A Judicial Learning Center Can Engage and Educate Courthouse Visitors

“FOOD FIGHT!!” shouts Bluto Blutarsky, seconds before cafeteria mayhem ensues in the iconic 1970s comedy “Animal House.” More images of chaos from other corners of pop culture quickly follow on-screen, humorously illustrating what our lives might look like without the Rule of Law. For a moment, I forgot I was in a courthouse rather than a movie theater.

I recently had the opportunity to tour the Ralph L. Carr Judicial Center in Denver with a group of judges, court executives, and architects. Located within this large, multi-tenant judicial center is the Colorado Judicial Learning Center, which is not only a centerpiece of the building but a valuable educational resource for the community.

 The Learning Center includes a brilliant video that explores the stark differences between the Rule of Man and the Rule of Law from the perspective of an inquisitive teenager. This video was so impressive in the way it interspersed a wide range of movie clips, graphics, and animation to convey important Constitutional concepts in an understandable and engaging way. It is certainly one of the Center’s more prominent exhibits. I also wandered through other exhibits and was able to explore the many opportunities for visitors to learn about the judicial process, including:

  •  Our Constitution – a trivia game testing participants’ knowledge of the U.S. Constitution
  • Path of Resolution – an interactive display demonstrating how different types of cases travel through the various levels of the court system, and the specific function of each court along the way
  • Our Colorado Map – a touch-screen map showing visitors how the state is divided into counties, districts, water divisions, and tribal lands
  • You Be the Judge – an interactive exhibit in which the visitor assumes the role of an appellate judge, learning the intricacies of judicial responsibility and discretion, reviewing facts and details, and eventually weighing the information to reach a decision

After trying many of the exhibits (the trivia questions are not easy!), I could picture groups of schoolchildren visiting the Colorado Judicial Learning Center and walking away both entertained and educated. It reminded me of a similar space I toured a few years ago in the Thomas F. Eagleton U.S. Courthouse in St. Louis, MO, which is specifically designed to educate young students about the role of the judiciary . Similar learning centers can also be found in the Thurgood Marshall U.S. Courthouse in New York City, the Supreme Court of Virginia in Richmond, VA, and the Supreme Court of Wyoming in Cheyenne, WY. The Judicial Learning Center of Wyoming was directly inspired by the Colorado Judicial Learning Center after Wyoming’s Chief Justice attended the 2013 dedication of the Carr Judicial Center in Denver and “was struck by the number of children and adults of all ages fully engaged in the Rule of Law as it has developed in Colorado.”

 As a courthouse planner, I took away many concepts from the Colorado Judicial Learning Center that could be incorporated into our future planning efforts. Here are a few observations you and your planning teams might also find helpful:

  •  Judicial Learning Centers are best located in a Supreme or appellate courthouse – The Carr Judicial Center houses both the Colorado Supreme Court and the Court of Appeals. The courthouses mentioned above and others that feature learning centers also typically house Supreme or appellate courts. These types of courthouses do not normally host proceedings with in-custody criminal defendants and therefore do not have a cellblock, holding cells, or prisoner circulation. Although all courthouse visitors are carefully screened, the overall feel of the building once past security is one of civic importance and quiet solemnity. This pairs well with a space intended to emphasize the role of the judiciary and the importance of the Rule of Law. A learning center might not work as well in a high-volume court of general jurisdiction or a municipal court with busy traffic and misdemeanor dockets.
  •  A 1st floor location is ideal – The Colorado Judicial Center is located adjacent to the 1st floor lobby. The easier it is for visitors to access the space – especially in large groups – the better. Once visitors pass through security, they should be able to make their way directly to the learning center. Proper signage and wayfinding helps this process. In addition, the building lobby should be sized to allow groups to assemble after passing through security, to perhaps divide into smaller groups, complete head counts, use restrooms, etc. Some noise and disruptions are likely with school groups, so the location of the learning center in relation to courtrooms should be considered from that perspective.
  •  Exhibits should cover a range of age groups and learning styles – While all visitors might not be as amused as I was by Mr. Blutarsky, the Colorado Judicial Learning Center seems to have something for everyone. From interactive games geared towards elementary schoolers to more in-depth exhibits better suited for Constitutional law students, the variety of exhibits makes the center an inviting and informative experience for any visitor. Developing exhibits that cover a wide range of interests ensures that the learning center effectively serves the community.

With technology rapidly advancing, it’s exciting to imagine what judicial learning centers might have in store for future visitors. Maybe we’ll see a virtual reality courtroom where aspiring lawyers could argue in front of Supreme Court Justices. Or perhaps the timeless importance of the Rule of Law will be illustrated through an entirely new series of cultural memes. Just watch out for flying tomatoes!

SHORES, Justice.

Kinder-Care Learning Centers, Inc. (Kinder-Care) filed an action against the State and certain state and local officials, asking the court to declare that the assessments for ad valorem taxes on the property of Kinder-Care during the tax years 1977 and 1978 were illegal and void in that the property of Kinder-Care is exempt from ad valorem taxation as property devoted exclusively to educational purposes. After a trial, the trial court entered its order declaring the property of Kinder-Care exempt from ad valorem taxes, and the State appealed. We reverse and remand.

Section 91, Ala. Const. 1901, provides a limited exemption from taxation for certain property used exclusively for religious worship, for schools, or for purposes purely charitable. Section 40-9-1, Ala. Code 1975, extends this exemption to “all property, real and personal, used exclusively for religious worship, for schools or for purposes purely charitable.” Amendment 373 to the Constitution, which was ratified November 20, 1978, and which amends § 217 of the Constitution, provides an exemption from ad valorem taxation in Section (k) for “property devoted exclusively to religious, educational or charitable purposes.” Similarly, § 40-8-1(d) provides an exemption for “real and personal property devoted exclusively to religious, educational or charitable purposes.” Kinder-Care operates approximately 725 day care centers throughout the nation. Its home office is in Montgomery, and it is regulated in Alabama by the Department of Pensions and Security. It accepts children between the ages of six weeks and twelve years, and the centers are open from 7:00 a. m. to 6:00 p.m. The programs offered are standardized throughout the system. Each center has a director and staff members who receive some training from the educational department, which produces a weekly program for each age group. A pre-school child (i.e., one between the ages of two years and five and one-half years) becomes involved with programs within the pre-school level at the age of four. These four year olds are involved in a pre-reading readiness program called “Happily Ever After.” The five-year-old child is involved in a reading readiness program entitled “Beginning to Read, Write and Listen,” and also in a mathematics program. The five year olds are given a test entitled “The Metropolitan Readiness Test,” which is designed to determine whether the child is ready to proceed to the first grade. Kinder-Care keeps quarterly progress reports or developmental records which indicate each child’s progress. Most of the children at Kinder-Care are enrolled on a yearly basis; however, Kinder-Care does accept “drop-ins” (i. e., children who are there for only a short period of time). Kinder-Care is *861 required by the Department of Pensions and Security to have minimum items of equipment.

The children from six to twelve years of age who are at Kinder-Care only after school, on arriving at Kinder-Care after school, participate in the afternoon snack, after which they go outside for thirty to forty-five minutes. After coming back inside, the children play board games such as jigsaw puzzles and Monopoly.

Kinder-Care is not licensed by the Board of Education and is not accredited by the Department of Education. The majority of children at Kinder-Care are between the ages of two and five. It is the business of Kinder-Care to earn a profit.

The trial court correctly noted that it is the use to which the property is put which determines whether it is exempt from ad valorem taxes. It also correctly observed that the term “education” is a general term and is not a limited one, as we recently held in Clark v. Jefferson County Board of Education, (Ala. 1982).

The issue, however, is one of constitutional and statutory construction. Did the legislature intend to grant an exemption from the payment of ad valorem taxes for the use made by Kinder-Care of its property? Or, stated differently, is Kinder-Care using its property exclusively for “educational purposes” as that term is used in the statutes creating the exemption, or are Kinder-Care day care centers “schools” within the meaning of those statutes? Those are the criteria established by this Court to entitle one to the exemption. Anniston City Land Company v. State, 160 Ala. 253, 48 So. 659 (1909). That case held that it was the use to which the property was put and not its ownership which determined the exemption issue. There the Court held that property used exclusively for a school was exempt. It also observed:

“The `universal rule of construction is that exemptions from taxation, whether statutory or constitutional, are to be strictly construed, against the exemption and in favor of the right to tax, and that no person or property is to be exempted unless the intention to exempt such person or property clearly appears in some statute or constitutional provision. The relinquishment or curtailment of the power of taxation is never presumed.’ Gray, Lim. of Taxing Power, p. 655, § 1321, and cases cited in note 53 to the text, among them being that of Stein v. Mobile, 17 Ala. 234, 239.”

Kinder-Care aptly points out that a subsequent appeal by the same taxpayer disallowed the exemption only because a part of the building was used as a boarding house and, thus, the property was not used exclusively for a school or for educational purposes. Anniston City Land Company v. State, 185 Ala. 482, 64 So. 110 (1913). It argues that all of Kinder-Care’s property is used for educational purposes and, thus, it is entitled to the exemption.

We agree that the term “education” is a broad one and that much of what Kinder-Care provides is educational. We cannot agree, however, that the term was used in that broad sense in the statutes and constitutional provisions extending the exemptions from ad valorem taxes. The teachers in the Kinder-Care Learning Centers are not certified teachers as defined by Alabama law. The centers are not subject to regulation or certification by the Department of Education. They are not “private schools” as defined in § 16-28-1, Ala. Code 1975, and attendance at such centers would not satisfy the compulsory school attendance laws. Section 16-28-2, Ala. Code 1975.

Because we must strictly construe tax exemption statutes, we conclude that, although much of what Kinder-Care offers is unquestionably educational, neither is its property used exclusively for “educational purposes,” nor are its centers “schools,” within the meaning of the pertinent statutes. Therefore, the decision of the trial court to the contrary must be reversed.

We acknowledge that in Clark v. Jefferson County Board of Education, supra, we held that the county board was authorized *862 to operate day care centers under a broad grant of authority from the legislature to develop “community education.” There, as here, we were called upon to construe a statute consistent with the legislative policy in enacting it. There, as contrasted with this case, we were compelled to liberally construe the language of the legislation. Here, we are bound to narrowly construe the terms “educational purposes” and “schools.”

The judgment of the trial court is reversed and the case remanded.

REVERSED AND REMANDED.

Judicial forum for disputes. You and CountingWorks agree that any judicial proceeding to resolve claims relating to these Terms or the Services will be brought in the federal or state courts of Orange County, California, subject to the mandatory arbitration provisions below. Both you and CountingWorks consent to venue and personal jurisdiction in such courts. If you reside in a country (for example, European Union member states) with laws that give consumers the right to bring disputes in their local courts, this paragraph doesn’t affect those requirements.

IF YOU’RE A U.S. RESIDENT, YOU ALSO AGREE TO THE FOLLOWING MANDATORY ARBITRATION PROVISIONS:

We Both Agree To Arbitrate. You and CountingWorks agree to resolve any claims relating to these Terms or the Services through final and binding arbitration by a single arbitrator. This includes disputes arising out of or relating to interpretation or application of this “Mandatory Arbitration Provisions” section, including its enforceability, revocability, or validity.

Arbitration Procedures. The American Arbitration Association (AAA) will administer the arbitration under its Commercial Arbitration Rules and the Supplementary Procedures for Consumer Related Disputes. The arbitration will be held in the United States county where you live or work, Orange County (CA), or any other location we agree to.

NO CLASS ACTIONS. You may only resolve disputes with us on an individual basis, and may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action. Class arbitrations, class actions, private attorney general actions, and consolidation with other arbitrations aren’t allowed. If this specific paragraph is held unenforceable, then the entirety of this “Mandatory Arbitration Provisions” section will be deemed void.

Controlling Law

These Terms will be governed by California law except for its conflicts of laws principles. However, some countries (including those in the European Union) have laws that require agreements to be governed by the local laws of the consumer’s country. This paragraph doesn’t override those laws.

Entire Agreement

These Terms constitute the entire agreement between you and CountingWorks with respect to the subject matter of these Terms, and supersede and replace any other prior or contemporaneous agreements, or terms and conditions applicable to the subject matter of these Terms. These Terms create no third party beneficiary rights.

Waiver, Severability & Assignment

CountingWorks failure to enforce a provision is not a waiver of its right to do so later. If a provision is found unenforceable, the remaining provisions of the Terms will remain in full effect and an enforceable term will be substituted reflecting our intent as closely as possible. You may not assign any of your rights under these Terms, and any such attempt will be void. CountingWorks may assign its rights to any of its affiliates or subsidiaries, or to any successor in interest of any business associated with the Services.

Modifications

We may revise these Terms from time to time to better reflect:

(a) changes to the law,

(b) new regulatory requirements, or

(c) improvements or enhancements made to our Services.


If an update affects your use of the Services or your legal rights as a user of our Services, we’ll notify you prior to the update’s effective date by sending an email to the email address associated with your account or via an in-product notification. These updated terms will be effective no less than 30 days from when we notify you.

If you don’t agree to the updates we make, please cancel your account before they become effective. By continuing to use or access the Services after the updates come into effect, you agree to be bound by the revised Terms.

Who we are

WE TEACH STUDENTS — NOT SUBJECTS

Focus on Learning offers students a nurturing educational environment for”new beginnings. ” For 37 years we have worked with students to bring out their best to become confident and successful learners.

We are currently focusing instruction on high school students  Our goal is to offer these young men and women the individual subject tutoring and test prep for ACT, PSAT, SAT they need to succeed in college and in life.

At no time has education been more important.  Students will need the education to participate in a society that is. becoming increasingly technical and science-driven.  Good jobs will be available for those who are educated to fill them. 

Our goal is for every student to be college or vocationally ready — to have the reading, writing, math, and science skills that will lead to success in college and other post-secondary classes.

We are committed to working with Columbia Public Schools both as professionals and as a Partner in Education. We sponsor the MAC Scholar high school program, which works with historically under-represented students in Columbia Public Schools, offering ACT courses at no cost. Focus on Learning is proud to be a part of the rich learning community in Columbia.

Learning Styles Matter

Left Brain learners rule the classroom. School schedules pose no problems because they are very time conscious. Assignments and test dates are remembered and even neatly entered into assignments books. Verbal and analytical, left brainers readily learn sequential skills : phonics, grammar rules, multiplication tables make total sense. Left brainers are verbal and enjoy reading and writing, building strong vocabularies in the process. Test questions make sense to them. They like to talk, debate, and argue. They follow multiple directions well and take good notes. The classroom environment is their natural home. Left brainers become our lawyers, neurologists, accountants, journalists , teachers, politicians, bookkeepers and bankers.

Right Brain learners view the traditional classroom as a foreign land. Visual and spontaneous, they have little sense of time. Assignments are forgotten and test dates not remembered. Nonverbal learners, right brainers struggle mightily with routine classroom tasks: phonics and grammar make no sense, memorization of rote facts is difficult, spelling is hopeless, punctuation is ignored, and the meaning of questions remains an ongoing puzzle. Note taking is problematic. Right brainers only learn what they understand. Out-of-the box thinkers, they are not verbal but creative and intuitive, often giving the right answer without being able to explain how they got it. Education

In accordance with the License to carry out educational activities, the Training Center implements professional retraining programs with a development period of 250 hours and advanced training programs with a development period of 16 hours. Training is conducted in Russian, in full-time or remote form.

Full-time classes are held in classrooms, the duration of an academic hour is 45 minutes. Classes in absentia are conducted using OLIMP-OKS, Mirapolis systems. The student is identified by an individual login and password. If necessary, consultations are held with teachers through telecommunication channels.

For some professional retraining programs, an internship with the involvement of a master of industrial training is provided. Based on the results of the internship, a diary of production practice is compiled.

Training ends with a final assessment in oral form or in the form of a test exam. For distance learning students, the exam is conducted in the distance learning system.

Persons who have successfully mastered the additional professional program and passed the final certification are issued documents: a certificate of advanced training and (or) a diploma of professional retraining. Qualification documents are issued on standard forms.

The following persons are allowed to master additional professional programs: persons with secondary vocational and (or) higher education; persons receiving secondary vocational and (or) higher education.

The training center provides training on a paid basis, on the basis of an agreement concluded with the student or with an individual or legal entity that undertakes to pay for the training of the person enrolled in the training.

Programs for professional retraining and advanced training are drawn up taking into account the requirements of the Professional Standards, CEN (Unified Qualification Directory for the Positions of Managers, Specialists and Other Employees, approved by the Decree of the Ministry of Labor of Russia dated August 21, 1998, No. 37), Federal laws, Decrees of the Government of the Russian Federation, other by-laws and industry regulatory documents.

Access to information systems and information and telecommunications networks, including those adapted for use by the disabled and persons with disabilities, is organized during the entire study time in the computer classes of the training center. For students with the use of special features of the Windows operating system is available, as well as special technical means are provided: projectors and loudspeakers. In computer classes, stationary user workstations are equipped with personal computers with a large monitor (19– 24″), a speech synthesizer and an NVIDIA screen reader for the visually impaired are installed. There is a mobile kit for equipping a workplace for a blind or visually impaired user: a laptop with headphones, on which a speech synthesizer and an NVIDIA screen reader are installed. Classrooms are equipped with sound amplification kits and multimedia projectors. Students can use their own technical means of access to information systems and information and telecommunication networks through free Wi-Fi points. The site of the training center has the ability to scale text for the visually impaired.

Logistics and equipment of the educational process

Information about teaching materials:

Educational and methodological support of the educational process includes the legal documents of the Russian Federation, teaching aids and other educational materials, as well as those developed by the teaching staff: educational and methodological materials for practical classes, methodological developments for business games, multimedia presentations, complex use which provides a high level of training of students.

Logistics of the educational process
:

The process of implementing educational programs at the Training Center is provided with the necessary material and technical base for conducting all types of training sessions. The training center has a classroom equipped with modern technical means that meets the current sanitary and technical standards and rules.
Laptops connected to the Internet are used for conducting classes. A marker board is used for visual demonstration of materials, a projector and an acoustic system are provided for multimedia presentation of information. Practical classes are held with the use of visual aids, posters, a demonstration of first aid techniques is carried out using the “Maxim” simulator. At the disposal of the teacher and students there are always several sets of personal protective equipment: gas masks, masks, protective leggings, boots, helmets, etc.
Education in distance form and e-learning is carried out using licensed systems “OLIMP-OKS” and Mirapolis. For consultations with teachers and acceptance of the certification exam, modern communication channels are used: Skype, Viber, Whatsapp, Telegramm.
Students are provided with cold and hot drinking water, if necessary, hot meals can be organized on the basis of an agreement with a public catering plant. On the territory of the Training Center there is a vending machine offering hot coffee and other drinks.

How to choose a training center and avoid scammers?

New orders of the Ministry of Health, periodic accreditation and the system of continuing medical education establish requirements for regular training of doctors, nurses and pharmacists. The need to take courses has led to many offers of specialist training services.

However, not all educational organizations conscientiously fulfill their obligations to clients. Therefore, it is important to choose the right educational institution in order to avoid losing money and problems with accreditation.

What documents should a CPE center have?

The key rule when choosing an educational institution is to check whether the organization has licenses and other permits that allow training specialists. In the absence of licenses, the CPE center does not have the right to conduct courses and issue educational documents.

You can check the availability of a license on the official website of Rosobrnadzor . When choosing an educational institution, be sure to request information on the license and check the information on the Rosobrnadzor website.

The following information must be provided in the licenses:

  1. Basic information – the date and number of registration of the document, the name of the organization, PSRN, TIN, the actual address of the institution and the validity period of the license.
  2. Appendix – includes the series and number of the document, as well as information about the educational institution and the type of permission for educational activities. In the appendices, the type of activity of the centers of further vocational education is registered as “Additional professional education”.
  3. Stamp and signature. All sheets of the license are stamped by the Department of Education and the person who approved the issuance of the document.

Additional professional education centers issue documents of the established form:

Educational documents are printed on special forms signed by the rector and stamped by the center of further education.

Each educational institution is required to enter information about issued educational documents into the FIS FRDO (Federal Register of Documents on Education) – based on Government Decree No. 825. The registry is open, so everyone can check the information about the document – it is enough to know the details of the diploma or certificate.

Important! Entering information into FIS FRDO affects admission to accreditation. The FAC necessarily checks the information on issued certificates. If there is no information in the register, the application for accreditation will be rejected.

The law obliges educational organizations to register issued documents in the register within 60 days from the date of their issuance to specialists. Only licensed educational institutions can enter information into FIS FRDO.

If the representatives of the CPE center state that the entry of information into the register is not significant, or they do not comply with the deadlines for registering information, this is a reason to doubt the competence of the organization. No document can be issued retroactively – this is illegal.

Important! Responsibility for the use of fake documents lies not only with the educational organization, but also with the specialist to whom they were issued – according to article 327 of the Criminal Code of the Russian Federation .

Curricula

The educational institution is required to provide information about the program in which the client plans to receive training. Important conditions are:

  1. Compliance with the terms of training. The requirements for the duration of the programs are specified in the 273-FZ and the order of the Ministry of Education and Science No. 499. Professional retraining should last at least 250 hours, advanced training courses – from 16 to 249 hours.
  2. Availability of compulsory and profile disciplines in the curriculum. Arbitrary topics cannot be added to the program or materials required to be studied according to the Federal State Educational Standard cannot be excluded.

Important! If a specialist wants to undergo training with ZET accrual, the program must be accredited on the NMO portal. If this requirement is not met, points for completing the course will not be credited to the specialist.

In order to complete a 5-year cycle of study in the CME system, we recommend that you create an educational plan strictly in your personal account on the official portal of continuing education. This is necessary even if you have already chosen a training center – checking the programs will avoid wasting money and time.

To take courses in specific areas of activity, specialists must have the appropriate qualifications. Requirements for the education and work experience of specialists are prescribed in the orders of the Ministry of Health No. 707n (VMP) and No. 83n (SMP). The educational organization must take into account the qualification requirements when providing educational services.

In simple words, all educational materials of the CVE centers should be placed on the educational portal, where the learning process is organized and the knowledge of students is monitored.

If during the inspection it turns out that the educational institution does not actually conduct educational activities, its license will be revoked, and all issued documents on education will be invalidated.

Starting from 06/02/2021, training sessions and intermediate certification (IA) events are held exclusively using e-learning and distance learning technologies ( in distance format ) for students:

  • 2 and 3 full-time bachelor’s courses;
  • 2-5 full-time specialist courses;
  • 1 year full-time master’s degree;
  • 1-4 undergraduate courses of part-time education.

From 06/21/2021 for 1st year undergraduate students, PA training sessions and events are also held remotely.

PA training sessions and events continue, mainly full-time for students:

  • 2 full-time master’s courses;
  • 5th year bachelor’s degree of extramural education;

    Non-resident and foreign students who arrived in St. Petersburg from another region of Russia or from a foreign state, in order to check into the hostel of the university or its partners, they need to have test results for coronavirus (PCR analysis – a swab from the nose and oropharynx, the test result is negative , for a period of not more than 3 days (for citizens of the Russian Federation 3-5 days) from the moment of passing the analysis).
