I can’t login to my account.

USING THE APP

How do I get the app on my mobile device?
How can I send my center a message?

Open the KinderCare App, and look for the mail icon

Can I add to my child’s journal without sharing with my center?

Yes! When in the app, simply tap the plus icon . Choose if you’d like to share with your Crew (more on the
“Crew”
below) by unchecking “Private.”

Why can’t I see nap or meal information throughout the day?

We provide our centers with the option to hide sleep and food information until the report is finalized at the
end
of the day. These updates can contain sensitive information, and this provides an opportunity for the teachers
to
confirm they haven’t entered any inaccurate information to parents.

How do I download my child’s photos from the KinderCare App?

The Crew

What’s the “Crew”?

The Crew is a close group of friends and family that you want to share updates with. This can include
grandparents,
aunts and uncles, close friends, separated families, or anyone that doesn’t live close enough to see your child
as
much as they’d like.
Note that the Crew can also share activities of your child by posting to their KinderCare App account, but only
if
you approve what they’ve shared with you or given them auto-post privileges.

How do I add and remove people from the Crew?

Open the app and head to the Crew page. Start adding! Each person you add will automatically receive an email
from
us inviting them to join the KinderCare App and participate in activity-sharing for your child.
To remove a Crew member, navigate to the Crew page, and click Edit next to the person’s name. Check the
Remove User
box at the bottom of the page. Click Submit.

Do I have to share everything with the Crew?

Nope. Some moments just aren’t meant to be shared with everyone. Maybe you want to keep a very special moment
just
between you and your spouse, or maybe you want to keep a log of your child’s medical-related activities. Mark
these
as “Private,” and only Crew members with special privileges that you set will be allowed to see these.

Who can add and remove people from the Crew?

Only Administrators can add family and friends to a child’s Crew. If you want to know who’s an Administrator of
your
child’s account, visit their Crew page.

What does it mean when I mark an activity as “Private”?

When an activity is marked as “Private,” the only Crew members that will be able to see those activities by
default
are those members who you have designated “Access Level: All photos. ” They will be identified on your child’s
Journal with a lock icon.

identified
on the Journal with a lock icon.
We take privacy seriously and will never share any photos or make them public without your explicit consent.

Is it legal to restrict parents’ access to the building of an educational institution (school/kindergarten)?

How does this fit in with a parent’s legal right to represent and defend their child’s interests?

In accordance with Part 1 of Art. 64 of the RF IC, the protection of the rights and interests of children rests with their parents. Parents are the legal representatives of their children and act in defense of their rights and interests in relations with any individuals and legal entities, including in courts, without special powers.

According to Part 1 of Art. 63 of the Family Code of the Russian Federation, parents have the right and obligation to raise their children and are responsible for their upbringing and development. Parents are obliged to take care of the health, physical, mental, spiritual and moral development of their children. In addition, on the basis of Part 2 of Art. 63 of the RF IC, parents are obliged to ensure that their children receive a general education.

The provisions of paragraph 31 of Art. 2 of the Federal Law of December 29, 2012 N 273-FZ “On Education in the Russian Federation” (hereinafter – Law N 273-FZ) defines the circle of persons recognized as participants in educational relations, which include: students, parents (legal representatives) underage students, teachers and their representatives, organizations engaged in educational activities.

The list of rights and obligations of parents, legal representatives of minors in the field of education is established by the provisions of Art. 44 of Law N 273-FZ. So, by virtue of the direct indication of paragraph 2 of part 4 of Art. 44 of Law N 273-FZ, parents are required to comply with the internal regulations of the organization carrying out educational activities, the rules for the residence of students in boarding schools, the requirements of local regulations that establish the mode of study of students, the procedure for regulating educational relations between the educational organization and students and (or) their parents (legal representatives) and registration of the emergence, suspension and termination of these relations.

Note that according to Part 1 of Art. 28 of Law N 273-FZ, an educational organization has autonomy, which means independence in the implementation of educational, scientific, administrative, financial and economic activities, the development and adoption of local regulations in accordance with Law N 273-FZ, other regulatory legal acts of the Russian Federation and charter of the educational organization. Thus, the development and adoption of internal regulations for students, internal labor regulations, other local regulations fall within the competence of an educational organization in the established field of activity (clause 1, part 3, article 28 of Law N 273-FZ).

At the same time, by virtue of paragraph 2 of part 6 of Art. 28 of Law N 273-FZ, an educational organization is obliged to create safe conditions for learning, educating students, supervising and caring for students, their maintenance in accordance with established standards that ensure the life and health of students, employees of an educational organization. So, for example, according to paragraph 1 of part 13 of Art. 30 of the Federal Law of December 30, 2009 N 384-FZ “Technical Regulations on the Safety of Buildings and Structures” to ensure protection against unauthorized intrusion into buildings and structures in the buildings of educational organizations, measures should be provided aimed at reducing the possibility of criminal manifestations and their consequences .

Note that neither Law N 273-FZ, nor other regulatory legal acts contain a direct rule granting the right of unhindered passage of parents to the building of an educational organization (kindergarten, school, boarding school, etc.). It does not follow from the provisions of Art. 64 of the RF IC on the legal representation of parents and other norms of the Family Code of the Russian Federation. In this regard, we recommend paying attention to judicial practice, for example, the appeal ruling of the Investigative Committee in civil cases of the Astrakhan Regional Court dated August 12, 2015 in case N 33-2400/2015.

At the same time, parents are not deprived of the opportunity to visit an educational institution, provided that they comply with the internal regulations approved by the educational institution itself, including taking into account the access control and the established time for communication with teachers and the management of the educational institution.

At the same time, in accordance with clauses 2, 7, 8, part 3 of Art. 44 of Law N 273-FZ, parents (legal representatives) of underage students have the right to get acquainted with the charter of an organization engaged in educational activities, a license to carry out educational activities, a certificate of state accreditation, educational and program documentation and other documents regulating the organization and implementation of educational activities, take part in the management of an organization engaged in educational activities, in the form determined by the charter of this organization, and also be present at the examination of children by the psychological, medical and pedagogical commission, discussing the results of the examination and recommendations received from the results of the examination, express their opinion on the proposed conditions to organize the education and upbringing of children.

Based on Part 1 of Art. 45 of Law N 273-FZ, parents (legal representatives) of students also have the right to:

) underage students, disciplinary sanctions. Such appeals are subject to mandatory consideration by the indicated bodies with the involvement of students, parents (legal representatives) of underage students;

2) apply to the commission for the settlement of disputes between participants in educational relations, including questions about the presence or absence of a conflict of interest of a teacher;

3) use other methods of protection of rights and legitimate interests not prohibited by the legislation of the Russian Federation.

It should also be noted that in accordance with Part 2 of Art. 63 RF IC, paragraph 1, part 3, art. 44 of Law N 273-FZ, parents have the right to choose an educational organization, the form of education for children and the form of their education, taking into account the opinions of children before they receive basic general education. Therefore, if parents (legal representatives) disagree with the conditions of education, including the internal regulations in a particular educational organization, they have the right to choose another educational institution. In addition, in the event of disputes between the educational organization and parents (legal representatives), the latter, by virtue of Part 1 of Art. 64 of the RF IC, paragraph 5, part 3, art. 44 of Law N 273-FZ has the right to protect the rights and legitimate interests of students, including in court.
