SAN ANTONIO – Advocates in Bexar County are calling on community volunteers to help foster families who need breaks and extra support.

“Fifty percent of foster families drop out in the first year because they can’t take a break,” said Sandi Jarzombek, a former foster mom and current certified babysitter.

Jarzombek and her husband fostered teen girls for years. Now without kids at home, they’re offering other families the support they know is necessary.

“Most of these children are being removed from hard places, which means they’re traumatized, and sometimes that means they have behavioral issues. So you need a break,” she said.

When most parents need a break, they call a family member or whatever babysitter is available.

However, foster children require certified caregivers that have gone through training acknowledged by the state.

“It’s a one-day training. People come in, they can become certified babysitters by the end of it, and they can serve local foster families,” said Jennifer Smith, the executive director of the South Texas Alliance for Orphans.

The STAO simplified these training sessions into a program that only takes several hours.

“You’ll get all your trauma training you need, you’ll get your CPR, and you’ll even get your TB tine test,” Jarzombek said. “The only thing you’ll have to do on your own time outside of this one Saturday is get your fingerprint.”

Smith says certified babysitters can give foster parents a chance to recharge.

“So these families can go out on a date with their spouse. They can go take care of the needs of other children. It just helps support that community so those foster families don’t burn out and quit. Because the last thing we need is foster families not being able to persevere,” Smith said.

Smith said almost 850 children currently need foster families in Bexar County.

“What that means is they’re either sleeping in offices, or they’re getting kicked out of Bexar County and going to Houston or Austin or El Paso or Dallas because we don’t have enough homes. That’s just not San Antonio. That’s not our community,” Smith said.

Jarzombek babysits for many foster families throughout San Antonio, ultimately helping keep foster kids sleeping in homes instead of offices or hotels.

“We desperately need more help. The only way foster families can get a break is if those of us that don’t have foster children at home step up and get certified,” she said.

Jarzombek said even if community members can’t become babysitters, there are so many ways they can help local foster families.

“Without proper support, my husband and I never would have made it as foster parents. When I was fostering, these women would help with my linens and towels. I’d leave a bin outside, and they would come pick it up, take it home and wash everything and bring it back,” Jarzombek said.

She said community members can volunteer to cook meals for families, pick up groceries, help with laundry, donate diapers, mow their lawns, or even become drivers to get the children to their many parental visits and doctors or counseling appointments.

The quest is to create a more extensive community web working together to give foster children the love and care they deserve.

Rosa Jimenez is free on bail after 16 years in state prison, released because a state district judge and the new Travis County district attorney believe she was wrongly convicted of killing a toddler in her care in 2003.

Jimenez’s case, bogged down in legal wrangling for years, roared to life this month as prosecutors, defense lawyers and state District Judge Karen Sage — acting with unusual speed — agreed that the Austin babysitter was unfairly blamed for killing the child who choked to death on a wad of paper towels.

“All of the medical evidence that is available to us at this time suggests that Miss Jimenez could not and did not commit this crime,” Sage said.

Jimenez was released from prison in Gatesville on Wednesday morning and taken into custody by agents with Immigration and Customs Enforcement because she was an undocumented immigrant when she was arrested.

ICE released her from custody in San Antonio hours later, and she made an emotional phone call to her mother in Mexico before she returned to Austin. ICE has the option of releasing individuals based on the circumstances of their cases; details on the conditions of her release weren’t immediately available.

For now, Jimenez is free on a no-money bond and will stay in Travis County while her appeal, and efforts to be declared innocent, continue.

It took only three weeks from the time Jimenez’s latest appeal was filed until Sage ordered her released from prison on bail this week.

Sage determined that Jimenez was convicted of choking the child because jurors were provided false and misleading testimony by prosecution experts who lacked proper expertise.

District Attorney Jose Garza, who worked in the prosecutor’s office for a month before taking over Jan. 1, and other top officials had already begun reviewing Jimenez’s case, and they were able to react quickly when defense lawyers filed a new appeal Jan. 4.

“We reviewed it thoroughly,” Garza said. “And after reviewing the evidence, we thought it was clear and that it needed to be in front of the court as soon as possible.”

The evidence included a new consensus report by four leading experts in pediatric airways and the mechanics of choking, including three who testified at a hearing Tuesday before Sage. The report rebutted trial prosecutors who argued that Jimenez forced paper towels down 21-month-old Bryan Gutierrez’s throat, leading to his death.

The experts concluded there was no evidence of a titanic struggle that would have ensued had Jimenez tried to forcefully choke the boy. They also said the child most likely filled his mouth with the paper towels and reflexively swallowed, with the throat muscles working to compact the wad.

At Jimenez’s 2005 trial, prosecution experts — none trained in pediatric airways medicine — testified that the towels could only have become compacted if forced by Jimenez, the only adult present, and that accidental swallowing was impossible in this case.

“This case is a tragedy,” Garza said. “It is a tragedy for Mrs. Gutierrez and her son, it is a tragedy for Miss Jimenez and her family, and my heart continues to break for Mrs. Gutierrez over the loss of her son and for the suffering she has had to endure through the entirety of this process.

“But our office has an obligation to seek out and pursue innocence, and we believe this is the right course of action in this case that is overwhelmingly supported by the evidence,” he said.

Sage said the new evidence, provided by the appropriate medical experts, led her to one important conclusion.

“There is clear and convincing evidence that Miss Jimenez did not intentionally attack and harm the child, and that Bryan Gutierrez’s death was almost certainly the result of a very, very tragic accident and not murder,” Sage said at the hearing.

“I cannot give Miss Jimenez justice today, but hopefully I can give her the inalienable right that she has been deprived of for far too long: her freedom,” the judge said to close the hearing.

Jimenez’s case is nowhere near over.

Sage’s findings will be sent to the Texas Court of Criminal Appeals, where its nine Republican judges can be difficult for inmates and defense lawyers to win over.

The state’s highest criminal court will decide whether to toss Jimenez’s conviction and order a new trial, as well as determine whether the evidence warrants a finding of actual innocence.

The court has no deadline for issuing its ruling.

Texas Attorney General Ken Paxton, whose office had opposed Jimenez’s release at an earlier stage of the case, didn’t respond to a request for comment.

Paxton is fighting a 2019 ruling by U.S. District Judge Lee Yeakel of Austin, who tossed Jimenez’s conviction and ordered a new trial, saying she was deprived of the right to hire effective medical experts during her trial in 2005. It’s pending at the 5th U.S. Circuit Court of Appeals.
