government that can write legislation, and that is Congress. We have a president who has decided that if Congress is not going to pass this law, he will write it himself.”

“The President has turned the constitution upside down,” he said.

Pat McCrory, Governor of North Carolina, said the order was inconsistent with the president’s “constitutional authority” because “the executive branch of the federal government does not have the right to be the final arbiter” of the law. nine0003

Gov. Matt Bevin, a constitutionalist, said, “It is hard to imagine a more ridiculous excess of federal authority in a local matter. Under the Tenth Amendment to the United States Constitution, the federal government has no power to interfere with toilet policy in local schools.

“Our administration is exploring options to ensure that this local issue should be handled by the people of Kentucky, not Washington bureaucrats,” he said. nine0003

Youth Hoops has developed a skills development curriculum focused on the fundamentals of basketball.
