In matters of wages, the employer must strictly follow the norms of the Labor Code. If an organization does not comply with the requirements of the law, it will have to pay a large fine and compensation to affected employees. The procedure for paying wages

The procedure, place and terms for receiving wages are contained in the employment or collective agreement, internal regulations, regulations on wages. If the organization has all these documents, then the conditions for the payment of salaries are prescribed in each of them – Letter of Rostrud dated 03/06/2012 No. PG / 1004-6-1. These rules cannot contradict the norms of the Labor Code of the Russian Federation.

Form of payment

Salary can be paid in cash or transferred to the employee’s current account. It is allowed to combine these methods – for example, transfer an advance to a bank card, and issue the rest at the checkout. What form of payment is convenient for the employer and employee is decided upon hiring and prescribed in the employment contract.

Then the employee can change the method of payment, but only with the consent of the employer – for example, switch from cash to cashless payments. The employee writes a statement, and if the employer does not mind, they conclude an additional agreement to the employment contract.

Terms of payment of wages

The specific terms of payment are set by the organization, but no later than 15 days after the period for which it was accrued. The Labor Code does not prohibit paying wages more than twice a month. If an employer pays employees every week or once every 10 days, he is not breaking the law. But he needs to officially approve the dates of payments – in the labor, collective agreement, regulation on wages, internal regulations.

If an organization pays wages before the dates specified in the documents, it may be fined for violating labor laws. For the first time, the employer is threatened with:

  • an official – a warning or a fine from 1000 ₽ to 5000 ₽;
  • IP – a fine from 1000 ₽ to 5000 ₽;
  • to a legal entity – a fine from 30,000 ₽ to 50,000 ₽.

For repeated violation:

  • to an official – a fine from 10,000 ₽ to 20,000 ₽ or disqualification for a period of one to three years;
  • IP – a fine from 10,000 rubles to 20,000 rubles;
  • to a legal entity – a fine from 50,000 ₽ to 70,000 ₽.

If an employee urgently needs money, you can pay the salary earlier – this will not be a violation. He writes a statement addressed to the head, in which he substantiates his request. The employer has the right to refuse or agree. If the organization is ready to pay, you need to make sure that the interval between payments does not exceed 15 days. For example, part of the advance payment should be paid earlier, and the rest – on the due date.

Responsibility for delayed wages

If an employer violates the deadlines for issuing wages, he must pay compensation to the employee in the amount of 1/150 of the key rate of the Central Bank of the Russian Federation for each day of delay – art. 236 of the Labor Code of the Russian Federation. The amount of compensation can be increased by a collective or labor agreement. Compensation is paid simultaneously with wages.

  • IP – a fine from 10,000 rubles to 30,000 rubles;
  • for legal entities – a fine from 50,000 rubles to 100,000 rubles.

If the employer delays wages for more than 15 days, the employee has the right to suspend work – Art. 142 of the Labor Code of the Russian Federation.

But there are also unforeseen situations. For example, an employee receives a salary at the cash desk, but this month he fell ill and could not come for the money on time. If you simply put the amount in the cashier or safe, it will be a violation. Such wages must be deposited – reflected in the accounting entries as not received, and given out at the first opportunity. In the payroll, opposite the names of employees who did not receive money, the entry “Deposited” is made. If an individual entrepreneur does not keep accounting, he does everything the same, except for accounting entries.
