Neil Gorsuch
Thursday, March 23, Amy Hagstrom Miller of Whole Woman’s Health, host Plaintiff in Historical Health of the Whole Woman v Hellerstedt Supreme Case trial, testimony before a Senate committee on why we have to stop Judge Gorsuch. Amy represents abortion providers, women’s health advocates and people around the country who need access to abortion. Below are her testimonies:
“I speak for abortionists, advocates for health, women’s rights and justice, and the people we serve across the country who deserve access to quality health care provided with dignity and respect.
I am the founder and CEO of Whole Woman’s Health. As a company, we were the lead plaintiff in last year’s landmark Supreme Court case Whole Woman’s Health v. Hellerstedt . I have personally witnessed how high court decisions directly affect women’s lives. I know what happens when politicians find clever ways to deny women’s constitutional rights, and why it’s so important to have independent lawyers who respect precedent and the rule of law.
I am deeply concerned about the appointment of Judge Gorsuch to the US Supreme Court. In fact, Whole Woman’s Health joined 54 other reproductive health, rights and justice organizations in a letter to the Senate opposing Judge Gorsuch’s nomination.
The Supreme Court affirmed the 1973 decision in Roe v. Wade that made abortion legal in the United States for four decades. That hasn’t stopped legislators across the country from creating barriers for women seeking abortion care. More than 2010 restrictive laws have been enacted since 2010, according to the Guttmacher Institute.
The state of Texas has been particularly hard hit by the laws. Anti-abortion lawmakers passed HB2 in 2013, closing more than half of public clinics. The law resulted in women being forced to travel hundreds of miles, even across state lines, to exercise their right to a safe and legal abortion. In some cases, the hurdles were so high that women simply took matters into their own hands.
I will never forget the woman who called us from South Texas just after the law went into effect. We told her that our clinic was forced to close, and now she had to drive 250 miles each way to San Antonio. She told us that she didn’t have the opportunity to take a two-day vacation, find babysitting and money to travel that far. She said, “I’ll tell you what’s in my medicine cabinet and can you tell me how I can get an abortion on my own?”
In our country, where abortion has been legal for more than 40 years, no woman should be forced to take matters into her own hands. Nor should she fear criminalization or imprisonment if she does so.
Will Neil Gorsuch support unnecessary obstacles to our constitutional rights? We need to know.
I also remember a woman who called from West Texas where all the clinics were closed. She, too, was a working single mother with three children. We helped her find a clinic, raised money for an abortion, childcare, transportation, and lost wages. When she arrived at the Dallas clinic eight weeks later, it was already too late to have an abortion in Texas.
Will Neil Gorsuch support laws that limit our constitutional rights to zip codes? We need to know.
We sued the Texas Supreme Court last year and won; in the final ruling, the court called these and other clinic closure laws for what they are – bogus laws that create barriers to healthcare without any medical justification.
Unfortunately, even with our victory this battle did not end. Women need to know about this if their rights are on trial again. We must ensure that they are served by judges who are not committed to the ideological agenda.
