The demographics of San José’s workforce have shifted considerably in recent years, and this trend is projected to continue. Dual-working parents with small children are the fastest-growing component of the labor force. If parents could obtain affordable, high-quality daycare, more parents would return to work.
The City of San José has long promoted the creation of additional daycare facilities, and it has continued to do so by deregulating and streamlining the process and regulations under which the city controls them. As a result of 1987 suggestions from the City’s Child Care Task Force Report, several of these standards were reduced in 1988. In order to gain the full benefits of the City’s streamlining efforts, child care providers must cooperate.
The child care provider should familiarise themselves with the City’s regulations, development process, and the Daycare Fee Policy and its recommendations as one of the best ways to ensure proposal success. Early communication with the City of San José and the State of California Department of Social Services Community Care and Licensing Division is critical to the creation and management of effective child care facilities in the city.
This Policy Update continues the legacy of continual development of the child care facility review process, and it reflects the need for responsible design review guidelines to promote child safety and community integrity.
The purpose of this Policy is to:
- Create safe environments for all children in childcare facilities throughout the City;
- Ensure that child care facilities are good neighbors and compatible with their surroundings.
- Provide guidance to child care providers on how to successfully design and operate facilities with greater certainty; and
- Consolidate the guidelines for use by childcare providers, decision-makers, and City staff on the location, design, and operation of childcare facilities.
The City issues Conditional Use Permits to Child Care Centers to ensure that they meet City criteria and are consistent with the neighboring areas.
Staff will assess proposals for compatibility with this Policy and the parameters stated in it, as well as the Zoning Ordinance, when making recommendations to the Planning Commission. Proposals are considered on a case-by-case basis, taking into account the particular circumstances of each property and project.
The standards outline the project qualities required for approval to make the examination process for individual permit applications easier.
The City allows Child Care Centers through the Conditional Use Permit process to ensure that they fulfill City requirements and are consistent with surrounding neighborhoods. In making recommendations to the Planning Commission, staff will review recommendations for consistency with this Policy and the guidelines included in it as well as the Zoning Ordinance. Proposals are examined on a case-by-case basis to account for the unique conditions of each property and proposal. To facilitate the childcare evaluation process for particular permit applications, the guidelines recognize the project characteristics necessary for approval.
In general, the guidelines have been formulated in the hope that they will be beneficial to those people engaged in the design, review, approval, and provision of child care.
They are planned as a reference point so that there can be a common understanding of the minimum design and operational probabilities of Child Care Centers in San José.
Child care providers and their design consultants should become aware of these guidelines and apply them appropriately to their programs so that they can be reviewed and authorized by the City as efficiently as possible. These guidelines, however, do not try to include every technique for achieving the best standards in the design and operation of Child Care Centers. Care providers are motivated to use their creativity and work with the City staff to accomplish individual excellence.
A successful Center normally begins with early meetings with the Department of Planning, Building, and Code Enforcement (PBCE) and the City’s Office of Early Care and Education Service. In some cases care providers may choose to manipulate the Preliminary Review process with PBCE before applying for a Conditional Use Permit to enhance the certainty, predictability, efficiency, and potential cost savings of the review process. Early contact by child care providers also avails PBCE an opportunity to harmonize the request within the City and other stakeholders such as the State of California Department of Social Services Community Care and Licensing Division, if mandatory.
It also allows PBCE to advise the care provider on potential community interests and involvement and the necessity to conduct early, proactive community outreach probably before the Conditional Use Permit process.

Op-ed: Young moms have a solution to the child care crisis in Santa Clara County
In Santa Clara County and throughout California, young mothers do not have equitable access to child care or economic opportunities.
In a study conducted by the Young Women’s Freedom Center and Alliance for Girls, young mothers in Santa Clara County said their main barriers to child care were high costs, service ineligibility for parents under 18, lack of accommodations for unconventional work schedules and transportation issues.
The findings echo data from a 2022 report by Children Now showing child care costs are the highest household expense in nearly every California county, surpassing housing. Meanwhile, the Public Policy Institute of California says the state’s underinvestment in child care undercuts families’ economic stability and the state’s economic growth, with lack of early childhood care costing California an estimated $6.8 billion annually.
While there are programs for subsidized child care and housing to alleviate financial burdens, eligibility often requires parents to forfeit other opportunities for financial stability. This resonated with many community experts—research participants—in our study who said that even after getting off a waitlist or using a combined income, they were still ineligible for subsidized support.
“My husband and I wouldn’t qualify for any programs based on being married, but yet our combined income was not enough to survive or pay for housing for ourselves, let alone the day care and everything else,” one participant said. “And so that’s always been a struggle because it’s ‘I don’t make enough, yet you make too much.’”
In addition to high costs, negative stereotypes about young parenthood and the disregard of our voices and self-determined needs erode trust and contribute to the child care crisis. Throughout our research study, young mothers said clinicians, nurses and case workers frequently interacted with them by undermining their authority and expertise as the main providers for their families.
“They just put us in a box,” another participant said. “When they see a young mom, they assume everything about our lives when it’s inaccurate. And that’s why it’s hard for certain people to look for resources because they don’t feel comfortable going and speaking with people that are judging them.
”
Ultimately, these factors impact young mothers’ mental health, education and our ability to find and retain work.
This issue is much larger than just California. According to Bureau of Labor Statistics data, in October roughly 104,000 Americans missed work because of problems finding care for their children. They also reported 100,000 fewer child care workers since the COVID-19 pandemic, exacerbating the issue. As we move into a post-pandemic world, one thing is clear: Child care accessibility impacts the American workforce of today and the future.
Our yearlong youth participatory research study was conducted as part of the When Young Moms Thrive, We All Do Santa Clara County sponsored program at the Young Women’s Freedom Center and Alliance for Girls, where we worked as fellows and interviewed over 100 young parents on their experiences and needs. In addition to providing a picture of the child care failures in the county, our report also sets out five recommendations for policymakers and local government departments to implement in order to solve the child care crisis and support young parents.
We need an increase in federal funding for subsidized programs; an expansion of services for parents under the age of 18; a standardized and transparent selection process to ensure equitable access to child care services across county agencies; a universal basic income pilot program to provide monthly payments for at least 100 young moms; and mandated stigma-free training for child care providers led by young parents.
As young moms, especially those who are also impacted by involvement in systems like foster care and the juvenile legal system, we experience many barriers that are unique to young parenthood. We know firsthand the effects of policies and programs that are not equitable and need to be on the forefront of decision-making when it comes to solving this crisis and developing programs to better serve young families.
We also know this crisis cannot be solved by Santa Clara County alone. We need a nationwide push to overhaul restrictive guidelines that leave young families stuck in crisis and cycles of poverty and system involvement, unable to access critical resources.
Santa Clara County policymakers can take the first step to change the experiences of young moms and lead the nation toward a system that works for all parents and providers.

We offer a full, varied and tasty breakfast in our garden patio when possible, under a huge umbrella, looking out to a great variety of fruit trees (mango, avocado, soursop, banana, orange, lemon, nispero), flowers and birds ( clay-colored robins, mot-mots, blue-gray tanagers, rufus-tailed hummingbirds) and millions of butterflies…At 1000m (3,280 ft) above sea level, Escazú is warm during the day and pleasantly cool in the evening, making it easy to enjoy a restful sleep.
Xavier used to work in housing and international development, loves to walk everywhere, swims every other day, was a former runner, loves to read — mysteries, politics, poetry — and listen to music. Pilar is a translator and former speechwriter, loves to act in community theatre, writes poetry, loves dance and singing, was a literature student and her favorite meal is breakfast! We both enjoy bird watching and belong to the Costa Rican Birding Club.
Whenever possible, we entertain friends and enjoy telling our guests about the many possibilities of travel in Costa Rica. One of the greatest joys of having Casa de las Tias is meeting such wonderful and interesting guests, many of whom have become our friends. Our breakfast conversations have ranged from genetic research in Costa Rica to the best way to cook beans. We really like people, especially those who share our curiosity about this and other countries and cultures.
We are in the foothills of Escazú, a little town once known for its witches and ghostly legends, nestled in the southern mountains that surround the Central Valley and San José. Our neighborhood, San Rafael de Escazú, is a walkable residential and shopping area with a bustling commercial street replete with clothing, furniture and souvenir shops as well as restaurants offering foods from Costa Rica to India, Italy, Greece or Argentina. The area is a curious combination of sophisticated art and architecture and traditional rural life.
Nearby and in the town of Escazú are well-preserved adobe houses that date back a few hundred years (Escazú was first settled in the 1600´s). Some are now restaurants, coffee houses and artful design stores, while others are still family homes. Once a year, on the Day of the Boyero, ox-drawn carts come from San Antonio de Escazú, the mostly agricultural area of the canton, to San Rafael for the traditional blessing of the animals, a March feast that has been declared Heritage of Humanity by the UN. We love to walk these colorful streets with impressive mountain views to go enjoy a ceviche at Madfish or rice and beans at la Casona de Laly.
