We just ended nearly three wonderful years with Happy Hearts. Our daughter started there at 3 months old and we only left because she aged out and was ready for full time preschool. We could not have asked for a better or more caring environment for our daughter and would have kept her there untilkindergarten if I was able to. She was excited to go every day and learned more by the age of three than my other two learned with all their years of preschool.     Instructions on the actions of state authorities when unaccompanied children from Ukraine are detected at the border or on the territory of the Republic of Bulgaria

    Unaccompanied children Bulgaria and is not accompanied by his parent or other adult who is responsible for him in accordance with Bulgarian law.

  • Persons legally responsible for an unaccompanied minor or alien minor other than parents are guardians or trustees appointed by the competent authorities in accordance with the legislation of the respective state.
  • Persons legally responsible for an unaccompanied minor or minor foreigner are adult relatives in the ascending line without limitation in degree (grandfathers, great-grandparents, great-grandfathers), as well as adult relatives in the collateral line up to the third degree inclusive: brother, sister, uncle, uncle.

Minor citizens of Ukraine entering the territory of the Republic of Bulgaria, who are not accompanied by a parent or guardian, but are entrusted and accompanied by another relative or close friend, are subject to the following measures:

Entry into the country

minors arriving from Ukraine, in the presence of an identity document – a passport, internal passport, identity card or birth certificate and any other available document proving the identity of the child, regardless of whether the child is accompanied by a parent, guardian or guardian within the meaning of Bulgarian law (unaccompanied child).

The access of unaccompanied children to the territory of the Republic of Bulgaria is ensured taking into account their interests and their right to request and receive temporary protection on the territory of the state.

Accompanying persons

  • power of attorney – by filling out and submitting by the accompanying person a sample declaration to the border guards / policemen to take responsibility and care for the child.
  • Border guards/police officers must make sure that the child is truly trusted by the accompanying persons and that they are acting in his or her best interests.
  • Border guards/police officers must indicate to the accompanying adult that he/she must submit a declaration of departure immediately upon arrival at the destination address in the Republic of Bulgaria to the Child Protection Department of the relevant Social Assistance Administration.
  • Border guards/police officers must inform the child and the accompanying adult about the possibility of immediate registration for temporary protection status in the Republic of Bulgaria. If the child and accompanying person declare that they wish to register, they receive registration immediately. The child is registered separately, he is issued a separate registration card for an unaccompanied minor/minor foreigner who has been granted temporary protection.
  • In case of doubt about the relationship between the accompanying adult and the child and
    in order to protect his/her interests, the border guards/police officers must immediately report this to the Child Protection Department of the relevant Social Assistance Department in the area of ​​operation of the police department (border service) of the checkpoint/police department and are obliged to take measures under Art. 63 of the Law on Foreigners in the Republic of Bulgaria.

Activities of child protection departments in the administration of social assistance

  • When an accompanying child submits a declaration or receives a signal about a child who is on the territory of the data center, CIA-DSP employees must conduct a social survey and assessment of the child’s situation.
  • If it is determined that it is in the best interests of the child to stay with an accompanying adult, in accordance with Art. 26 of the Law on the Protection of Children, by order of the director of the relevant NSP, the child is temporarily placed administratively with an adult accompanying him at the address indicated by this person.
  • Necessary legal actions for the protection of the child’s personal rights related to his health, education and civil status, as well as for the issuance of identity documents, are carried out by the relevant CPD until the court decides to place the child with a companion (art. 137, paragraph 5 Family Code). These actions can also be performed by the escort after the court confirms the temporary residence order issued by the director of the DSP (Article 137, paragraph 4 of the Family Code).
  • If it is established that the child does not have accompanying adults who have the ability and consent to care for him, or if the conditions for this do not correspond to them, proceed with the placement of the child outside the family within the meaning of paragraph. After the device, the necessary legal actions for the implementation of the rights of the child are carried out by the persons provided for in Art. 137 or art. 173 of the Family Code. In the event that it is determined that registering a child for temporary protection is in the best interest of the child, or the child clearly wishes to do so, the relevant NSP in his/her location will arrange for his/her registration for temporary protection.
  • If it is established that a child has unknown or deceased parents, after being registered under temporary protection, one should proceed with the establishment of guardianship and guardianship by the mayor of the municipality where the child is located in accordance with article 155 of the Family Code, with the exception of cases when the child is placed in social service for children. In this case, the necessary legal actions to protect and exercise the rights of the child are carried out by persons provided for in Art. 137 or art. 173 of the Family Code.

Guidelines for dealing with an unaccompanied child displaced from Ukraine at a border checkpoint, checkpoint (primary reception points), Migration Department, regional police station or SAR registration point/place

Police officer/ The State Agency for Refugees who has discovered an unaccompanied foreign child from Ukraine located on the territory of a border checkpoint, checkpoint, Migration Department, regional police department (ATC) or registration center / place of the State Agency for Refugees, is obliged to immediately notify / filed a signal with the Department of Social Assistance at the current address / place of residence of the child.

The Children’s Protection Department under the NPB, a structure of the Social Assistance Agency, is directly involved in activities and activities for the protection of children. The main function of the Directorate of Social Assistance is the implementation of ongoing practical activities for the protection of children in the municipality. The signal may be received by the Department of Social Assistance in writing or verbally.

An unaccompanied child is subject to extra-family protection measures in accordance with the Child Protection Act. In cases where the establishment took place on weekends and holidays, joint action is taken (Ministry of the Interior and the Department of Social Assistance) to provide police protection and placement in a social home care service. Police protection is an emergency measure that is provided within 48 hours and in cases where the child is: the object of a crime or he is in immediate danger to his life or health, and also when there is a danger that he may be involved in a crime; lost or helpless; left unattended. Specialized bodies of the Ministry of Internal Affairs can place the child in social services at the place of residence, and if necessary, he will be provided with protection.

When the Unaccompanied Child Welfare Office is notified, the official of the Police/State Refugee Agency who has located the unaccompanied child must provide the necessary assistance to verify and evaluate the signal.

The Directorate of Social Assistance, as a child protection authority at the local level, takes the following actions and measures for unaccompanied children from Ukraine after assessing the risk, situation and interests of the child:

  • Consulting services – pedagogical, psychological and legal assistance and social support;
  • Accommodation with relatives or friends/providing financial assistance;
  • Accommodation with a foster family;
  • Placement with a social service in the community or an integrated health and social care service in the community as a last resort.

Placement of a child in a family of relatives or friends, in a foster family and in a social or comprehensive medical and social service at the place of residence is carried out by order of the director of the Department of Social Assistance at the place of residence of the child. .

In cases where an unaccompanied child is accompanied by persons close to the family, on whom the child’s biological parents have “obligated” parental functions, this obligation of the persons concerned must be documented by filling out a declaration of responsibility and care for the child. The declaration must indicate the address/place of residence where it will be possible to conduct a subsequent social survey and assessment of the situation of the child from the CPD. In these cases, work is carried out in the direction of the placement of the child “with a relative.”

The Family Code (FC) contains provisions regarding the legal status of the person with whom the child is. The main regulation is contained in Art. 137 of the Family Code “Special cases of representation and guardianship” and is expressed in the commission by persons caring for the child, all those actions from the content of parental powers that are aimed at ensuring the rights and protection of the interests of the child. Persons with whom the child is in court take the necessary legal steps to protect the personal rights of the child related to his health, education and civil status. When placing a child in an administrative order under Art. 27 of the Child Protection Act, the actions are carried out by the Department of Social Assistance.

Article 27. Obligations of citizens in the field of health protection

1. Citizens are obliged to take care of their health.

2. Citizens, in cases provided for by the legislation of the Russian Federation, are required to undergo medical examinations, and citizens suffering from diseases that pose a danger to others, in cases provided for by the legislation of the Russian Federation, are required to undergo medical examination and treatment, as well as engage in the prevention of these diseases.

3. Citizens undergoing treatment are required to comply with the treatment regimen, including those determined for the period of their temporary incapacity for work, and the rules of the patient’s behavior in medical organizations.

Informed voluntary consent is a relatively new phenomenon for us. Previously, doctors often did not see the need to explain to the patient what kind of operation he would have, what were its possible outcomes. Nowadays, no operation or major medical procedure is performed without the permission of the patient. This protects the rights of both parties: both doctors and patients.

Who signs the voluntary informed consent?

Informed voluntary consent (IDS) is an inalienable right of the patient. It consists in the voluntary acceptance by the patient or his legal representative of the medical intervention proposed by the doctor, the type of examination and treatment. To do this, the doctor in an accessible form gives detailed information about the upcoming intervention, possible complications, options for procedures and conditions for their provision. Voluntariness in this case means the absence of coercion in the form of threats, authoritarian imposition of a medical opinion, manipulation of information.

The concept of informed voluntary consent was first legislated in the Russian Federation in 1993. At present, in Russia, informed voluntary consent “is a necessary condition for the provision of medical care” (in accordance with Article 20 of Federal Law No. 323 “On the Fundamentals of Protecting the Health of Citizens in the Russian Federation”, and the procedure for obtaining it is established by Order of the Ministry of Health of the Russian Federation dated 20.12. 2012).

The right to consent is directly related to legal capacity. In accordance with Article 28 of the Civil Code of the Russian Federation, children under 6 years of age are completely incapacitated, and consent for them is given by legal representatives. Minors from 6 to 18 years of age have limited legal capacity (Article 26, 28 of the Civil Code of the Russian Federation), however, from the age of 15, according to the Federal Law “On the Basics of Protecting the Health of Citizens in the Russian Federation”, adolescents have the right to voluntary informed consent to medical intervention. Thus, from 6 to 15 years of age, legal representatives give consent for a minor, from 15 to 18 years of age – minors independently, although they can use the help of parents or legal representatives, nevertheless sign the form on their own.

Adult citizens give voluntary informed consent on their own. Citizens of age who have been declared legally incompetent give informed voluntary consent through guardians.

Without consent

In some cases, voluntary informed consent from the patient is not required.

According to Part 9 of Art. 20 of Law No. 323-FZ, medical intervention without the consent of a citizen, one of the parents or other legal representative is allowed:

  1. If medical intervention is necessary for emergency reasons to eliminate the threat to a person’s life and if his condition does not allow him to express his will or there are no legal representatives (in relation to persons specified in Part 2 of Article 20 of Law No. 323-FZ). The urgency of indications for medical intervention is determined by a council of doctors. In the event that it is impossible to convene a consultation – the attending (duty) doctor directly with such a decision entered into the patient’s medical documentation.

  2. In relation to persons suffering from diseases that pose a danger to others. The list of diseases that pose a danger to others was approved by Decree of the Government of the Russian Federation of December 1, 2004 No. 715 (viral fevers, leprosy, malaria, glanders, anthrax, plague, etc.).

  3. In relation to persons suffering from severe mental disorders. Features of obtaining consent to medical intervention in relation to persons suffering from severe mental disorders are established by Art. 11 and 29Law of the Russian Federation of July 2, 1992 No. 3185-1 “On psychiatric care and guarantees of the rights of citizens in its provision.”

  4. In relation to persons who have committed socially dangerous acts (crimes).

  5. When conducting a forensic medical examination and (or) a forensic psychiatric examination. The procedure for making a decision on medical intervention in the above cases is defined in Part 10 of Art.
