Supporting the initiative, experts point out that it is limited to a particular case. They note that the observance of the rights of fathers with many children, like any other workers, will largely depend on the conscientiousness of employers.

The Ministry of Health and Social Development has prepared amendments to the Labor Code, according to which employers will be prohibited from firing fathers with many children if they are the only breadwinner in the family. As explained in the press service of the department, the draft Federal Law “On Amendments to Article 261 of the Labor Code” refers to the impossibility of terminating an employment contract with the fathers of large families in which children under 14 are raised, while at least one child has not reached three years of age and the children’s mother does not work. nine0003

According to the current version of the Labor Code (part 4 of article 261), at the initiative of the employer, it is impossible to dismiss women whose children are under three years old, single mothers raising a child who is under 14 years old, or a disabled child (under 18 years old). The changes proposed now are not only a measure of social protection for the family, but also “eliminate inequality in the provision of guarantees upon termination of an employment contract for female workers and male workers,” the Ministry of Health and Social Development specifies. On March 15, the bill was “basically” approved by the Russian tripartite commission for the regulation of social and labor relations, the press service said. But while the document has not been submitted to the State Duma, therefore, the parties (the government, the RSPP and trade unions) have time to send their proposals and comments. Article 261 of the Labor Code, which implicitly allowed such dismissal, was found to be partially contrary to the Constitution. The precedent was created by the father of many children, Muscovite Alexei Ostaev, who won the case in the Constitutional Court, who worked as the chief artist at the Logos-Media publishing company. After the crisis of 2008, the company’s management began to optimize the business, which resulted in a massive reduction in staff. In the summer of 2010, Ostaev also got laid off.
