Non-compliance with the requirements of the Family Code of the Russian Federation on the placement of a child in a family of citizens of the Russian Federation resulted in the refusal of international adoption
Citizens of Spain K. and L. applied to the court for the adoption of a citizen of the Russian Federation I.K., born on December 24, 2008, located in the Regional Specialized Orphanage No. expand the family through international adoption.
By the decision of the regional court dated April 13, 2012, the application was denied.
Leaving the court decision unchanged, the Judicial Collegium for Civil Cases of the Supreme Court of the Russian Federation indicated the following.
Art. 165 of the Family Code of the Russian Federation, adoption (adoption) on the territory of the Russian Federation by foreign citizens of a child who is a citizen of the Russian Federation is carried out in accordance with the legislation of the state of which the adoptive parent is a citizen. In this case, the requirements of Art. 124-126, Art. 127 (with the exception of az.8 p.1), art. 128 and 129, Art. 130 (with the exception of paragraph 5), art. 131-133 of the Family Code of the Russian Federation, taking into account the provisions of the international treaty of the Russian Federation on interstate cooperation in the field of adoption of children.
Art. 21 of the Convention on the Rights of the Child, it is recognized that adoption in another country can be considered as an alternative way of caring for a child only when the child cannot be placed in foster care or placed in a family that would be able to provide for his upbringing or adoption, and if it is not possible to provide any suitable care in the child’s country of origin.
Art. 124 of the Family Code of the Russian Federation allows the adoption of children by foreign citizens or stateless persons only in cases where it is not possible to transfer these children for upbringing to families of citizens of the Russian Federation permanently residing on the territory of the Russian Federation, or for adoption by relatives of children, regardless of the citizenship and place of residence of these relatives. In addition, the adoption of brothers and sisters by different persons may be allowed only when it is in the interests of the children.
As can be seen from the case file, the child’s mother, I.A.V. by decision of the district court of 09/30/2010, she was deprived of parental rights in relation to him. There is no information about the father in the child’s birth certificate.
In addition, the child has a sister, Alexandra, born on March 6, 2007, who was adopted in December 2011 by spouses B. The children lived in the same family, were removed from it together, in July 2010 were placed in different organizations for orphans and children left without parental care.
In refusing to satisfy the claims, the court proceeded from the fact that the guardianship and guardianship authorities and the regional operator of the state data bank on children left without parental care had not taken all the necessary and possible measures to place the child in a family of citizens of the Russian Federation.
The information submitted to the court that the information about the boy was published in the regional newspaper Komsomolskaya Pravda in Ch. in the heading “Looking for a mother”, and also submitted for publication to the editorial office of the regional newspaper “Earth”, is not confirmed by any evidence, as well as explanations in court by representatives of guardianship and guardianship authorities about placing information about the boy on the appropriate stand of the Education Committee of the administration of the city district .
Provided for by Article 11 of Federal Law No. 44-FZ of April 16, 2001 “On the State Data Bank on Children Left Without Parental Care” questionnaire on I. with information on measures taken by guardianship and guardianship authorities, regional and federal operators for the device (assistance in the placement) of a child left without parental care, for raising in a family of citizens of the Russian Federation permanently residing in the territory of the Russian Federation, is also not presented to the court.
In accordance with the legal position set out in the Resolution of the Plenum of the Supreme Court of the Russian Federation dated April 20, 2006 No. 8 “On the application of legislation when considering cases of adoption (adoption) of children” on the need to verify by the court information about the refusal of citizens of the Russian Federation to accept a child for upbringing to the family, spouses B., who adopted the boy’s own sister and submitted refusals to accept him for upbringing in the family, were interrogated. However, at the court session, spouses B. explained that they wanted to adopt K., while the court did not establish that they could not act as such.
According to Articles 124, 165 of the Family Code of the Russian Federation, Art. 21 of the Convention on the Rights of the Child, spouses B., who are citizens of the Russian Federation, by virtue of the law have a priority right over foreign citizens to adopt a child, including because of the adoption of his sister by them.
The court also correctly took into account that, by virtue of clause 3 of article 124 of the RF IC, the adoption of brothers and sisters by different persons is not allowed, except in cases where the adoption is in the interests of the children.
Under such circumstances, the court correctly concluded that there were no grounds provided for by law for establishing the adoption of I. by foreign citizens.
At the same time, the court of appeal noted that when exhaustive measures are taken to place the child in a family of citizens of the Russian Federation and there are no other grounds preventing adoption, citizens of Spain K. and L. have the right to reapply with a corresponding application for adoption (determination of the Supreme Court RF No. 72-APG12-4 dated 17.07.2012).

A picture of a girl standing next to her mother sweeping the streets of Baku at dawn blew up Azerbaijani social networks. After that, people united and tried to help the family. Now the fate of Ayan and her mother is being dealt with by the chairman of the Union of Children of Azerbaijan, children’s human rights activist Kamala Agazade, who promises to do everything in her power for the girl.
Today, June 24, little Ayan celebrates her sixth birthday. Thanks to the support of Agazade and the “Gunesh” charity club, a holiday was organized for the birthday girl on the seashore in the city of Sumgayit. Sputnik Azerbaijan went to the name day and, on behalf of the news agency, presented Ayan with a gift – a plush bunny and a drawing set. The girl took up drawing immediately at the celebration. In a warm and cozy atmosphere, children from the Reintegration Center at the Union of Children of Azerbaijan NGO sang songs for Ayan, danced with her and gave her gifts. Of course, the birthday girl was presented with a cake with her portrait.
The girl’s mother, Shovket Kelbiyeva, who worked as a cleaner in the Sabail district of Baku, told Sputnik Azerbaijan in an interview that she is currently not working anywhere.
“At the moment when they began to help us financially, and the chairman of the Union of Children of Azerbaijan – to provide support in the treatment of my daughter, I had to leave work in order to deal exclusively with the child. The savings accumulated during this period also went to repair the house, which I I did it myself. I don’t have extra money for masters. I didn’t have time to complete all the work, I don’t have money anymore, so I need a job,” says Ayan’s mother.
According to Shovket, now she dreams of saving money so that in September she can send Ayan to first grade.
“I really want my daughter to get an education and be able to achieve much more in life than I do. Thanks to everyone who has extended a helping hand to us during this time.
