Learning Is meant to be a natural, Joyful experience. Our goal is to help your child develop socially, emotionally, physically, and intellectually. Children thrive when the process of discovery Is lovingly encouraged and gently reinforced. This is the philosophy behind our research-based curriculum that fosters Individual growth by providing plenty of opportunities for exploration and child-Initiated choice. All children need opportunities to be responsible, to make choices, and to be treated with respect. Our programs encourage your child’s growth and development with early learning experiences that build a strong foundation for his or her social, emotional, physical and intellectual skills. We believe each child has unique talents and Interests. Our teachers honor these differences by providing your child with customized attention and activities that enable your son or daughter to learn and grow at his or her own pace and in your child’s own way. Norm of hours of teaching staff
Question
Norm of hours of teaching staff
Answer
Question
Hello. I work as a kindergarten teacher. We have a 12 hour kindergarten. Previously, we worked: 1st shift from 6-30 to 13-40, and
2nd shift from 11-20 to 18-30. Now we work from 6:30 am to 12:30 pm and from 12:30 pm to 6:30 pm, as we should not have overlapping hours. But
now we have to work 12 hours once a week so that we have worked out all the hours. Bottom line – we were all confused, we are sure
that it is illegal. Help, please understand.
Answer
In accordance with the Order of the Ministry of Education and Science of the Russian Federation of December 22, 2014 No. 1601 “On the duration of working hours
(norms of hours of pedagogical work for the wage rate) of pedagogical workers and on the procedure for determining the teaching load
pedagogical workers, stipulated in the employment contract, the norm of hours of pedagogical work is set for educators 36
hours per week for the wage rate.
In accordance with clause 8. 2. Order of the Ministry of Education and Science of the Russian Federation of March 27, 2006 N 69 “On the peculiarities of the regime of working hours and rest time
pedagogical and other employees of educational institutions” in preschool educational institutions (groups) with a 12-hour
stay of pupils with a 5-day working week (60 hours of work per week), in which two positions of educator (72 hours of work) are provided for each group of pupils
, the mode of their working time is determined taking into account the implementation of
each educator teaching work for 36 hours a week.
A 36-hour working week by each educator can be ensured by the simultaneous daily work of two
educators for 6 hours a week for each educator or by each educator replacing during this time
absent educators due to illness and other reasons, performing work production of educational and visual aids,
methodological and other work regulated by the internal labor regulations of an educational institution and others
local acts.
Working hours and rest are regulated by the internal labor regulations. If for a particular employee the regime
of working time and rest is different, the condition for this is mandatory for inclusion in the employment contract. If the establishment of a new
kindergarten operation regime affects the working hours established for a particular employee, while maintaining his
labor function, it is necessary to amend the terms of the employment contract in accordance with Article 74 of the Labor Code of the Russian Federation.
From the wording of the question, it is not possible to determine whether there are grounds for establishing a new work schedule
without amending the internal labor regulations and employment contracts.
At the same time, it should be noted that the establishment of a work schedule in which on one of the days the duration of working time
exceeds the duration of working hours on other days does not contradict labor legislation, provided
Compliance with a total working time of 36 hours per week.
Places of educational activities, including those not specified in the application of the license (register of licenses) for the implementation of educational activities in accordance with part 4 of Art. 91 of the Federal Law of December 29, 2012 No. 273-FZ “On the formation of the Russian Federation) |
