How to check the queue for a kindergarten in the Moscow region

What to do?

Anonymous

asked in the Community T—F

My son will be two years old in a few days. My wife and I are preparing to send him to kindergarten.

In January, I found out where we were in the queue for kindergarten – they said that we were on the 15th. And already in April, the son was in 40th place. They argued that privileged families always go out of turn.

We live in the Moscow region, in the city of Mytishchi. Registered right there. We look at children and their parents – no one even smells like beneficiaries! How to check if our queue for kindergarten is legally moving away, and is it possible to complain somewhere?

Arman Zhumanov

lawyer in the field of educational law

Most likely, your queue is moving legally. Higher in the queue could be children whose parents changed their place of residence and applied earlier. In addition, the queue could really shift because of the benefited children.

You can check all this if you file a complaint with the education department of the Mytishchi administration or the prosecutor’s office.

How the queue for kindergarten is generally formed

T—J, there was already a detailed article on how to queue for kindergarten, so I will briefly remind you of the main points.

The queue for kindergarten is formed on the basis of applications submitted by parents. Children who have the right to receive a general education are taken into account by local governments of municipal districts and urban districts.

paragraph 6, part 1, art. 9 of the Law “On Education in the Russian Federation”

Local governments keep records in electronic form and fix the procedure for maintaining a queue in a municipal regulatory legal act.

Clause 1 of Appendix 1 to the letter of the Ministry of Education and Science of Russia No. 08-1908

The movement of the queue primarily depends on free places in kindergartens. Children are usually enrolled until June-July of the current year. During the school year, groups can be staffed, but already for single places, which are vacated if the parents have taken the child from the kindergarten.

Sometimes the queue can move back. This happens if:

  1. there is a child with a benefit for enrollment: for example, children of judges and prosecutors are taken to kindergarten without a queue at all, and children from large families – in the first place;
  2. the family moved and, accordingly, the child changed kindergarten, and his parents initially applied before you. When moving within the same municipality, the date of application does not change;
  3. there is a child who moved from one age group to another, and his place in the electronic queue was determined by the original date of application, which turned out to be earlier than yours.

There is one more point: first of all, places in kindergartens are provided to those who are registered at the place of residence on the territory of the municipality. And then they consider the applications of those who have temporary registration – at the place of stay. So the fact that your child’s turn to kindergarten has shifted may not depend on the number of beneficiaries who want to go to the same kindergarten as you.

The amazing story 08/08/19

What if the child has not given a place in kindergarten

How children are enlisted in kindergartens of the Moscow Region

in the Moscow Region is formed in a unified information system for managing preschool educational organizations of the Moscow Region. The procedure for registering children in the queue in Mytishchi is regulated by the regulation on the staffing of kindergartens.

Regulations on the staffing of kindergartens in the Mytishchi Municipal DistrictPDF, 42. 8 KB

According to this document, all children within their age category are counted by the date they were placed in the queue, that is, by the date of application, but taking into account benefits. The list of children who need kindergarten from September 1 of the current year is formed as of April 1. After April 1, the list of children may include those who have the right of priority and extraordinary admission to kindergarten.

The list of categories of beneficiaries is quite long. For example, the following can go to kindergartens in Mytishchi out of turn:

  1. Children of citizens who were exposed to radiation as a result of the Chernobyl disaster and the accident in 1957 at the Mayak production association and the discharge of radioactive waste into the Techa River.
  2. Children of citizens from special risk units, as well as families who have lost a breadwinner from among these citizens.
  3. Children of prosecutors.
  4. Children of judges.
  5. Children of employees of the Investigative Committee of the Russian Federation.

And the following have the right to priority enrollment:

  1. Children from large families.
  2. Children with disabilities and children with a parent who has a disability.
  3. Children of contract servicemen.
  4. Children of police officers.
  5. Children of employees of the penitentiary system, such as the Federal Penitentiary Service, the state fire service and customs authorities.

Benefits for admission to a kindergarten

In addition, the administration of the kindergarten can receive, on a priority basis, adopted children and children of kindergarten employees and teachers from Mytishchi schools.

Thus, the line for beneficiaries and ordinary children in your city is the same, and given the number of beneficiary categories, it could easily move back. But from January, when you called for the first time, until April 1, your queue could have shifted not only because of beneficiaries. For example, there could be children who moved and changed kindergarten, and their parents applied before you did.

How to check the legality of shifting the queue

You can independently check the status of the application and the position of the child in the queue on the website of public services or on the portal of state and municipal services of the Moscow Region by the series and number of the birth certificate.

The formation of the queue is automated, so cases of illegal provision of a place in a kindergarten are easy to establish. To do this, you have the right to file a complaint with the Department of Education of the Administration of the city of Mytishchi or with the local prosecutor’s office. In both cases, they will check and provide an answer.

How to place a child in a kindergarten without a residence permit

A complaint can be filed in person, by mail or, more conveniently, electronically:

  1. through the electronic reception of the education department of the Mytishchi administration;
  2. through the Internet reception of the Moscow Region Prosecutor’s Office.

In a complaint, it is enough to indicate your contact details and ask to check the legality of the actions of the education department to form a queue for kindergarten. References to legislation are optional.

You also have the right to apply to the Mytishchi City Court of the Moscow Region with an administrative claim against the Department of Education – to demand the elimination of violations of the provision of your son’s place in kindergarten. It is not necessary to write a claim in advance. State duty – 300 R.

art. 125, 220 CAS RF

sign. 7 p. 1 art. 333.19 of the Tax Code of the Russian Federation

An administrative case, as a rule, must be considered within two months from the date of filing a claim. The court will schedule meetings at which you and a representative of the Department of Education are entitled to attend. You can protect your interests in person or use the help of a representative.

The request will be satisfied if it can be proved that the order of formation and movement of the queue was violated – someone took the queue above you illegally. The court decision will be the basis for your child’s place in the queue to be reviewed.

What to do if there are no vacancies

If it turns out that everything is in order with the queue, and your child still does not go to kindergarten in the desired year, the Department of Education will offer vacancies in other kindergartens. The list of municipal kindergartens in Mytishchi is available on the website of the city’s education department.

If you are offered a kindergarten located in another microdistrict, you can apply to the Department of Education with an application for a transfer. At the same time, the previous date of registration is retained in the application. The date of the desired enrollment is indicated on the 1st day of the month following the date of the transfer application.

What to do? 10/08/18

How to get a place in a free kindergarten

If the proposed kindergarten is located in the same microdistrict, you can also apply for a transfer to the desired kindergarten.
