Family sponsorship | Immigration to Canada

Family sponsorship: immigration to Canada of relatives.

Immigrant family category. Family class (family sponsorship)
Under Canadian law, any Canadian resident, citizen or permanent resident who is 18 years of age or older is eligible to sponsor a close family member to obtain an immigrant visa to Canada. Mandatory requirement – the sponsor must reside in Canada. As an exception, a Canadian citizen (citizen only, not permanent resident) residing outside of Canada may sponsor a spouse/marriage partner or dependent child, provided that after the sponsored relative obtains an immigrant visa, the sponsor and family return to Canada for permanent residence. nine0008

Changes being made to Canada’s immigration system since 2012 have affected the terms of family sponsorship. The latest changes in June 2015 affected the recognition of marriages that were entered into without the presence of both or one of the parties, meaning – by proxy, telephone or Internet. In a marriage that was concluded in this way, sponsorship is canceled. The only exception is members of the Canadian Forces.

Immigration to Canada through marriage

An important condition in determining the likelihood of family sponsorship by the Canadian side is not so much the legality of the marriage in the country of its registration, but the recognition of the union in Canada. For example, consanguineous marriages or polygamy do not fall under the definition of family sponsorship. nine0008

Sponsorship of a spouse is only possible if both the husband and wife are 18 years of age and older at the time of the sponsorship application. Exactly the same conditions apply to partners who are in extramarital relationships.

These requirements are for maximum protection against forced marriages and against the introduction into Canada from outside of uncivilized customs that infringe primarily on the rights and freedoms of women.

Considerations for family sponsorship in Canada

Another significant amendment has been made to the immigration law since October 2012 regarding conditional permanent residence status for the sponsored spouse. It was adopted both to strengthen the protection of Canadian citizens themselves, whose sincere feelings are often used for personal gain in obtaining permanent residence in Canada, and to prevent the use of family sponsorship in Canada when concluding fictitious marriages.

The essence of the amendment is that if the spouses have been married for less than 2 years and there are no children at the same time, the sponsored spouse acquires a permit for permanent residence in Canada for only a period of 2 years, during which people who are married must live together. nine0008

If the spouses separate even for some temporary period (with the exception of short business trips), then the status of permanent residence received by the sponsored spouse will be immediately canceled, and the person himself will be required to leave the country. But there may be exceptions in case of confirmation of the facts of neglect, physical, psychological, material violence and bullying.

In addition, according to the same June 2015 amendment, if there is a further divorce after 2 years, the sponsored spouse loses the right to sponsor their other half upon remarriage for the next 5 years. nine0008

Family Sponsorship Restrictions in Canada

Non-Canadian permanent residents of Canada who currently reside outside of Canada cannot sponsor their spouses. Therefore, they can only start applying for family sponsorship for immigration through marriage while they themselves are within Canada.

Restrictions on who cannot sponsor their foreign partner:

  • Imprisonment of sponsor
  • Declaration of bankruptcy
  • Receiving financial support from the state (welfare)
  • Past attempted offense
  • Failure to pay child support obligations from his previous marriage
  • Non-payment of subsidies received from the state
