At its last meeting before the holidays, the Duma decided to put an end to all these contradictions and adopted in the first reading the draft law “On a moratorium on changing the profile of activities of social organizations” prepared back in July.

Perhaps this question in itself would not be so interesting if it did not become a very curious illustration of how the current regulatory framework allows conflicting interpretations of the same issue. This allows regulations to be simply ignored. Recall that until 1992, the so-called health, education, culture and sports facilities (in simple terms – clinics, schools, kindergartens, sanatoriums, cultural centers and stadiums) could be on the balance sheet of enterprises. From 19For 92 years, all these institutions began to be privatized either together with the enterprise or separately. However, the incompleteness inherent in all Russian privatization has led to the fact that the current regulatory framework in the form of presidential decrees and government decrees, designed to regulate the procedure for the privatization of these objects, has turned out to be confusing.
As Pavel Bunich, chairman of the Duma Committee on Property, draws attention, the presidential decree of January 10, 1993 “On the use of social, cultural and communal facilities of privatized enterprises”, for example, states that, by decision of the labor collectives of privatized enterprises, privatized enterprises may include objects of social and cultural purpose that are on the balance sheet, but “with the obligatory preservation of their profile” may be included. At the same time, the procedure for the privatization of objects that enterprises decided not to burden themselves with was established by the approved presidential decree of July 22, 1994 “Basic Provisions of the State Program for the Privatization of State and Municipal Enterprises in the Russian Federation after July 1, 1994”. It says that such objects retain their purpose “during the period established by the contract of sale.”
The procedure for actions in case the enterprise did not have enough money to maintain its social facilities is described in another document – the order of the State Property Committee of January 27, 1993 “On streamlining the process of delimiting property rights to objects of socio-cultural and communal purposes of privatized enterprises “. It says on this occasion that they are subject to transfer to municipal ownership or to “joint use” of privatized enterprises and municipalities. Finally, the procedure for financing these facilities, regardless of their post-privatization status, is regulated by the relevant government decree of December 23, 1993 years old
Despite the numerous normative acts, all of them cannot be implemented for one simple reason – neither enterprises nor local budgets are able to finance these objects. As a result, their profile began to change, transforming into everything that could be commercially profitable. The most remarkable thing is that the owners of these objects began to refer in their actions not to all these regulations, but to the Civil Code and the law “On the General Principles of Organizing Local Self-Government in the Russian Federation”, which take precedence over them, which states that the owners have the right to freely manage their property.
From a legal point of view, the situation could only be corrected by law. Therefore, the Duma Committee on Property has developed a very simple bill, which contains only five articles. The very first article says that “in order to protect the health, rights and legitimate interests of citizens of the Russian Federation, preserve the social structure and ensure state guarantees for the provision of social services …” a moratorium is established on changing the profile, as well as the termination of the activities of a number of organizations in the social sphere. These include, among other things, nurseries, kindergartens, all children’s summer cottages, kindergartens and camps, dispensaries, hospitals and sanatoriums for the disabled, children and the elderly, children’s and teen clubs, centers for creativity and leisure, as well as sports and fitness centers.
Art. 2 regulates the conditions on the basis of which the profile of the organization can still be changed. For example, if the services of such an organization are not used in full. True, in this case only reorganization is possible. It is possible to completely stop the activities of the organization or change its profile only if the services of the organization are not used, if the owner has created another organization of the same profile, or if major repairs are being carried out in the buildings and structures of the organization. In the latter case, you can suspend the activities of the organization for a period not exceeding 3 months. However, it is not clear what to do if the repair lasts longer.
In Art. 3 says that the owners are obliged to provide priority funding for these organizations, and the government and executive authorities at all levels – to ensure the procedure for financing local authorities for these purposes. Responsibility for violation of the law is set out in Art.
